Dispensation on account of illegitimacy, as the son of a priest and an unmarried woman, to be tonsured and to be promoted to all even holy orders and hold four compatible benefices with or without cure, even if canonries and prebends etc., and to resign them, simply or for exchange, as often as he pleases. (fn. 3) Faculty, at his recent petition (containing that although Nicholas V made him provision of the church of Dromore, and that in virtue thereof he has obtained possession of the said church and of the rule and administration, or of the greater part thereof, he has been prevented by a lawful impediment from having himself consecrated within the canonical time) to be consecrated by any catholic bishop, assisted by two or three others, in accordance with the said pope's letters. (f. 105.)		 To William Heris, rector of the parish church in Kirkghorzan (rectius Kirkghonzan) in the diocese of Glasgow, M.A. Decree etc., as below. Nicholas V on 3 Id. Aug. anno 7 [1453] dispensed him, at his own petition and that of James earl of Douglas, who alleged that William was a kinsman of him and of James king of Scots, and was by both parents of a race of great nobles, that he, who was holding the said parish church, value not exceeding 20l. sterling, and the canonry and prebend of Kirkpatrik in the church of Tinolouden (rectius Linclouden) and the poor hospital of Traltrole in the diocese of Glasgow, value together not exceeding 60l. sterling, (fn. 4) might hold for life with the said parish church any one other, or without that church any two other benefices with cure or otherwise incompatible, even if two parish churches or perpetual vicarages or dignities etc., and resign them, simply or for exchange, as often as he pleased. Inasmuch as the said pope died before his letters were drawn up, the pope hereby decrees that [the said letters shall hold good from the date thereof and that] these presents shall be sufficient proof of the said dispensation. (f. 147.)		 To Angus [son] of John de Insulis, (fn. 5) canon of Ross, bachelor of canon law. Absolution etc., as below. His recent petition contained that (after John bishop of Sodor had by his ordinary authority deprived by a definitive sentence for his faults and demerits Alexander Terleti, then rector of the parish church of Kilchoman (fn. 6) in the diocese of Sodor, of the patronage of the earl of Ross and lord of the Isles, and after John earl of Ross and lord of the Isles, the patron, had presented the said Angus to the said bishop, and after the said bishop had instituted him, and after the said Alexander had appealed to the apostolic see from the said deprivation, presentation and institution) he took, in virtue of the said presentation and institution, during the term for the prosecution of the said appeal, possession of the said church and held it with the parish church of Kilcolmkill in Morvern, (fn. 7) in the diocese of Argyll, which he was then holding, taking their fruits. The pope hereby, absolving him (who is a priest, and who alleges that he afterwards resigned the said church of Kilcolmkill, and that Alexander did not prosecute the said appeal within the lawful time, wherefore the said sentence has become a res judicata) from all sentences of excommunication etc. as far only as regards the taking effect of these presents, rehabilitates him on account of the foregoing, but requires him to resign the said church of Kilchoman. (f. 148.)		 To the abbot of St. Columba's, Iona (de Y Insula), in the diocese of Sodor. Mandate, recapitulating the preceding, (fn. 8) to collate and assign to the above Angus—who was lately dispensed by papal authority, on account of illegitimacy as the son of a married nobleman and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, and subsequently, after he had been so promoted and had obtained the above church of Kilcolmkill, to hold any other benefice with or without cure compatible with the said church of Kilcolmkill, even if a canonry and prebend, dignity etc., and to resign it, simply or for exchange, as often as he pleased; and whom the pope hereby absolves etc. as in the preceding—the above church of Kilchoman, value not exceeding 14 marks sterling, after he has resigned it, as above, summoning and removing the said Alexander and any other unlawful detainer; notwithstanding that he has been received by authority of the ordinary as a canon of Ross. Mandate to dispense Thomas Fitzmorice de Geraldinis, earl of Kildare (Kildarie) and Joan, [daughter] of James earl (fn. 9) of Desmond (Dessemonie), of the dioceses of Kildare (Daren.) and Ardfert, who are dwelling in the diocese of Dublin, after absolving them from excommunication incurred, and after enjoining penance, and after temporary separation, to contract anew and remain in the marriage which they formerly contracted per verba legitime de presenti and consummated, not in ignorance that they were related in the third and fourth degrees of kindred; proclaiming (fn. 10) legitimate the offspring to be born of the marriage. (f. 271d.)		 To Denis Macgillavanach, archdeacon of Kilmacduagh (Duacen.). Decree etc., as below. Nicholas V ordered provision to be made to him of the said archdeaconry, on its voidance by the death of Thomas Macgillavanach, absolving him from all sentences of excommunication, censures etc. as far only as regarded the taking effect of his letters. At his recent petition (containing that there are many in Ireland who affirm that the said absolution is of no avail to him and others who have a like clause in papal letters, for the removal of the flaw of surreptitiousness due to such censures, on account of which opinion many doubts arise and there is even reason to fear that homicides may in consequence take place, if such doubt be not swiftly settled by the apostolic see, whence the said letters emanated (fn. 11) ) the pope hereby decrees and declares that the said absolution fully avails him for the removal of the flaw of surreptitiousness due to such censures, general or special, as far only as regards the taking effect of the said letters.   • 2. On the back of the volume is the usual modern description in Italian: ‘Calisto iii. 1455. Anno 1 (to which a recent hand has added ‘2’), Lib. 3.’ The contemporary flyleaf has not survived, but at the top of f. i. is the contemporary description: ‘De diversis formis anno primo domini Calisti pape iii.’ A similar contemporary description occurs, as usual, on the bottom edge of the volume: ‘Tertius de diversis [formis] anno primo domini nostri domini Calisti pape tertii.’ There are ff. i.–cccvi. of text.
  • 3. In the year, millesimo quadringentesimo quinquagesimo quinto, ‘quinto’ is cancelled and over-written ‘P(etru)s,’ and ‘sexto’ substituted in the margin without the usual subscription.
