Dispensation to him, who is in about his seventeenth year, and is of noble and knightly birth, (fn. 2) and is studying letters, at his own petition and that of James king of Scots, to receive as soon as he attains his eighteenth year, whilst engaged in the said study, any parish church or its perpetual vicarage, and to retain it in commendam till he attains his twenty-second year, and thereafter to retain it in titulum, and to resign it, simply or for exchange, if he please, and cede such commenda. and receive instead another parish church or its perpetual vicarage, and retain it in commendam, until his said twenty-second year, and thereafter to retain it in titulum as above. notwithstanding the said defect of age etc. Nobilitas generis, vite etc. (Her. and Ja. Dispensation to receive and retain for life with the said archdeaconry, which is a non-major non-elective dignity with cure, and to which a certain prebend of the said church is canonically annexed, and whose value and that of the said annex does not exceed 12 marks sterling, with which he cannot live becomingly, any other benefice with cure or otherwise incompatible in the province of Dublin, even if a parish church or its perpetual vicarage or a dignity etc., even a major or a principal dignity, etc., and to resign them, simply or for exchange, as often as he pleases, provided that he do not hold two parish churches or their perpetual vicarages, or two major or principal dignities, or such mixed. Dispensation to him, who is of noble birth, a subdeacon and in about his twentieth year, and has studied in the university of Oxford for about two years, and is still studying there, to receive and retain any benefice with or without cure, even if a parish church or its perpetual vicarage, or a dignity etc., even elective and with cure, provided that such dignity be not major nor principal, and not to be bound by reason of such benefice to be promoted to any higher orders until he has completed his twenty-fourth year. To the abbots of Molanfyd, Kyrieleison and Fermoy (de Castro dei), in the dioceses of Lismore, (fn. 7) Ardfert and Cloyne (Clonen.). Mandate as below. A canonry of Limerick and the prebend of Donakmor therein became void by the death of Matthew [son] of James Macconmara at the apostolic see, and therefore reserved to Calixtus III, who died without having disposed thereof, and are therefore still void and reserved to the present pope, notwithstanding which Gilbert Artur alias Gibun, clerk, of Limerick has, under pretext of a collation and provision made to him by authority of the ordinary, unduly provision made to him than six years but less than seven, after and contrary to the said reservation, and still detains possession. And the recent petition of Matthew [son] of Donald Macconmara, clerk, of the diocese of Limerick, contained that when he was a boy and had begun to study letters, and was very greatly tormented by a horrible boil in his flesh, the late Rory Okeruil, clerk, of the diocese of Killaloe (Laonien.) gave him a hard kick in the place where he was suffering pain, and by thus increasing and renewing Matthew's pains stirred his anger, wherefore Matthew without reflection and on the impulse of the moment, and with the readiness of his age, threw after Rory a small knife which he was holding in his hands, without the intention of killing him, and accidentally hit Rory with it, so that Rory died of the blow, although it was not thought likely to be mortal. (fn. 8) The said petition adding that Matthew, who was not otherwise guilty of the death of Rory, made due satisfaction to Rory's parents for the said clericide and excess, and desires to serve God in the ecclesiastical state and to pray for Rory's soul, the pope hereby orders the above three to absolve him (who alleges that he is of a race of dukes by both parents and in about his sixteenth year, and has on account of the said clericide betaken himself to the Roman court with very great labours. perils and cost, and who, from fear of the power of the said Gilbert, cannot safely meet him in the city and diocese of Limerick in the matter of the said canonry and prebend) from sentence of excommunication incurred by reason of the foregoing, and from the said guilt of clericide and, enjoining penance etc., dispense him, on account of irregularity contracted. to act as a clerk and receive and retain the said canonry and prebend if conferred on him in virtue of these presents and rehabilitate him; and moreover. in the event of their doing so, to summon Gilbert and others concerned, and collate and assign the said canonry and prebend, value not exceeding 8 marks sterling, whether void as above, or by the resignation of the said Gilbert or of Cornelius Magmahuna or of Thomas Dyward, or in any other way, to Matthew. To Gerald de Geraldinis, Dermit Okeywe and Maurice Osullewayn, canons of Cloyne (Clonen.). Mandate as below. The recent petition of Thady Yhurain, rector of the rural church of Kylnanania in the diocese of Ardfert, contained that on the voidance of the parish church of Dwngorne in the diocese of Cloyne, of the patronage of laymen, by the death of Matthew Oregayn, (fn. 9) John Baru (? recte Barri), layman, the sole patron, presented the said Thady within the lawful time to Jordan bishop of Cloyne, who by his ordinary authority instituted him, in virtue of which presentation and institution he obtained possession of the said church, from whose fruits he cannot, on account of their slenderness, maintain himself and pay his burdens; and that if the perpetual vicarages of the parish churches of Clommolt and Danghindonwam in the said diocese (which are not more than two miles from the said church of Dwngorne and not more than half a mile from its bounds, and from the fruits of neither of which can a vicar be conveniently maintained, and on account of the slenderness of the fruits of which vicarages it is hard to find anyone willing to serve them, and which vicarages can be served by the rector of Dwngorne) were united to one another for Thady's life, and provision of them made to him, he, who is of a race which is wont to give hospitality to the poor and needy from every side, (fn. 10) could be more becomingly maintained, and divine worship would be in no small measure augmented by his efforts in each of the said churches. The said petition adding that Thady now doubts whether the said presentation and institution hold good, and the pope having learned that the said church of Dwngorne is still void as above, and the vicarage of Clommolt by the death of John Ymurchw, and that of Danghindonwam by the death of the said Matthew, the values of which church and vicarages do not exceed 16, 2 and 1½ marks sterling respectively, the pope hereby orders the above three, if they find the foregoing to be true, to unite the said vicarages to one another for Thady's life, and in the event of their so doing, to collate and assign the said church of Dwngorne and the said vicarages to Thady, notwithstanding that he holds the rectory of Kilnanania. without cure and value not exceeding 6 marks sterling. He is hereby dispensed to receive and retain together for life the said church of Dwngorne and vicarages, and to resign it and them, simply or for exchange, as often as he pleases and receive and retain for life instead two other incompatible benefices, even if they be parish churches or their perpetual vicarages or dignities etc., provided that they be not major or principal dignities, nor such mixed, and provided that the fruits etc. of such two incompatible benefices do not exceed a yearly value of 20 marks sterling. Mandate—the pope having learned that the perpetual vicarage of the parish church of Fyduyn in the diocese of Ossory became and is void (because Laurence Omeachyr, its former holder, when holding the rectory of the parish church of Achabeloyr in the said diocese, obtained the said vicarage by collation made to him by authority of the ordinary, and detained the vicarage together with the said rectory contrary to ‘Execrabilis,' not only for a month but for three years and more. but less than four years, without having obtained any canonical dispensation), and is reserved to the pope in virtue of the said constitution—to collate and assign to Cornelius Macagowand alias Okennedy, rector of the parish church of Beoley alias Wnayng in the said diocese, who is a priest, the said vicarage, value not exceeding 12 marks sterling, summoning and removing the said Laurence etc.; notwithstanding that he holds the said rectory of Beol[e]y, value not exceeding 6 marks sterling. The pope hereby dispenses Cornelius, who alleges that the said vicarage and rectory of Beol[e]y are distant about a mile of those parts from one another, to retain the said rectory of Beoley for life together with the said vicarage, if he obtain it in virtue of these presents. [i.e. P. de Varris],’ and the corresponding: ‘Rubricatus est.’ A like contemporary description ‘Secundus …’ occurs, as usual, on the bottom edge of the volume. The usual numeration note by Mgr.
