To John Ohedyan, archdeacon of Cashel. Absolution etc., as below. The pope lately, on being informed by Patrick Porcell, rector of Callan in the diocese of Ossory, that the said John had committed simony, dilapidated the goods of the said archdeaconry and other benefices, and openly kept a concubine and concubines by whom he had had offspring, ordered the chancellor of Killaloe, if and after Patrick accused him, to summon him, and if he found the foregoing to be true, to deprive and remove him, and in that event to collate and assign the archdeaconry, a nonmajor dignity, to Patrick, as is more fully (fn. 3) contained in the pope's letters [above, Reg. Vat. CCCCLXXIII, f. 95]. At John's recent petition, containing that the said letters were obtained from the pope whilst Patrick was absent from the Roman court, and whilst John for the expedition and prosecution of divers of his affairs was on his way thither where he is at present residing, and that they have not yet been presented to the said chancellor, as judge and executor, (fn. 4) and that Patrick has so many ecclesiastical rents etc. that he can get from them more than 100 ducats a year, the pope hereby absolves him from the crimes, delicts, excesses and sins of simony, dilapidation, concubinage and fornication and any others, howsoever committed and perpetrated, and anysoever enormous ones, even if such as ought to have been expressed, even if reserved cases, (fn. 5) and from all sentences of excommunication etc., dispenses him on account of irregularity, howsoever contracted, even in celebrating masses and other divine offices or taking part therein, and rehabilitates him, and moreover annuls the said letters and the corresponding petition or petitions, decrees that they have no judicial value, that judgement or sentence cannot be given in accordance therewith by the said chancellor or any other judges, and that John cannot, by reason’ of the foregoing, be accused or deprived of his benefices, orders the said petitions and letters to be deleted, ringed and abolished from the pope's registers of petitions and of bulls of the Camera and of his secretaries and anywhere else, (fn. 6) and inhibits the said chancellor and any other judges, under pain of excommunication etc., to proceed to execution of the said annulled letters. To the bishop of St. Andrews, the provost of St. Salvator's at St. Andrews and the official of St. Andrews. Mandate (the pope having been informed by William Boncle, a monk of the Benedictine monastery of Aberbrothoc in the diocese of St. Andrews, that Richard Robsen, abbot of Kelso, of the said order and diocese, an open and assiduous adulterer and fornicator, has kept with him divers concubines and adulteresses by whom he has had children still living, and has continually adhered to them, (fn. 9) and has dilapidated the goods of the said monastery and consumes them with the said concubines and adulteresses and for other evil uses, has violated the customs and statutes of the monastery, and committed other even graver excesses and crimes, about which he is defamed in those parts, and that by his negligence etc. the buildings have been deformed and some of them brought to ruin, so much so that whereas thirty or forty religious and the abbot were able to be maintained, at present only seventeen or eighteen priests are there) if and after William accuses Richard before them, to summon him, and if they find the foregoing to be true, to deprive and remove him, and in that event to make provision to William, if found fit, of the said monastery, the fruits etc. of whose abbatial mensa do not exceed 190 gold florins of the Camera a year. To David Stewart, a canon of Moray, M.A. Dispensation to him (who was formerly dispensed by papal authority, on account of illegitimacy as the son of the late Alexander earl of Mar, a kinsman of the late James king of Scots, and an unmarried woman, to be promoted to all even holy orders and receive and retain any compatible benefices of any number and kind, with and without cure, even if canonries and prebends, dignities, etc., even major or principal dignities etc., and to resign them, simply or for exchange, as often as he pleased, and had indult not to mention the said defect in future papal letters impetrated by him; who is a priest and is of a race of barons, and holds a canonry and prebend of Moray) to be elected to any episcopal or archiepiscopal dignities, and exercise the rule and administration of them and any cathedral or metropolitan churches, notwith-standing the said defect etc. Litterarum sciencia, vite etc. (G. de Piccolominibus. | lxxx. To Henry bishop of Térouane (Morinen.). Indult, as below. His recent petition contained that his city and diocese border on the English, on account of which and of the fierce and cruel battles and wars in times past between French and English his bishopric has sustained very many losses and is greatly deteriorated, so that from the fruits etc. of his episcopal mensa he [cannot keep up] his estate as his predecessors kept it up before the said wars and bear his other burdens, especially seeing that the said English, who are relentless enemies of the citizens of Térouane, have long dared to hold and still hold possesson of a certain part of the said bishopric, which part he is unable, as he earnestly desires, to recover. (fn. 11) The pope, therefore, considering that burdens are more easily borne when they are shared, and considering it just and proper that the ecclesiastical persons of the said city and diocese should bear the said burdens along with him, and the members aid the head, grants him indult hereby to ask, receive and exact, once only, from all ecclesiastical persons, secular and regular, exempt and not exempt, of his city and diocese, who hold benefices for which a tenth has been wont to be paid, a charitative subsidy, and to convert it to his uses in the way expressed in other letters of the pope, for the more easy support of the said burdens and for the recovery of the said part: with mandate hereby to the bishops of