(f. 33d.)		 To the bishops of Oviedo (Oveten.) and Aberdeen, and William Fratour, a canon of Aberdeen. Mandate, as below. The recent petition of William Gordon, clerk, of the diocese of Aberdeen, contained that on a canonry of the church of St. Mary, called the chapel royal, at St. Andrews and the prebend of Strabok therein, which are of the patronage of Alexander Sorderland (rectius Souderland) lord of Douffoys in the diocese of Moray, becoming void by the death of George de Crethon, the said Alexander presented the said William to James bishop of St. Andrews, who has wrongfully refused to institute him. The said petition adding that William doubts whether for certain reasons the said presentation holds good, and the said canonry and prebend being still, as the pope has learned, void as before, he hereby admits the said presentation, and orders the above three to collate and assign the canonry and prebend, value not exceeding 40l. sterling, to William, who is of a race of nobles and earls, inducting him, etc. Nobilitas generis, vite etc. (G. de Piccolominibus. | xxii. Mandate, at the recent petition of John Ocearnaig, clerk, of the diocese of Tuam (containing that on the voidance of the rectory of the rural lands of Umall Uachtarach in the said diocese by the deprivation by archbishop Donatus of Odo Omalle for his faults and demerits, the said archbishop made collation and provision of it to the said John; and adding that he doubts whether for certain causes they hold good, and the pope having learned that the rectory is still void as above) to collate and assign to the said John (who alleges that the rectory was formerly of the patronage of laymen, of whom, however, there is at present no certain knowledge) the said rectory, with cure and value not exceeding 12 marks sterling. (f. 112.)		 To the bishops of St. Andrews, Aberdeen and Ancona. Reservation and mandate, as below. Lately, upon the expected voidance of a canonry of Moray and the prebend of Spyni therein, by the promotion made by the pope of David Stewart, elect of Moray, (fn. 4) to that church, and by his consecration which was to be administered to him, the present pope ordered provision to be made thereof to the late Robert Froster (rectius Forster, above, Reg. Vat. CCCCLXXXVI, f. 251d., which has the spelling ‘Forstar’). Seeing that Robert has died at the apostolic see before the said consecration has been administered, and without having had possession, wherefore the said canonry and prebend, the value of which does not exceed 20l. sterling (cf. ibid.), are still expected to become void as above, the pope hereby reserves them to his gift, for collation to Andrew Lesly, clerk, of the diocese of Aberdeen, who is by both parents of a race of barons, and orders the above three to collate and assign them to him upon their becoming void as above, inducting him, etc. Nobilitas generis, vite etc. (G. de Piccolominibus. | xxii. Abbadia S. Salvatore in the diocese of Chiusi. (fn. 5)
(f. 113.)		 To the bishops of St. Andrews and Silves (Silven.) and the official of Aberdeen. Mandate, as below. The recent petition of Richard Wyly, priest, of the diocese of Brechin, M.A., contained that Calixtus III, on being informed by him that the late Gilbert F(or)ster (fn. 6), sometime archdeacon of the church of Brechin, had laid violent hands on the late John bishop of Brechin in the said church and, being thereby excommunicate, had taken part in divine offices, ordered a certain judge, if and after Richard accused Gilbert before him, to summon Gilbert, and if he found the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said archdeaconry to Richard; that the present pope, inasmuch as pope Calixtus had died before his letters were drawn up, decreed that they should take effect from their date, and that his own letters should suffice as proof thereof, and moreover ordered the official of St. Andrews, inasmuch as from fear of Gilbert's power Richard could not safely meet him in the city or diocese of Brechin, if and after Richard accused Gilbert before the said official, to summon Gilbert, and if he found the aforesaid to be true, to deprive and remove him, and in that event to collate and assign as above; that after Richard had caused Gilbert to be summoned before Thomas Luderdel, official of St. Andrews, and the said official had proceeded to a conclusion, the said Gilbert, falsely alleging that he was wrongfully molested by Richard in the matter of the archdeaconry, appealed from such fictitious molestations to the apostolic see, and that the pope committed the appeal to Master John Didaci de Coca, a papal chaplain and auditor, who, wrongfully proceeding, promulgated an unjust definitive sentence on behalf of Gilbert and against Richard, the latter's appeal from which the pope committed to Master John de Cesarinis, also a papal chaplain and auditor; that inasmuch as it was alleged that neither Richard nor Gilbert had a right, the pope, calling up the cause pending before the said official, ordered the said auditor John [de Cesarinis], by letters which have not been drawn up, if by the result of the suit he found that neither Richard nor Gilbert had a right, to collate and assign the said archdeaconry, whether void by the said bishop's deprivation of the said Gilbert by his ordinary authority on account of the said violence, made by his definitive sentence which became a res judicata, or void in any other way, to Richard; and that the said auditor John de Cesarinis is said to have subsequently proceeded, short of a conclusion. At the said petition, which added that the said Gilbert, being still in possession, has died in the castle of San Quirico in the diocese of Arezzo, when following the Roman court, whilst the said suit was pending before the said auditor John de Cesarinis, the pope hereby calling up the cause to himself, orders the above three to collate and assign the said archdeaconry, a non-major non-elective dignity with cure, value not exceeding 20l. sterling, whether it be void by the deprivation of the said Gilbert, or by the death of him or of David Yduy, or in any other way, and whether it be generally reserved to the pope by the death of the said Gilbert or because he was an acolyte of the pope, to Richard, inducting him, etc. Litterarum sciencia, vite etc. (G. de Piccolominibus. | xxxxv. Collation and provision to him, who is of noble birth, of the archdeaconry of Brechin, a non-major elective dignity with cure, value not exceeding 23l. sterling, void and ipso facto reserved (under the pope's general reservation of all benefices of members of the papal court void by their death at any place when following the said court from place to place) by the death of Gilbert Fo[r]star, an acolyte of the pope and the apostolic see and a member of the papal court, in the castle of San Quirico [in the diocese of Arezzo (fn. 8) ], where he was staying for the sake of recreation, not more than two days’ journey from the abbey of San Salvatore in the diocese of Chiusi, where the pope was residing with his court; with mandate executory hereby to the bishop of Aberdeen, the dean of Dunkeld and the archdeacon of Biscay (Viscaya) in the church of Calahorra (Calagurrican.); notwithstanding that he holds the parish church of Foreste and the canonry and prebend de Pebokis (rectius Petcokis) in the church of Dombar, in the dioceses of Glasgow and St. Andrews, the value of both not exceeding 51l. sterling. Pienza.

