To the abbot of Paisley in the diocese of Glasgow, and the archdeacon of Lismore alias Argyll. Mandate, as below. Nicholas V (upon its being set forth to him by Robert de Hamylton, priest, of the diocese of Glasgow, bachelor in decrees, that, with a view to the study of letters, he appointed the late James bishop of Dunkeld and Henry Legan (rectius Logan), priest, of the diocese of St. Andrews, as his proctors, with the fullest power, and that the said Henry at the instance of the said bishop, Robert being then residing at the university of Paris, resigned Robert's parish church of Abernit to the said bishop for the purpose of its being united to the chapter of Dunkeld, that the said bishop admitted the resignation and united the church to the said chapter in perpetuity, to Robert's prejudice, and that the dean and chapter, as compensation, assigned to him for a certain period a yearly pension of 20 marks of the usual money current in those parts, upon the fruits etc. of the said dean and chapter) ordered certain judges to grant and assign the said pension to Robert for life. At Robert's recent petition (containing that although William prior of St. Andrews, one of the said judges, granted and assigned the said pension to him, and that although the said dean and chapter paid it for several years, yet for nearly a year past they have without reasonable cause refused to pay; and that, although those of the dean and chapter who have prevented the payment have been declared to have incurred sentence of excommunication, and the chapter suspended a divinis, and the church of Dunkeld laid under interdict, yet the dean and chapter, contemning the said sentences etc., have celebrated [masses and other divine offices], violated the interdict and taken part in divine offices, in contempt of the Keys, and still do so) the pope hereby orders the above two to summon the dean and chapter and others concerned, and if they find the foregoing to be true, to cause the said pension to be fully paid to Robert, and compel the dean and chapter thereto, without appeal, proceeding by aggravation of processes, ecclesiastical censure, and invoking the aid of the secular arm etc. Humilibus supplicum votis. Mandate, at the recent petition of Cristina Sewale alias Archer, wife of John Archer, layman, of the diocese of London (containing that the said John has so inhumanly beaten and wounded her beyond her deserts, even when she was pregnant, that he caused her to bring forth two still–born children, and has treated her and still treats her so cruelly that she is in fear of her life and cannot any longer remain with him; and praying the pope to order a judicial separation and the restoration of her dowry (fn. 2) ), to summon John and others concerned, and if he find the foregoing to be true, to pronounce between them sentence of separation (fn. 3) as above, and cause Cristina's dowry to be restored to her. To the bishops of Winchester and Bath and the archdeacon of York. Mandate, as below. The recent petition of Thomas Weston, rector of Rowstorn in the diocese of Coventry and Lichfield, contained that although in virtue of a provision made to him by authority of the ordinary he had canonically obtained the said church, and had held it for several years and was then holding it peaceably, nevertheless Thomas Mere, Robert Layceston and Thomas Leglon, (fn. 4) esquires, falsely alleging that he had obtained it by simony, brought him before John Stokys, doctor of laws, [auditor] of the court or audience of Thomas archbishop of Canterbury, primate of England and legatus natus, under pretext of a commission of the cause to the said auditor by the said archbishop, by his legatine authority, at the instance of the said esquires; that the said auditor, wrongfully proceeding, promulgated an unjust definitive sentence against the said Thomas, by which he deprived and removed him, and condemned him in the costs; that he appealed therefrom to the apostolic see, but that James Legh, clerk, of the said diocese, notwithstanding the said appeal, of which he was not ignorant, and within the period for prosecuting which Thomas still was, falsely alleging the said church to be void by such deprivation and removal, is said to have obtained the making of collation and provision to himself thereof by authority of the ordinary, and under pretext thereof molests and disturbs Thomas. The pope therefore orders the above three to summon the said esquires and James and others concerned, hear both sides, and decide what is just without appeal, causing their decision to be observed by ecclesiastical censure. Mandate, at the recent petition of John Kennocthson, clerk, of the