Dispensation to him, a priest and of noble birth, to receive and retain for life any benefice with cure wont to be governed by secular clerks, even if a parish church or its perpetual vicarage, or a chantry or an annual service wont to be given to secular priests in England, and to resign it, simply or for exchange, as often as he pleases, and also to wear the habit of his profession under an honest priestly garment of dark (obscuri) colour. To all Christ's faithful who shall see the present letters. Relaxation in perpetuity (the pope having learned that the inhabitants of the town of Beniptori (rectius Bempton) in the diocese of York, have to the glory of God and in honour of St. Michael the Archangel caused a certain chapel in the said town to be erected by the ordinary into a parish church, and have caused it to be enlarged, or rather almost entirely built at great expense, (fn. 7) and that the said church is not yet entirely provided with books and chalices and other ecclesiastical ornaments) of seven years and seven quarantines of enjoined penance to penitents who on the feast of St. Michael the Archangel in September, from the first to the second vespers, visit the said church and give alms for the said books etc. and for its fabric and conservation. To all the inhabitants of the town of Poynton in the diocese of Lincoln. Grant and indult, at their recent petition (containing that it was formerly granted to them by papal authority that they might hear masses and divine offices in a certain chapel of the said town, and confess their sins to a fit priest therein, and receive from him the sacraments of Eucharist and Extreme Unction; and that on account of frequent floods in those parts it is at times dangerous for them to go to their parish church of Simpryngham in order to receive the other sacraments from the rector thereof), to have a baptismal font erected in the said chapel, have a cemetery hard by the chapel consecrated by a catholic bishop, have the sacrament of baptism and the other sacraments administered to them by the priest of the chapel for the time being, and have their dead buried in the said cemetery, saving the right of the said church. To the bishop, the dean and the archdeacon of Glasgow. Mandate, as below. The pope recapitulates his late mandate ordering the bishops of Orte and St. Andrews and the abbot of Dumfer[m]lim in the said diocese, at the petition of the abbot of the Benedictine monastery of St. Thomas the Martyr, Alberbroth (sic), in the diocese of St. Andrews, to inhibit all bishops and ordinaries, except only the bishop of St. Andrews, the ordinary, to molest the said abbot and convent etc., as above, Reg. Vat. CCCCLXXXV, f. 275d. (fn. 8) The recent petition of Thomas bishop of Aberdeen contained that the greater part of the parish churches in his diocese are united to various monasteries of the order of St. Benedict and other orders, which churches are for the most part ruinous and lacking in ornaments and other things necessary for divine worship, on account of the avarice and neglect of the religious who hold them and who have little regard for them except in the taking of their fruits, and very many of which would, if it were not for the care of the ordinaries, be totally fallen and destroyed, so that if the said abbot and convent had informed the pope of the foregoing they would not have obtained such letters from him; and that moreover, when the aforesaid is ripely considered, it is evident that the said letters are liable to be held surreptitious and were granted by and extorted from the pope under false pretences, inasmuch as the said bishop of Aberdeen and other bishops of those parts do not unduly and without cause vex the said abbot and convent, but reasonably and fittingly etc. admonish and require them by their ordinary authority to come to synods etc. The pope therefore (fn. 9) orders the above three to summon the said abbot and convent and others concerned, and if they find that the pope's said letters emanated from false pretences, to annul them and their contents as far as regards parish churches in the city and diocese of Aberdeen only, the said letters to remain in force as regards other [such churches], to decree and declare that they do not extend to them [the parish churches in the said city and diocese], but that the said parish churches in the said city and diocese of Aberdeen are altogether excepted from the said letters, and not to permit the said bishop to be molested by the said abbot and convent or any others contrary to such annulment, decree and declaration. Indult (the pope having learned that a number of his predecessors granted to their church and the prior for the time being that he might wear the mitre, ring (anulo) and other pontifical insignia, and in the said priory and other churches belonging to the prior and convent give solemn benediction after masses, vespers and matins, provided that no bishop or papal legate were present; and they alleging that in the said grant concerning the mitre and pontifical insignia it was not expressed that the prior for the time being may use the staff and ring (annulo) (fn. 11) and almuce) that the present prior and his successors may wear not only the aforesaid, namely, the ring (annulo) and other pontifical insignia, but also the staff and almuce, and give benediction after mass in the said priory and the parish churches belonging to the prior and chapter, provided that no bishop or papal legate be present. To the archbishop of Tuam. Mandate, at the recent petition of Bernard Oheadra, dean of Achonry, containing that he (desiring to recover a certain castle built by the bishop of Achonry on lands of the church of Achonry, granted by the said bishop to the said dean Bernard and his brothers under a yearly pension, and thereafter violently taken away from the said bishop and from Bernard and his brothers by the late John Oheadra, layman, captain of his clan (gentis), and detained for many years by the said John and his sons) gathered together a number of men-at-arms for the purpose of capturing Rory Oheadra, the said captain's son, in order to recover the said castle, expressly forbidding them to mutilate or kill the said Rory or any of his servants; that, going with the said men-at-arms to capture Rory, and holding his unsheathed sword in his hand, in a fight between them and the said servants two laymen were killed in his presence and the said Rory taken prisoner; that he handed over Rory to his kinsmen to guard, and begged and invited them with gifts to keep him safe from Rory's kinsmen and friends; that, after disputes and wars had broken out between his kinsmen and those of Rory, and manslaughter had taken place, and after peace had been made, war broke out again, and Rory repaired with his kinsmen and friends to destroy and capture the said castle, and was trying to do so when one of his men-at-arms was killed by one of the said dean's friends in the dean's presence. Seeing that, as the said petition added, dean Bernard did the foregoing to recover the said castle and lands, although some allege the contrary, and that he had expressly forbidden, as stated, his men-at-arms to mutilate or kill any one, and that he himself mutilated or killed nobody with his own hand, etc., the pope orders the above archbishop to provide for him, enjoining penance etc. Sedes apostolica, pia mater.
