To Thomas Omtirchu (recte Omurchu), Thomas Obruachan, and Matthew Dundonall, canons of Killala (Aladen.). Mandate, as below. The pope has been informed by Mulerus Baret, priest, of the diocese of Killala, that Cornelius Oduda, priest, of the said diocese, in a cause brought by him against Cormac Oduda, priest, of the same diocese, about the [perpetual] vicarage of the parish church of Kildroma in the said diocese, before William Baret, a canon of Killala (who had been appointed judge between them by the apostolic see), obtained a definitive sentence in his favour and against the said Cormac, which became a res judicata; that he afterwards made an agreement with the said Cormac that the latter should give him free and speedy possession of the said vicarage, which Cornelius was then holding, and that he (Cornelius) should answer to Cormac for the mean fruits of the said vicarage for one year then current, which agreement was carried out; that subsequently the said Cornelius laid violent hands on Matthew Dundonall, priest, of the same diocese; that he has committed simony and, having incurred and being under the sentences of excommunication etc. promulgated therefor, has celebrated masses and other divine offices, and taken part therein, in contempt of the Keys, thereby incurring irregularity, about which things he is defamed in those parts. The pope therefore orders the above three, if the said Mulerus will accuse the said Cornelius before them, to summon Cornelius and others concerned, and if they find the foregoing to be true, to deprive and remove Cornelius, and in that event to collate and assign the said vicarage, value not exceeding 4 marks sterling, to Mulerus; whether it be void by such deprivation and removal, or by the death of Oliver Yndiber, or in any other way. To Mulerus Baret, William Obruachan, and Rory Oduan, canons of Killala (Aladen.). Mandate to collate and assign to Thomas Baret, clerk, of the diocese of Killala (who was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of a priest, provost of Killala, and a married woman, to be promoted to minor orders and hold a benefice without cure) the perpetual vicarage of the parish church of Kylligan in the said diocese, of lay patronage and value not exceeding 6 marks sterling, so long void (by bishop Bernard's deprivation, for his faults and demerits, of John Odonchw, although the said John has, after the said bishop's sentence, detained possession by his own temerity for between three and four years, without collation or provision or tittle of other right) that by the Lateran Statutes its collation has lapsed to the apostolic see; summoning and removing the said John and any other unlawful detainer. To the bishop of Tarazona (Tyrason.), the dean of Brechin, and the provost of St. Mary's at St. Andrews. Mandate, as below. The recent petition of John Barrij (i.e. Barry), clerk, of the diocese of Brechin, contained that on the voidance, by the death of David Seras, of the perpetual chaplaincy at the altar of St. Mary in the chapel of St. Clement, within the bounds of the parish of the town of Dunde, in the said diocese, which [chapel] is of the patronage of the provost and twelve bailies of the said town, laymen, (fn. 4) the said provost (fn. 5) and twelve bailies presented the said John within the lawful time to John, bishop of Brechin, who admitted the said presentation, and instituted and made provision to him, and that in virtue of the said presentation, institution and collation he obtained possession of the said chaplaincy, and still holds it. The said John's petition adding that he doubts whether the presentation, institution and provision hold good, and the pope having learned that the said chaplaincy is still void as above, he hereby orders the above three to collate and assign to the said John, who is only a clerk, the said chaplaincy, which is without cure, and in whose foundation it is said to be provided that as often as it becomes void one in priest's orders shall be presented to it, and the value of which does not exceed 8l. sterling a year. To the bishop of Elphin, the abbot of St. Mary's, Boyle (de Buellio), in the diocese of Elphin, and Cormac Omochan, a canon of Elphin. Mandate, as below. The recent petition of Fergallus Ygormuly, prior of St. Mary's, Inchmacnerin (de Insula Macnery), O.S.A., in the diocese of Elphin, contained that Pius II (on being informed [by the said Fergallus] that Thomas Obenachan, then prior of the said monastery, had openly and notoriously kept with him a certain concubine, (fn. 6) had committed perjury, and had neglected to reside in the said monastery and exercise the cure of souls thereof and of the convent, and to exercise divine offices therein), ordered Malachy Omochan, John Offloynd and John Ohaigadan, canons of Elphin, if the said Fergallus would accuse the said Thomas before them, to summon Thomas and others concerned, and if they found the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said priory, conventual and with cure, to Fergallus; that, upon Fergallus bringing the said Thomas before the said Malachy, the latter promulgated a definitive sentence in favour of Fergallus and against Thomas; that, although the latter appealed therefrom to the apostolic see, falsely alleging it to be unjust, he neglected to prosecute the appeal within the lawful time, wherefore the said sentence became a res judicata; that, although the said Fergallus obtained by canonical collation the said priory, thus void, and held it for some time, the late Maurice Macdonchayd, a canon of the said monastery, with the help of lay power captured Fergallus's father and brother, despoiled them of their goods and imprisoned them, and compelled the said Fergallus, yielding to natural fear, (fn. 7) to give up to Ca[r]bricus, Maurice's brother, a layman, the said letters; that, without making mention of the foregoing circumstances, the said Maurice got provision made to him surreptitiously, by papal authority, of the said priory, void, as he alleged, by the said Thomas's free resignation, intruded himself and detained possession for his lifetime, thus despoiling the said Fergallus of the said priory; that, upon the latter's seeking, after the death of the said Maurice, to be restored to the said priory by Magonius, abbot of the monastery of Holy Trinity de Lochoe (recte Lochce), O. Prem., in the said diocese, then acting as commissary of Nicholas, bishop of Elphin, who was in remote parts, the said abbot, wrongfully at Thomas's instance proceeding, etc., annulled (although his own annulment was null) the said Malachy's sentence; wherefore Thomas detained possession of the said priory, until his son Donatus (whom he had made a canon of the said monastery), got provision made to him by the same papal authority without making any mention of the said deprivation, removal and collation etc., whereof he was not ignorant, of the said priory, as being void by the death of the said Maurice, still unduly detaining possession thereof, as does also Ranaldus Occolla, priest, of the perpetual vicarage of the parish church of Ardcarna in the said diocese, canonically united to the said monastery. At the petition, therefore, of the said Fergallus for his restoration to the said priory and vicarage, the pope hereby orders the above three to summon the said Donatus and Ranaldus and others concerned, and, after restoring the said Fergallus, to hear both sides, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure.
