To the archbishop of York and the abbot of St. Mary's without the walls of York. Confirmation and mandate, as below. The recent petition of the abbot and convent of the Cistercian monastery of St. Mary, Fountains, contained that upon its being set forth to Eugenius IV on their behalf that a dissension having arisen between them, who had held, as they were still holding to their uses, as appropriated to them, the parish church of Croschewacte (fn. 6) (rectius Crosthewaite) in the diocese of Carlisle, and Walter Lombarde (sic), perpetual vicar of the said church, about certain articles contained in an agreement made by the late Ralph bishop of Carlisle in regard to the portion of the vicar, the parties agreed that the vicars should have, as such portion, a tenement with an enclosure contiguous thereto and enclosed with hedges, (fn. 7) which [tenement] the former vicars were wont to inhabit in the town of Croschewacte (sic) and for the fodder of their horses etc.… which later agreement was approved and confirmed by Marmaduke bishop of Carlisle, patron of the said vicarage, and its observance decreed under pain of the greater excommunication (as in Cal. Papal Lett., VIII, pp. 352–3) the said pope ordered certain judges (viz. the prior of St. Oswald's, Nostel, and the treasurer of York, as ibid.) to confirm the said later agreement and the said confirmation etc. (as ibid); and that upon its being subsequently set forth to the same pope Eugenius by the abbot and convent that the second (alter) of the said executors had duly confirmed and approved the said later agreement and confirmation etc., the said pope himself by other letters approved and confirmed the same later agreement and confirmation etc. At the petition of the said abbot and convent, the present pope hereby confirms and approves the said later agreement and confirmation etc., and orders the above archbishop and abbot to publish the foregoing, when expedient and when requested by the abbot and convent, and cause the said later agreement and confirmation etc. to be observed, and not permit the abbot and convent to be molested in respect thereof, compelling obedience by ecclesiastical censure, without appeal. Eugenius IV (i) dispensed him to receive and retain for five years with the said church of St. Clement any other benefice with cure or otherwise incompatible, even if another parish church or its perpetual vicarage, or a major or principal dignity etc., and to resign them meanwhile, simply or for exchange, as often as he pleased, in virtue of which he obtained, collated to him by authority of the ordinary, the chancellorship of Chichester, a non-major non-elective dignity, (ii) during the said five years dispensed him to retain the said chancellorship and church together [for life], and to resign them, simply or for exchange, as often as he pleased, and in their stead to receive and similarly retain for life two other incompatible benefices, even if major or principal dignities or parish churches or their perpetual vicarages, or such mixed, after which he resigned the chancellorship and obtained by the same authority the parish church of St. Bride, London, which he at present holds with St. Clement's. To all Christ's faithful who shall see the present letters. Relaxation, as below. The pope has learned that the Augustinian monastery of Christchurch Twynham, in the diocese of Winchester, formerly founded for a prior and fourteen canons, is situate between two great rivers near the sea, so that there is a daily ebb and flow of the sea, by reason of which the monastery and places adjacent are often flooded and the monastery in great part demolished and in need of great repair; that through their impoverishment by wars and other misfortunes, not only are their means insufficient for the repair of the buildings, some of which have utterly fallen with age, whilst others are threatened with ruin, but also for the maintenance of the prior and convent, (fn. 11) who are often harassed by hostile incursions of the French and others by way of the sea and compelled to cease from the celebration of divine offices; that for the said repair and maintenance etc. the alms of the faithful are very necessary and useful; and that Catherine Chydyok, relict of John Chydyok, knight, of the said diocese, has, in accordance with his will, founded in the said monastery a certain chapel, for the perpetual celebration of masses therein, with an altar in the same, beneath which altar lies buried the body of the said knight, has caused herself to be buried beneath the said (sic) altar, and near her husband, and has made to the monastery other charitable gifts. The pope therefore, out of consideration for the said knight and his wife, who made charitable gifts to the said monastery in aid of its necessities, (fn. 12) and at the petition of the executors of the will of the said Catherine, especially John Cramborne, a canon residentiary of Salisbury, supervisor of the will, and Elias Broun, esquire, and John Bellew, grants hereby to all penitents who on the feasts of Holy Trinity and St. Faith the Virgin, from the first to the second vespers, visit and give alms for the said repair, conservation and maintenance, each time they do so, a relaxation in perpetuity of seven years and seven quarantines of enjoined penance. He wills and orders that whatever is given for the fabric shall not be applied, without special licence of the said supervisor and executors, to any other purposes than the work of the fabric of the church or to the buildings of the said monastery belonging to the said church or monastery.
