(22 Nov.)
Mantua.
(f. 113d.)
To the abbot and convent of the Cistercian monastery of Whalley in the diocese of Coventry and Lichfield. Grant, as below. Their recent petition contained that they have held for a long time the parish church of Blakeburne in the said diocese by grant to their said monastery, a competent portion being reserved for a vicar or rector, which church, sufficiently endowed, has been wont to be governed by secular priests presented by them as the patrons to the ordinary and by him instituted; that it has often happened that on the voidance of the said church they have, on account of the importunate prayers of magnates and nobles of those parts, and the fear of molestation thereby, presented secular priests as vicars or rectors who could not conveniently exercise the cure of souls nor be useful to the monastery and church, to the injury of the said monastery and church and of the souls of the parishioners. The pope therefore, in order to remove all occasion for molestation etc., grants them indult that in future the said church shall at each voidance be governed by one of their monks, a priest, to be presented by them to the ordinary, and by him instituted, the cure of souls to be exercised by the same. Exigit vestre devotionis. (Ja. Lucen. | xxx. B. de Brendis. Jo. de Tartarinis.) [In the margin: Novembris. 1 p.]

Footnotes

  • 1. On the back of the volume is the usual modern red leather label, with: ‘Pii ii. Secret. Lib. v. T. xxxv.’ Inside the volume is the usual front half of the original sheepskin binding, with the contemporary description, of which ‘anno secundo’ and ‘Decembris’ are faintly visible, in addition to the usual unimportant contemporary and later notes. The text consists of 6 unnumbered folios, and ff. i. to iiiicxxxix., on the last of which is the usual ‘Gaspar Blondus.’
  • 2. Without the usual exchange clause.
  • 3. i.e. the new name of Ja. Lucen. after his adoption by pope Pius into the Piccolomini family. Cf. a bull summed up in a marginal note on f. 145 of the present Register DII: Ja. Lucen. fit de Pi[c]colominibus. He has just occurred above, f. 113d., with his old name Ja. Lucen. See also above, p. 195.
  • 4. seu ipsa parrochiali ecclesia per te dimissa. Cf. the next.
  • 5. seu illa per te dimissa. Cf. the preceding.
  • 6. cum cura vel sine cura vel cuiusvis ordinis regulare. The word ‘seculare’ has probably dropped out before ‘vel.’
  • 7. qui ut asseris nobilis viri Wilhelmi Bourghier Fytzwarenclare memorie Edwardi olim regis Anglie prenepotis [rectius pronepotis] ac carissimi in Christo filii nostri Henrrici (sic) nunc regis Anglie illustris in quarto gradu consanguineus, necnon venerabilis fratris nostri Thome Cantuariensis archiepiscopi ac dilecti filii nobilis viri Hunnfredi ducis Bokyngamie fratris natus, et in nono tue etatis anno constitutus existis.
  • 8. simplicia beneficia sine cura.
  • 9. seu illa per te dimissa.
  • 10. valorem animum (rectius annuum).
  • 11. beate Marie et sancte Gawswiche (rectius Eanswithe, as below, f. 389) de Flokston’ (rectius Folkston’).
  • 12. The words ‘Martini Chellisfeld Rosen.’ have been added in a space which had been left for the purpose.
  • 13. The Quarto Kal. Maii is added in the margin.
  • 14. The vii. Id. Augusti is added in the margin.
  • 15. The mention in the non obstantibus clauses of the constitutions of Otto and Ottobon, sometime legates in England, alone shows that the above friar is English.
  • 16. The name of his monastery is not mentioned.
  • 17. et [in] universitate studii Auxonen. (sic) actu studes.
  • 18. Datum Senis anno incarnationis dominice millesimo quadringentesimo quinquagesimo nono, decimo Kal. Maii pontificatus nostri anno secundo. If ‘anno secundo’ be right, ‘1459’ must be an error for ‘1460.’ Cf. the date of the next following letter.
  • 19. ‘x/v’ presumably an error for ‘v/x.’
  • 20. The mention in the non obstantibus clauses of the constitutions of Otto and Ottobon, sometime legates in England, confirms the evidence of Crouland's name as to the friar's nationality.
  • 21. per clericos seculares vel cuiusvis ordinis regulares personas gubernari consuetum,’ the ‘personas gubernari’ being a variant for the more usual ‘regi et gubernari.’
  • 22. Also written ‘Welburn’ in the body of the dispensation.