(fn. 10) 		To James Kennedei, M.A. Collation and provision to him (who is illegitimate, being the son of unmarried parents, and has been dispensed by papal authority to be promoted to all even holy orders and receive and retain any benefices of any number and kind, with and without cure, even if dignities etc.) of the deanery of Dernok in the church of Caithness, a non-major non-elective dignity, value not exceeding 16l. sterling; with mandate executory hereby to the dean of Nevers (Nivernen.) and the officials of St. Andrews and Caithness; notwithstanding that he holds the parish church of Tannodes in the diocese of St. Andrews and a canonry of Glasgow and the prebend of Guvane, value altogether not exceeding 50l. sterling, and that the present pope lately granted him provision of one or two benefices in the collation etc. of the bishops of Glasgow and Aberdeen and the deans and chapters etc. of those churches. He is hereby dispensed to retain the deanery for life together with the said church of Tannodes, and to resign both, as often as he pleases, and receive instead and retain for life two other incompatible benefices, provided that they be not two parish churches or major or principal dignities or such mixed.   • 8. In the preceding bull but one the diocese in which San Quirico was situate on 31 July, 1462, is expressly mentioned, namely that of Arezzo. In the present bull, however, and also in the next following bull, under date 10 August, the mention of the diocese seems to be avoided. The hesitation is probably to be explained by the fact that San Quirico was on the point of ceasing to be in the diocese of Arezzo. Three days later, in fact, namely on 13 August, pope Pius erected his native town of Pienza into a city, the see of the bishop of a new diocese, consisting of parts of the three dioceses of Arezzo, Grosseto, and Chiusi. The bull of creation ‘Ad perpetuam rei memoriam. Pro excellenti preeminentia,’ dated at Pienza, occurs in the present Register, viz. Reg. Vat. 487, ff. 187r–190r (printed in Ughelli, Italia Sacra, vol. I, col. 1175, whence cocquelines, Bullar. Rom., vol. III, part iii, (1743), p. III; also partly printed in Rinaldi's Annales, an. 1462, § 47). It enumerates by name the portions of the three dioceses which were thus cut off to constitute the new diocese, and one of the places mentioned as being separated from the diocese of Arezzo is San Quirico, another being Pienza itself. Thus, until 13 August, 1462, San Quirico was in the diocese of Arezzo, but on and after that date in the diocese of Pienza. In the bull of 31 August, referred to in the next footnote but one, San Quirico is therefore correctly described as being in the diocese of Pienza. The date of the two bulls of 10 August has ‘Datum Pientie.’ This should more correctly have been ‘Datum Pientie Aretine diocesis.’ At the present day Pienza is no longer a separate see, but is united to Chiusi.

(31 Aug.) anno 4, addressed to Alan Kaernynynen, perpetual vicar of Treffgo(n)dern in the church (ecclesia) of Léon (Leonen.), M.A., making him, who is by both parents of noble birth, at the petition also of John cardinal priest of St. Martin's in Montibus, of whose household he is a continual commensal member, collation and provision of the said vicarage, with cure and value not exceeding 65l. tournois, recently void by the death of Christopher Carpentarii, who was also a continual commensal member of the household of the said cardinal, at the town (opidum) of San Quirico in the diocese of Pienza, less than two days’ journey from the city of Pienza, where the pope was then residing, and therefore ipso facto reserved under the pope's late reservation of all benefices of members of the papal court who go on account of illness or recreation etc. to any place distant two days’ journey from the Roman court and die there; notwithstanding that he holds the parish church de Telgruc and a chapel (capellam,? rectius capellaniam) at the altar of St. Gouternus (sancti Gouterii rectius Gouterni) in the parish church of Moutreff, in the said diocese (dicte diocesis), value not exceeding 40l. and 20l. tournois respectively; with dispensation to receive the vicarage, and retain it and the said parish church, and without them any two other benefices with cure or otherwise incompatible, etc., and mandate executory hereby to the archdeacon of Ach (Agnen.) in the church of Léon, Oliver Principis, a canon of Nantes and the official of Quimper. Alano Kaernynynynen providetur de perpetua vicaria de Treffgonderii in ecclesia Leonen. fo. ccciiiiTheiner has mis-read the clearly written ‘Leonen.’ of the Rubricelle and of the text as ‘Laonien.’ He has consequently made his cross in the margin of the Rubricelle and of f. 304d., and also his ‘etc.’ on f. 305, the latter being his usual instruction to his copyist to omit the Non obstantibus and following clauses. They contain, however, the mentions of Alan's other benefices, his dispensation, the names of the executors, &c., a knowledge of which might have saved Theiner from inserting a summary of the bull in his Monumenta, p. 454, which has ‘Carpentarn.’
