Confirmation, at the recent petition of the dean and chapter of the church of Lichfield, of (i) the following grants made to them by Henry the present king of England, by certain of his letters, namely, that no sheriff, undersheriff, escheator, constable, bailiff or other minister of his and his heirs and successors, or of any other, should enter the said church and its cemetery, close, precinct, gates or walls etc. in order to exercise any office therein, nor vex, disturb nor in any way molest them [the dean and chapter] nor any one of them nor of their successors nor of their servants etc.; that returns of all writs, precepts, attachments, and other mandates of him and his said heirs and summonses of the Exchequer, and the execution of the said writs, precepts, attachments, mandates and summonses, and of summonses touching pleas of the Crown and of felonies and all other pleas, should be made by the dean and chapter or their appointed ministers, etc. so that no sheriff, bailiff or other minister of the king and his heirs should, for the execution of any such writs, precepts, attachments, returns or the execution of the same, enter the said close, precinct, gates or walls; that the chattels of felons, fugitives and outlaws, and of all condemned [persons] dwelling within the said close, (fn. 2) precinct, gates and walls in case of forfeiture etc., should belong to the dean and chapter for the benefit of the fabric of the said church; that the dean and chapter should be his justices of the peace (justiciarii sui ad pacem), with power to arrest and imprison etc. any disturbers of his (sue) peace; that no one of the king's justices should enter the said close and walls in order to exercise his office there [Cal. Dispensation to him, who is of noble birth, to hold for life together with the said deanery, which is a major dignity, value not exceeding 60l. sterling, any one other, or, if he resign the deanery, to hold any two other benefices, with cure or otherwise incompatible, even if dignities etc. or two parish churches or their perpetual vicarages, etc., and to resign them, simply or for exchange, as often as he pleases. To Robert Theleuall, rector of Aluerdescote in the diocese of Exeter. Dispensation, as below. Nicholas V, at the petition of Henry king of England, dispensed him [Cal. Papal Lett., X, p. 141] to hold for life together with the said church any one other benefice, or if he resigned the said church to hold any two other benefices, with cure or otherwise incompatible, even if two parish churches or their perpetual vicarages or dignities etc., or one of each, and to resign them, simply or for exchange, as often as he pleased, the said pope's letters stating that he was of noble birth. At his recent petition, containing that he is not of noble birth but the son of a knight, (fn. 5) wherefore he fears lest the said letters may be held surreptitious, the pope hereby grants that they and their consequences shall hold good from the date thereof and have force as if it had been expressed therein that he is not of noble but of knightly birth. To Master Vincent Clementis, canon and provost of the church of Valencia, (fn. 6) a subdeacon of the pope. Power and faculty to dispense any persons in the realm of England, and in any parts subject to Henry king of England, on account of defect of age, to be, after they have attained their twenty-third year, promoted to all holy orders, even the priesthood, and to dispense them to minister in their orders received, and hold a benefice with cure; to dispense any of the said persons, related in the third or fourth degrees of kindred. or affinity, to contract marriage, and to dispense them, or those who, in ignorance that they were related in [the said] degrees, have contracted marriage per verba legitime de presenti and consummated it, to remain therein, proclaiming legitimate the offspring born or to be born of such marriages. To the bishops of Alessandria and Dunkeld and the dean of Dunkeld. Decree etc., as below. Nicholas V, on learning the voidance of the perpetual vicarage of Dunde in the diocese of Breehin by the death of Richard de Crag, granted on 12 Kal. Oct. anno 7 (20 Sept. 1453) a mandate to certain judges to collate and assign it, value not exceeding 32l. sterling, to Gilbert Forstar, (fn. 7) archdeacon of Brechin, priest, M.A., of noble birth, notwithstanding that he held the said archdeaconry, a non-major dignity with cure, and a canonry and prebend of Moray called (nuncupatos) the succentorship (succentoriam), value altogether not exceeding 60l. sterling, and that he had been lately dispensed to hold for life together with the said archdeaconry any benefice with cure or otherwise incompatible, even if a parish church or its perpetual vicarage or a dignity etc., and to resign them, simply or for exchange, as often as he pleased, and hold two other incompatible benefices, provided that they were not two parish churches. Inasmuch as the said pope died before his letters were drawn up, the present pope hereby decrees that they shall hold good from the said date and that these presents shall be sufficient proof thereof, and orders the above three to collate and assign the said vicarage accordingly. Motu proprio collation and provision of the canonries and prebends of Magdeburg and Lübeck, the value of each of which does not exceed 10 marks of silver, which have become void by the death without the Roman court of John Gele, an acolyte of the pope, and therefore ipso facto reserved to the pope, he having been an abbreviator of apostolic letters. To John Carr[i]ck. Collation and provision to him (who was lately dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, to be promoted to all even holy orders, and also in regard to retaining a canonry and prebend of Dumbar and the perpetual vicarage of Lochtresk in the diocese of St. Andrews, and who has had himself so promoted) of the archdeaconry of Dunkeld, a non-major, nonelective dignity with cure, value not exceeding 35l. sterling, void at the apostolic see, and therefore reserved, by the resignation made there to the pope of Adam de Mongomeri through his proctor Master William Gonne, an abbreviator of [apostolic] letters, licentiate of canon law; with mandate of execution hereby to the bishops of St. Andrews and Glasgow and the official of Dunkeld; notwithstanding that he holds the said canonry and prebend and vicarage, the value of each not exceeding 12l. sterling. He is hereby dispensed, notwithstanding the said defect etc., to receive the said archdeaconry and to retain it and the said vicarage for life, and to resign them, simply or for exchange, as often as he pleases, and hold instead two incompatible benefices, provided that they be not two parish churches or perpetual vicarages or two major or principal dignities, or one of each.