Tournai, Cambrai and Amiens to cause the said subsidy to be paid. To Mary queen of Scots. Decree, as below. Upon its being set forth lately on her behalf to the present pope that after Nicholas V had, with consent of the late Alan Cant its rector, erected the poor hospital of Soltre in the diocese of St. Andrews into a dignity called the chancellorship in the church of St. Andrews, and had made provision of the same chancellorship, which is of the patronage of the king of Scots, to the said Alan, the late James king of Scots, the sole patron, on its becoming void by Alan's death, presented John Tyri, clerk, of the diocese of St. Andrews, bachelor in decrees, to the vicar-general in spirituals of the bishop of St. Andrews, and that the said vicar instituted him, in virtue of which presentation and institution the said John obtained possession; and its being added that she had founded and caused to be built a collegiate church with a poor hospital near the burgh of Edymburg in the north of the said diocese, and that James [the present] king of Scots, whose progenitors founded the said hospital of Soltre, and she too desired the said hospital, thus erected into the chancellorship, to be restored to its original state, and to be appropriated to the said new hospital, and that the said king was ready to consent, the pope, having moreover learned that the said John proposed to resign the said chancellorship in favour of the said union, and in order that the chancellorship might be reduced to be again the hospital of Soltre, as formerly, ordered the bishop of Glasgow to summon the said bishop and chapter of St. Andrews and others concerned and, if he found the facts to be as stated, to receive the said John's resignation, and to unite and appropriate the chancellorship (upon its becoming void by such resignation, and after suppressing, with the king's consent, its name and dignity in the said church) and the said hospital of Soltre, after reducing it to its original state, (fn. 13) to the said new hospital etc., the pope's letters stating that Alan Cant was then rector of the said hospital of Soltre and had caused it to be erected into the said chancellorship. At the recent petition of the said queen, containing that it was Thomas the present bishop of Dunkeld, and not the said Alan, who procured the erection of the said chancellorship, that at the time of the date of the said letters the said church was not yet entirely erected into a collegiate church nor its buildings completed, and that the said John resigned first to the said bishop of St. Andrews and afterwards to the said bishop of Glasgow, wherefore the force of the said letters may be called in question, the pope hereby decrees (fn. 1) that his said letters and their consequences shall hold good from the date of these presents, as if it had been stated therein that it was Thomas and not Alan who had caused the said erection to be made, and that John had made the said resignation first to the bishop of St. Andrews, the ordinary, and afterwards to the bishop of Glasgow, and as if it had been not mentioned therein that the said church (fn. 14) was entirely finished and erected into a collegiate church. Confirmation etc., as below. The recent petition of Mary queen of Scots contained that whilst the late James II king of Scots, her husband, was alive, she caused a poor hospital to be built without the royal burgh of Edinbourgh (fn. 18) in the diocese of St. Andrews and endowed it, and erected hard by a church or chapel for a college of a provost and ten or twelve priests and clerks, has continued it with magnificent and sumptuous work, and intends as soon as possible to finish it, has assigned as the endowment of the said church a certain good barony and other possessions etc. to the sum of about 100 marks [sterling], and intends to increase the said endowment. Seeing that Nicholas V caused the poor hospital of Soltre in the said diocese, of the patronage of the king of Scots, which was in ruin and in which no hospitality was kept, to be erected into the chancellorship of the church of St. Andrews, and that the present pope, at the said queen's petition, has undone the said union and erection, and has ordered the same hospital to be united to the said new hospital [above, f. 228], James the present king of Scots, son of the said queen, and the said queen also have petitioned the pope to confirm the said foundation, endowment and union, and also the union, made by authority of the ordinary, of the chapel of Ochterogarte in the said diocese, likewise of the patronage of the said king, the yearly value of which and of the said hospital of Soltre does not exceed 70l. sterling, (fn. 19) and to erect anew the said church into a collegiate church with the insignia of a college, etc., the pope therefore approves and confirms hereby the said foundation, endowment and unions, and moreover erects anew the said church into a collegiate church with the insignia of a college, decrees that all obventions to the said church are to be applied to its fabric and repair, and grants power and faculty to the master or rector of the said new hospital, present and future, to administer all the sacraments to all of both sexes who dwell and to others who serve therein. Nicholas V, upon being informed by Robert Sutton, priest, of the diocese of Ferns, that John Whitey, then a canon of Ferns and prebendary of Fydard (or Fyderd), had perpetrated certain excesses and crimes then expressed, ordered certain judges, if and after Robert accused John before them, to summon John, and if they found the same to be true, to deprive and remove him, and in that event to collate and assign the canonry and prebend to Robert; after which, as Robert's recent petition to the present pope contained, he caused John to be summoned before two of the said judges, who found the said relation to be true, deprived and removed John, and made collation and provision to Robert, who in virtue thereof obtained possession and has held the said canonry and prebend in peace for about six years.
