The recent petition of John Ymadagayn, archdeacon of Annaghdown, contained that prior Thomas and the convent of the house of the hospital of St. John Baptist, Tristolldiarmod, of the order of the Cruciferi in the diocese of Dublin (considering that the rectors of the parish churches (fn. 6) of Muntermuraiad, which lawfully belong to the said house and are canonically annexed thereto, on account of the distance and dangers of the roads, the interferences and encroachments of laymen and clerks, and other lawful causes, could not conveniently rule and govern and reside in the said churches in person, and that if the said churches were granted to a good man of those parts as procurator, it would be for the benefit of the said house and churches) granted, after careful consideration, the rectory of the said churches to the said John in perpetual procuration, and unanimously appointed him procurator alike of the said house as of the said churches, with the condition of his being bound to pay yearly two marks of the usual money of those parts to the prior and convent in token of lordship, as is said to be more fully and in greater detail contained in the letters of the prior and convent drawn up in the matter. At the said John's petition, the pope hereby orders the above official, if he find the foregoing to be as stated, to confirm the said grant and appointment etc. by papal authority. (f. 255.)		 To Francis bishop of Terni (Interannen. rectius Interamnen.), legate of the apostolic see, the archbishop of Canterbury and the bishop of London. Mandate, as below. The pope has learned that the monastery of St. Peter of Westminster, near London, and a number of other ecclesiastical places called ‘sanctuaries’ are the resort of almost innumerable criminals, malefactors and debtors etc., who enjoy full security and immunity therein, in virtue of the foundation of the said places or of royal privilege, confirmed by papal authority, and that not only do they obtain therein the fullest protection of their persons, so that all execution of justice is inefficacious against them, but the said criminals and malefactors, abusing the immunity which they enjoy, go forth by night from the said places with their accomplices and commit robberies, mutilations and homicides etc., and then return to the said places, which for many years have constituted dens of thieves and robbers. (fn. 11) The pope, therefore, considering that if former kings of England and the other faithful, who by papal authority and the authority of the said kings founded such places, wished them to acquire such great immunity, they did so in aid of human frailty, and not in order that their pious purposes should be perverted into hatred and evil, motu proprio orders the above three or the said bishop of Terni to make inquiry into the foregoing, and if they find them to be as stated, and if the consent of king Henry, who is the patron of a number of the said places, be given, to modify etc. the privileges, immunities, exemptions and liberties of all the said places, or, if it seem to them more expedient, to reform them, and to ordain whatever else may be necessary for the remedying of the said abuses etc. Detestanda iniquorum perversitas. Relaxation in perpetuity (the pope having learned that the parish church of St. Peter without the walls of Calais in the diocese of Térouane, which was formerly, by reason of the wars and other misfortunes with which in times past those parts were afflicted, burned by fire and utterly destroyed, has been begun to be re-built and repaired, together with a chapel of St. Mary therein, for whose completion and conservation, inasmuch as it is without yearly rents, the help of the faithful is the more opportune; and desiring that the said church and chapel shall be thus completed and conserved, and furnished with books, chalices and other ecclesiastical ornaments) of four years and four quarantines of enjoined penance to penitents as often as they visit the said chapel on the feasts of the Assumption, Nativity, Conception, Purification and Annunciation of St. Mary the Virgin, from the first to the second vespers, and give alms for the completion and conservation of the said chapel and church, and for their fabric, and for the purchase or provision of the said books and other ornaments, or bequeath or give anything in their wills or otherwise. A single (unicus) place in their province of Ireland, called Magyn in the diocese of Killala (Aladen.), was lately built by authority of letters of Nicholas V, (fn. 13) which contained inter cetera the following clause:—
‘We grant hereby to all and singular the friars of the order who shall dwell in the said place that they may enjoy all and singular the privileges, liberties, exemptions, immunities and indults granted by the said or any other authority to the houses or places and friars of the said province and order of the Observance.’
Before, however, the said grant Eugenius IV, and after it Calixtus III, granted a number of liberties, exemptions and indults or provisions to the friars of the Observance, of which liberties etc., on account of the great distance of their country and their separation from the intercourse of the said friars, and the smallness of their number, and the consequent difficulty of crossing the sea, they were ignorant, and were therefore ignorant also of the modes of the rule and life of the order of the friars of the Observance, so that they were under immediate rule, and therefore under the rule of the minister-provincial of Ireland, contrary to the common custom and rite and privileges or indults of the order; for, in accordance with the provisions and indults of the said Eugenius and Calixtus, the friars of the Observance in parts ultramontane may and ought to be under the vicar-general, and those of each province ultramontane under the vicar-provincial of that province, the vicargeneral ultramontane may and ought to be elected by the friars of the provinces ultramontane, and the vicar-provincial may and ought to be elected by the friars of his province and confirmed by the minister-general, and is, upon the latter's refusal, confirmed ipso facto by papal authority, and the said friars have to live, in accordance with certain forms and liberties contained in papal letters, under the said vicars. As soon as the said friars of the province of Ireland learned the said papal provisions and the life and rule of their brethren of the Observance, they began to rule themselves in accordance therewith, electing and obeying one of themselves, namely, friar Malachy Ocluban, as their vicar-provincial, in accordance with the letters of the said Calixtus, and behaving thenceforward as subjects of the vicar-general ultramontane. (fn. 14) Shortly before the time of the said election, however, another provision by the present pope had emanated, for the peace and concord of the friars conventual and of the Observance, containing the following clause:—
‘For the preservation of peace and quiet between you we will and order, under pain of sentence of excommunication, to be incurred ipso facto by contraveners, that one part shall not under any pretext venture to invade and take or otherwise disturb the places, convents or nuns’ monasteries of the other. (fn. 15) ’
Of the emanation of which provision they were entirely ignorant, but now, having learned it, fear lest their said election etc., and the consequences thereof, are not valid. The pope, therefore (desirous of helping all, especially those who are far removed and are therefore, without guile and even rather without fault, ignorant of papal ordinances), validates and confirms, at the petition of the said friars their said election etc. and all the consequences thereof, and declares that they, the friars of the said convent and province, present and future, shall remain under the vicar-general ultramontane and live according to the papal provisions and common rite of the friars of the Observance, notwithstanding the pope's said letters and those of any of his predecessors, or the statutes and customs of the said order, and any other things to the contrary. The recent petition of William, abbot of the Cistercian monastery of Deire in the diocese of Aberdeen, and David Bane, a monk of the same order, contained that a suit arose lately between them about the said monastery and the dignity of abbot thereof, and that after the cause had been ventilated for some time they for the sake of peace etc. made, with the consent of the convent, an agreement to the effect that abbot William should remain in peaceable possession, that David should give up and renounce in William's favour the said suit and cause and all right belonging to him in or to the monastery and the said dignity, which he afterwards did, and that a yearly pension of 20l. of the usual money of Scotland, which amount to about 8l. sterling, should be paid by William and his successors to David for life or until provision were made to him, and he obtained possession of, another monastery of the same order, and that also, for his costs in the prosecution of the said abbey of Deire, 200 marks of the said usual money should be paid to him within the next following five years; and that abbot William bound himself thereto, likewise with consent of the convent, as is more fully contained in a public instrument.
