To the archdeacon of Annaghdown and Thomas Obrayn, a canon of Tuam. (fn. 3) Mandate, the pope having been informed by William de Burgo, clerk, of the diocese of Kilmacduagh (Duacen.) that Malachy Okeallaid, abbot of the Cistercian monastery of St. Mary Knockmoy (Collis victorie) in the diocese of Tuam, has publicly kept a concubine and dilapidated and alienated etc. the goods of the monastery and committed simony, if and after William, who is of noble birth and in or about his twenty-third year, and desires to enter the said monastery, accuses Malachy before them, to summon Malachy, and if they find the foregoing to be true, to deprive and remove him, and in that event to cause William to be received as a monk of the said monastery, and receive his profession, and thereafter, and if they find him fit, to make provision to him of the said monastery, value not exceeding 50 marks sterling, whether it become void by such deprivation, or be void by the successive deaths of Cornelius Mecagayn or Donald Ymurenyg or Malachy Occrualli, or in any other way; and to grant that he may be blessed by any catholic bishop. To the precentor of Cork. Mandate (the pope having been informed by Macrobius Ohederstgyol (sic), clerk, of the diocese of Ross, that Matthew Omaythgamma (or Omaythgaunna), canon of Cork, an open fornicator and a simoniac, has dilapidated and alienated etc. the goods of his canonry and prebend of Dru[m]wydaluig (fn. 4) in Cork, and is much defamed in those parts, to the shame of the clerical order) if and after Macrobius (who was lately dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, to be promoted to all even holy orders and hold a benefice even with cure, after which he had himself made a clerk) accuses Matthew before the above precentor, to summon him, and if he find the foregoing, or one of them sufficient for the purpose, to be true, to deprive and remove him, and in that event to collate and assign the said canonry and prebend, which have cure and whose net value, with their annexes, does not exceed 12 marks sterling, to Macrobius, whether they become void by such deprivation, or be void by the non-promotion of the said Matthew to the priesthood within the lawful time, or by his resignation, or in any other way. To the abbot of SS. Peter and Paul's, Armagh, and Maurice (Muricius) Omolmuaid and William Macerenait (rectius Maccreuair), canons of Armagh. Mandate (the pope having been informed by Patrick Macchamail, clerk, of the diocese of Armagh, that, on the voidance in a certain way [not expressed] of a canonry of Armagh and the prebend de Cluaindeo et de Domnachfinnrach therein, Ysac Oculean, their possessor, and Patrick Olucharean, clerks, of the said diocese, who were litigating about them without the Roman court, made an unlawful agreement and division of the fruits of the prebend, in such wise that the chief part was to go to Ysac and the other to the said Patrick Olucharean, and still make the said division) if and after Macchamail, who is illegitimate, being the son of a priest, a Friar Minor, and a married woman, accuses Ysac and Olucharean before them, to summon them, and if they find the foregoing to be true, to deprive and remove them, and in that event to collate and assign the said canonry and prebend, value not exceeding 10 marks sterling, to Macchamail, whom the pope hereby dispenses to be promoted to all even holy orders and receive and retain them, and to resign them, simply or for exchange, notwithstanding the said defect etc. Vite etc. (P. and H. To the archbishop of Tuam. Mandate (the pope having learned that a moiety of the tithes of the parish churches of Cilluignata and Dunyingayn in the diocese of Elphin which used to belong to the community of the church of Elphin before its separation, and which was wont to be assigned to the canons of that church as a canon's portion or prebend, (fn. 5) is void because Milerus de Burgo, recently a canon of the said church of Elphin, has entered the Augustinian canons regular monastery of St. Mary, Acheruym Omane, in the diocese of Clonfert and made therein his profession as a canon thereof) to collate and assign to Patrick Ostingyn, perpetual vicar of Cillmacuagyn in the diocese of Elphin (who was lately dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, to be promoted to all even holy orders and hold a benefice even with cure, after which he had himself so promoted and obtained the said vicarage) a canonry of the said church, in which there is not a fixed number of canons, and the said portion, value not exceeding 12 marks sterling, whether void as above, or by the deaths of Charles Ycotichohayr (rectius Yconchobayr) or Dermit Meccilarnaid, or by the resignation of the said Milerus, or in any other way; notwithstanding that he holds the said vicarage, value not exceeding 5 marks sterling. He is hereby dispensed to receive and retain the said canonry and canonical portion, notwithstanding the said defect etc., and is upon obtaining them to resign, as he has offered, the said vicarage. Mandate to collate and assign to Malachy Ochogly, clerk, of the diocese of Leighlin, who lately, notwithstanding his illegitimacy as the son of unmarried parents, had himself made a clerk, a canonry of Leighlin and the prebend of Illard therein, value not exceeding 8 marks sterling, so long void, by the death of John Ocurryn, that by the Lateran statutes its collation has lapsed to the apostolic see. Malachy is hereby dispensed to be promoted to all even holy orders and receive and retain them, and resign them when (quando) he pleases, simply or for exchange, notwithstanding the said defect etc. Vite etc. (P. and G.   • 1. On the back of the volume is the usual modern description in Italian: ’Calisto iii. 1456. Anno 2 (corrected in a more recent hand to ‘1. 2.’) Lib. 1.’ A flyleaf has in different contemporary hands: ‘Primus de provisionibus prelatorum et de prebendis vacantibus anno secundo’ and ‘R(ecipe) L., P.’ [de Varris.]. A like contemporary description occurs also, as usual, on the bottom edge of the volume, viz. ‘Primus de provisionibusanno secundo (as above) domini nostridomini Calisti pape iii.’ There are ff. i. to cccvii. of text.

Eubel, Hierarchia, Vol. II, p. 197, has the wrong date 7 June 1456, and refers to Obl. 72, 71, which has the right date, having in fact, ‘Die lune decima mensis Maii mcccclvi. sanctissimus dominus noster dominus Calistus pape iii. anno secundo pontificatus sui, ad relacionem reverendissimi domini P[etri Barbi] cardinalis sancti Marci, ecclesie Lymiricensi, tunc per obitum bone memorie Johannis Michäl (sic) eiusdem ecclesie ultimi episcopi extra Romanam curiam defuncti vacanti, de persona venerabilis viri domini Thome Leggher canonici regularis monasterii de Dunstaple ordinis sancti Augustini canonicorum et (sic) regularium Lincolniensis diocesis provincie Cantuariensis decretorum doctor[is] et in sacerdotio constituti providit, preficiendo illi [sic] in episcopum et pastorem, curam regiminis etc. Eubel refers also to Gams, p. 227, where the above bishop elect is described as ‘Thomas intrusus.’ In fact John Mothel remained bishop till his resignation in 1458, dying circ. 1468 (Eubel and Gams, ad loc.).
