(f. 152.)
To the official of Aberdeen. Mandate, as below. Nicholas V (upon its being set forth to him by John Clait, a canon of Aberdeen, that on the voidance of a canonry and the prebend called Glenberuy in Brechin by the death of John Crab, and of the perpetual vicarage of Coula in the diocese of Aberdeen by the resignation, admitted by the authority of the ordinary, of Richard Ackinsen [in exchange] for the parish church of Glass’ in the diocese of Moray, he was simonically presented by the lay patron within the lawful time to the said canonry and prebend, which are by papal privilege of lay patronage, and was instituted by the said authority, and that collation and provision were made to him by the said authority of the said vicarage, the said resignation of which had likewise been simonically made, under pretext of which presentation and institution and collation and provision he obtained possession of the said canonry and prebend and vicarage, and was still unlawfully holding possession) ordered the archdeacon of Aberdeen on Pridie Non. April anno 8 [4 April 1454] to absolve the said John Clait from all sentences of excommunication incurred by reason of the foregoing and from simony, enjoining penance, dispense him on account of irregularity contracted by celebrating or taking part in masses and other divine offices when under such sentences, and rehabilitate him, and in the event of his doing so, to collate and assign to him the said canonry and prebend and vicarage, value not exceeding 16 and 8 marks sterling respectively, after he had duly resigned them to the said archdeacon. At his recent petition (containing that, on account of the absence in remote parts of the existing archdeacon of Aberdeen, execution of the said letters has not yet been proceeded to, and alleging that he has resigned the vicarage, but not the canonry and prebend, possession of which he still detains, taking their fruits) the pope hereby orders the above official, after Clait has resigned the canonry and prebend, to proceed to the execution of the said letters (which the pope decrees shall, from the date of these presents, as if they had emanated under the date of these presents, avail the said John Clait, as far only as regards the said absolution, dispensation, rehabilitation and collation and provision of the said canonry and prebend), as if they had been directed to the said official and presented to him during the life of the said pope, and as if the execution thereof had been begun by him. (fn. 4) Solet sedis apostolice. (P and Jo. Rode. | P. xiiii. de Varris.) [3 pp. The mandate by Nicholas V is not in Cal. Papal Lett., vol. X.]

(f. 171d.)
To the bishop of Glasgow and the officials of Salamanca and Avila (Abulen.). Mandate to collate and assign a certain canonry and prebend of Salamanca. Vite etc. (P. and G. Gonne. | P. xxvi. Undecimo Kal. Junii Anno Secundo. de Varris.) [4½ pp.]
4 Non. May. (fn. 5)
(4 May.)
St. Peter's, Rome.
(f. 245.)
To the bishops of Brechin and Dunblane and the abbot of Paisley (de Pasleto) in the diocese of Glasgow. Mandate, at the recent petition of Andrew bishop of Glasgow (containing that a number of clerks and laymen of those parts, some of whom are entirely unknown to him, concealed and usurped and took possession of and detained divers goods, amongst them even precious moveables, belonging to the episcopal mensa of Glasgow, both during the life and after the death of the late bishop William, and still usurp, hold possession of and detain them) to admonish all such persons publicly in churches before the people to make restitution within a certain term to the said bishop Andrew, failing which to excommunicate them generally, and cause the sentence to be solemnly published, and, by ecclesiastical censure without appeal, to compel, upon the said bishop's request, those whom they find in possession of the said goods, to restore them. Justis petencium votis. (P. and Nicasius. | P. x. de Varris.) [1¾ pp.]
Prid. Id. Oct.
(14 Oct.)
St. Peter's, Rome.
(f. 261.) (fn. 6)
To the priors of Montacute (de Monteacuto) and Ely, in the dioceses of Bath and Wells and Ely. (fn. 7) Mandate, as below. The recent petition of William Russell of Wytteleshey, layman, of the diocese of Ely, contained that formerly Walter Baker, layman, of the said diocese, falsely alleging that William had attributed to him certain crimes then expressed, and had defamed him in respect thereof with good and grave men, incurring thereby the penalty of a certain provincial constitution, (fn. 8) brought William, not by papal delegation, before the then official of the court of Canterbury to whom belongs, it is alleged, the cognizance of similar causes, even between laymen of the said province; that the said official, wrongfully proceeding, promulgated an unjust definitive sentence in favour of Walter and against William, by which he pronounced, inter alia, that William had ipso facto incurred the sentence of excommunication contained in the said constitution, and had been and was excommunicate, and condemned him in the costs of the cause; and that afterwards, upon Walter's falsely relating to the said official that William had treated with contempt his mandates and those of his said court, and had not obeyed them, the said official, proceeding summarily and wrongfully and unjustly in the suit for contempt, the said Walter being prosecutor, condemned William in the costs incurred in the said suit for contempt, which, as also the former costs, he subsequently taxed at an excessive sum, (fn. 9) from which definitive sentence, pronouncement, condemnation in costs and their taxation etc. William has appealed to the apostolic see, and has petitioned the pope to order him to be absolved from the said sentence of excommunication, at least ad cautelam, and to commit the causes of the said appeals and of the principal matter to upright men in those parts. The pope therefore orders the above two priors to summon Walter and others concerned and, after receiving from William a pledge that, if the above two find that the said sentence of excommunication was justly delivered against him, he will obey them and the church, to grant him ad cautelam absolution from the said sentence, hear both sides, and decide what is just without appeal, causing their decision to be observed by ecclesiastical censure. Humilibus supplicum votis. (P. and H. Maesheim. | [P.] xxii. de Varris.) [2½ pp.]

