1455. Kal. Sept. (1 Sept.) St. Peter's, Rome. (f. 19.)	To Peter and John de Medicis and their fellow merchants following the Roman court. Bond in their favour, as against the pope, the papal camera and his successors, for the sum of 6,000 florins of gold of the camera which (over and above past loans free of interest (fn. 2) ) they have this day lent free of interest (fn. 3) to the pope; with grant hereby that they may retain and exact up to the said sum from the moneys of the indulgences of the year of Jubilee which were granted in England by Nicholas V, in whosesoever hands they may be, even if in their own hands or in the hands of any other. (fn. 4) In the event of their not being fully paid from the said moneys of England, the pope hereby orders Alan, cardinal priest of St. Praxed's, whom he is sending as legate de latere to France, to pay them from the first moneys of the tenths imposed or to be imposed by him in France etc. If within the next coming six months they have not been paid in whole or part out of the said moneys of England and France etc., the pope hereby specially binds in their favour the revenues of the papal camera which shall come into their hands, and grants them power to receive them from any debtors of the camera and to keep them. 16 Kal. Aug. (17 July.) St. Peter's, Rome. (f. 29d.)	To the priors of St. Mary's, Killagh (de Belloloco) and St. Mary's, Innisfalynd, in the diocese of Ardfert, and the dean of Ardfert. Mandate, as below. The recent petition of Dermit Ysuellewayn, archdeacon of Aghadoe (de Achadeo) in Ardfert, bachelor in canon law, contained that after Martin V's confirmation and reservation to himself and his successors of the absolution from all sentences etc. of excommunication etc. incurred for simony, and after the said Dermit had, in virtue of certain letters (fn. 1) of Eugenius IV, obtained the deprivation and removal, by the definitive sentence of one of the judges appointed therein, of Florence Osuellewayn, then archdeacon of Aghadoe, who, although he did not prosecute within the lawful time the appeal which he lodged from the said sentence, refused to give up possession of the archdeaconry to Dermit, they at length, as a result of mediation, came to an agreement, sworn to by both sides, that Florence should remain in possession and that Dermit should receive part of the fruits etc.; that subsequently, on the cessation of Florence's inordinate power and influence, Dermit in virtue of the said letters and the processes based thereon and of the said sentence, which became a res judicata, obtained possession of the archdeaconry and is at present in possession, taking the fruits in good faith, perhaps incurring the said sentences etc. and perjury. The archdeaconry being still void by the said simonical agreement, the pope hereby orders the above three to collate and assign it, a non-major dignity, value not exceeding 16 marks sterling, to Dermit (who alleges that he was successively dispensed on account of illegitimacy, as the son of an unmarried man of a race of dukes and an unmarried woman related in the third and fourth and in the fourth and fourth degrees of kindred, without mention of which he had been made a clerk, (i) to act as a clerk and be promoted to all, even holy orders and hold the said archdeaconry (ii) to hold the perpetual vicarage of Kyllerochayn in the diocese of Ardfert, of which benefices provision was on their voidance ordered to be made to him by papal authority, and to hold the archdeaconry and vicarage together for life, and that the said Florence does not cease to molest him about the archdeaconry; the value of whose benefices, even of the said vicarage, the pope holds to be expressed by these presents; whom the pope hereby absolves from the said and from all other sentences etc. of excommunication etc., as far only as regards the taking effect of these presents, and absolves from the said perjury if any, relaxing the said oath, remitting the said fruits taken by him, dispensing him on account of any irregularity contracted by him, and rehabilitating him), whether it be void as above, or by the deaths of Maurice or Thady Ysulle wayn, or the resignation of the said Florence, or in any other way. He is hereby dispensed, notwithstanding the said defect, to receive the archdeaconry and to retain it and the vicarage together for life, and to resign them, simply or for exchange, as often as he pleases and hold instead two other incompatible benefices. 4 Kal. Sept. (29 Aug.) St. Peter's, Rome. (f. 40d.) (fn. 2)	To Peter and John de Medicis and their fellow merchants following the Roman court. Grant (seeing that the pope is sending to the realm of France etc. Alan cardinal priest of St. Praxed's as legate de latere, and that the said cardinal has contracted debts with them to the sum of 7,000 [gold] florins), that they may retain and exact up to the said sum from the moneys of the indulgences of the Jubilee which were granted in England by Nicholas V, in whosesoever hands they may be, even if they be in their own hands or in the hands of any others, (fn. 3) in the same way as was done in the time of the said pope in the case of a sum of 3,000 florins to be exacted by them in the said realm, as is contained in a certain obligation and in the acts etc. of Philip de Piscia, notary of the papal camera; with mandate hereby to the said cardinal, in case of their not being fully paid from the said moneys of England, to pay them from the first moneys of the tenths to be imposed in the realm of France etc. by his collectors. If within the next coming eight months they have not been paid from the said moneys of England and France etc. the pope promises to pay the said sum, and for its payment binds himself and the rights of the papal camera. Plenary faculty and power (for the facilitating of his mission to England in order to sollicit help against the Turks) to endeavour to negotiate peace or truces, perpetual or temporary, in the various provinces through which he will have to pass or in which he shall exercise his legation, and in the parts adjacent thereto, etc. Redemptoris et domini nostri. Faculty (the pope having recently by other letters appointed him, in aid of the preparation of an expedition against the Turks, to publish in Germany a Crusade and collect a tenth) inasmuch as difficulties may arise from certain expressions in the said letters, as for example where it is said that the said tenth shall under pain of excommunication be paid according to the true value of benefices, to accept the sworn statement of the beneficiaries as to such value; with other faculties and powers for facilitating the execution of his said mission, e.g. the temporary suspension of interdict, the commutation of vows, the granting of indulgences, etc. Cum te nuper pro subsidio.