diocese of Ross (containing that on the voidance of the precentorship (cantoria) of Caithness, a non-major dignity, by the deprivation made by bishop William, by his ordinary authority, of John Wylle, the said bishop made collation and provision thereof by the same authority to the said John Kennocthson, who in virtue thereof obtained possession, but doubts whether for certain reasons the collation and provision hold good) to collate and assign the said precentorship, which is not elective and has cure, value not exceeding 9l. sterling, to the same John Kennocthson, who is of noble birth. Mandate, at the recent petition of Lactinus (fn. 5) Ylongaych, clerk, of the diocese of Cork (containing that he obtained by canonical collation the [perpetual] vicarage of Achynach in the diocese of Cloyne, value not exceeding 3 marks sterling, and detained it for six years without having himself promoted to any holy order, afterwards resigning it to Jordan bishop of Cloyne; that also formerly, on the voidance of the perpetual vicarages of the united parish churches of Raynach (sic) and Magindi in the said diocese of Cork, he made a simonical bargain with Dermit Macormech to the effect that if with his help Dermit obtained them, La[c]tinus should receive the fruits etc. thereof, value not exceeding 8 marks sterling; that Dermit duly obtained them with the help of La[c]tinus, and that the latter has received the fruits thereof for six years, thereby incurring sentences etc. for simony, but has promised to do so no longer) if he find the foregoing to be true, to absolve La[c]tinus from simony and the said sentences etc., enjoining penance, dispense him on account of irregularity contracted, and rehabilitate him. Mandate, at the recent petition of Charles Macmagnussa, layman, of the bishop's diocese (containing that the rector called the plebanus or comorbanus of the church of St. Tierny (Sancti Tigerniacii), Cluaneois, in the said diocese, has been wont to grant to farm for periods of five years in return for a yearly cess, even to laymen, the tithes, first fruits (primitias), oblations and dues (responsiones) belonging to the said church, and that if they were granted to the said Charles at perpetual farm the said church would without doubt benefit greatly) to summon the said rector and others concerned, inform himself, and if he find the foregoing to be true, and such grant to be to the evident benefit of the said church, to grant the said tithes etc., the names and values etc. of which the pope holds to be expressed by these presents, to Charles (who alleges that he is the chief of his sept (fn. 6) and a literate, and that he holds to farm for the present five years part of the said tithes etc.) and to his heirs and successors to farm for ever. Mandate, at the recent petition of John Macculmarthayn, clerk, of the diocese of Kilmore—containing that the prior and convent of the Benedictine monastery of SS. Taurin and Feighin, Fogur, in the diocese of Meath, have been wont to grant to farm or yearly pension for periods of five years the tithes, first fruits, oblations and dues belonging to the said monastery in the places called Bailyg(?)ebert (fn. 8) and Bayly curtag Camphylyn, in the diocese of Kilmore (? rectius Meath), and that if they were granted to the said John on perpetual lease or farm the said monastery would without doubt greatly benefit—to inform himself, and if he find the foregoing to be true, and the said grant to be to the evident benefit of the said monastery and convent, to grant the said tithes etc., the names and values etc. of which the pope holds to be expressed by these presents, to the said John on perpetual lease or farm. To the bishop of Aberdeen. Mandate to make provision of the Cistercian monastery [of] Dere (fn. 10) in his diocese, value not exceeding 160l. of old sterlings (void at the apostolic see, and therefore ipso facto reserved to the pope, by the recent resignation made there to the pope by Nicholas de Fores, [now] a monk thereof, through his proctor William Lyndesai, a canon of Moray) to William Evyot, a monk of the said monastery, who is illegitimate, being the son of unmarried parents, and who was lately by papal authority translated from the order of Val-des-Choux to that of Cîteaux. The above bishop is to bless him, or grant that he may be blessed by any catholic bishop, and the pope hereby dispenses him on account of the said defect etc. Further the above bishop or the consecrator is, after the consecration, to receive from him the usual oath of fealty according to the form enclosed, and is to send it by William's letters patent sealed with William's seal, by his own envoy to the pope.