De Dignitatibus Vacantibus.

8 Id. May.
(8 May.)
St. Peter's, Rome.
(f. 272.)
To the abbot of Paisley (de Pasleto) in the diocese of Glasgow. Mandate to collate and assign to Thomas Waus(e), perpetual vicar of Symonton in the diocese of Glasgow, M.A., who is of noble birth and a member of the household of James king of Scots, the deanery of Glasgow, a major elective dignity with cure, value not exceeding 50l. sterling, provision of which, on its becoming void, and ipso facto reserved to the pope in accordance with his general reservation of all major cathedral dignities, by the death of Thomas Myrton, the pope ordered to be made to the late James Inglys, then a canon of the said church, who has died without having had possession, wherefore it is still void and still reserved in virtue of the said general reservation; notwithstanding that he holds the said vicarage, value not exceeding 13l. sterling, which, upon obtaining the deanery, he is, as he has offered, to resign. Dignum arbitramur. (P. and A. de Amelia. | P. xxx. Tertio Non. Junii Anno Secundo. de Varris.) [3⅓ pp. See above, pp. 34 and 64.]
7 Kal. Sept.
(26 Aug.)
S. Maria Maggiore,
Rome.
(f. 309.)
To David Ocurrcyn (rectius Ocurreyn). Collation and provision to him (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, after which he had himself so promoted and obtained the perpetual vicarage of Leodryn in the diocese of Leighlin) of the deanery of Leighlin, a major non-elective dignity with cure, value not exceeding 6 marks sterling, void, and reserved to the pope in accordance with his general reservation of all major cathedral dignities, by the resignation of Nicholas Clawllus made to and admitted by Thomas bishop of Leighlin by his ordinary authority; notwithstanding that he holds the said vicarage, value not exceeding 4 marks sterling. He is hereby dispensed, notwithstanding the said defect etc., to receive and retain the said deanery, upon obtaining which he is, as he has offered, to resign the said vicarage. Vite etc.
Concurrent mandate to the bishop of Alessandria, the treasurer of Leighlin, and Patrick Obroyn, a canon of the same. Hodie dilecto filio (here with the spelling ‘Ocurryn’). (P. and G. Gonne. Ja. Bigneti. | P. xx. xviii. Tertio Id. Septembris Anno Secundo. de Varris.) [3½ pp.]

Footnotes

  • 1. On the back of the volume is the usual modern description in Latin: ‘1456. An. ii. Callixti iii.’ The usual contemporary flyleaf is wanting, and the right hand upper portions of about the first 30 ff. are more or less injured, the lost foliation numbers of the first fourteen ff. being repeated in arabic numbers. The text extends to f. cccxvi. On the bottom edge of the volume is the usual contemporary description: ‘Primus de diversis [formis], de exhibitis et de dignitatibus vacantibus anno secundo domini nostri domini Calisti pape tertii.’
  • 2. ’ciusdem,’ but he has not been mentioned before.
  • 3. There is evidently an error here: ‘xxx’ is at the end of one line and ‘xv’ at the beginning of the next.
Datum
  • 5. Datum Rome apud sanctum Petrum anno incarnationis dominice millesimo quadringentesimo quinquagesimo sexto, quarto nonas Maii anno primo, ‘anno primo’ being presumably an error for ‘anno secundo.’
  • 6. The date ends ‘anno sexto’: ‘sexto’ is cancelled and over-written ‘P(etru)s’ [de Varris] and is followed by ‘secundo’ in the hand of P. de Varris.
  • 7. i.e. two executors only.
