(f. 55.)		 To the dean of Derry (Deren.), and Donald Ocaeltid an Patrick Omargay, canons of the same. Mandate (the pope having been informed by John Olucharean, dean of the rural deanery of, the place of Tulathoge in the diocese of Armagh, that Patrick Olucharean, a canon of Armagh, and William Olucharean, perpetual vicar of the parish church of Dompnachmor in the said diocese, have openly committed perjury; that Patrick promised and paid a sum of money to Maurice Olucharean in order that the latter might resign to the ordinary in Patrick's favour his rectory of the parish church of Tulachnesgan in the same diocese (which he did), and in order that provision might be made thereof to Patrick; that the said William promised and paid a sum of money to the ordaining bishop in order that he might be promoted to holy orders; and that they have in other ways committed simony, about which and divers other crimes [not here expressed] they are much defamed in those parts) if and after John (who was lately made a clerk notwithstanding his illegitimacy as the son of a priest and an unmarried woman, and obtained the said deanery by canonical collation) accuses Patrick and William before the above three, inasmuch as from fear of their power he has no hope of obtaining justice in the city and diocese Armagh, to summon Patrick and William and others concerned, and if they find the foregoing to be true, to deprive and remove Patrick from the said canonry and the prebend of Dompnachmor, and William from the perpetual vicarage of the said church, and in that event to collate and assign them, value not exceeding 12 and 6 marks sterling respectively, to John; notwithstanding that he holds the said deanery, which is without cure and is a removeable office, value not exceeding 2 marks sterling. He is hereby dispensed to be promoted to all even holy orders, and receive and retain the canonry and prebend and vicarage together with the deanery, notwithstanding the said defect etc. Vite etc. (P. and G.   • 1. On the back of the volume is the usual modern description in Latin: ‘1460. An. iii. Pius ii.’ There is no contemporary flyleaf, but the usual partly illegible contemporary description occurs on the bottom edge of the volume: ‘Primus de prebendis, de exemptionibus [curialium], de curia, de litteris dominorum cardinalium, [de] provisionibus prelatorum, [de] tabellionatus officio et plenaria [remissione] anno (? annis) secundo et iii. domini nostri domini Pii pape secundi.’ This description is only legible with the help of the headings of the various quires in the volume. The first quire in the volume was evidently headed ‘de prebendis vacantibus.’ The quire which begins on f. 76 is headed ‘de exemptionibus curialium anno (sic) ii et iii,’ i.e. exemptions of members of the papal court (e.g. abbreviatores and scriptores) from the jurisdiction of their ordinaries, in virtue of Clement VI's bull of exemption ‘Ad perp.rei mem. Dudum felicis recordacionis Johannes pape xxii.’ Fol. 100 is headed ‘De curia [anno] iiio’; f. 122 ‘[De] litteris domino[rum] cardinalium [anno] iii.’; f. 140 has ‘de provisionibus prel torum [anno] iiio’; f. 160 has ‘de tabellionatus officie [anno] iii'; f. 214 has ‘de plenaria [remissione anno] 3o domini Piii’ (sic) and this heading embraces the contents of the rest of the volume, including indults of portable altars etc. The text of the volume extends from [i.] to f. cccxvii., of which the first two are mere fragments. Mgr. Wenzel's numeration note does not occur.
  • 2. On f. 223 is an indult Devotionis tue, i.e. an indult of plenary remission, dated at St. Peter's, Rome, 1461, 12 Kal. June anno 3, to John Bernal, a Friar Minor, whose diocese is not mentioned.
  • 3. Here and in other following cases the amount of the tax is not enclosed within the name of P. de Varris.
  • 4. On f. 263d. is an indult for John Benedicti, nobleman, and his wife Joan, and for each of them, under date 1461, 6 Non. May anno 3, to have a portable altar. Their diocese is not mentioned.
  • 5. On f. 276d. is an indult of plenary remission to William Gouen, an Augustinian friar, without mention of his diocese, dated 1461, 3 Non. July anno 3.
