Mandate to collate and assign to William Fornyvalle, priest, of the diocese of York, the rectory of Okallie in the diocese of Cloyne (Clonen.), value not exceeding 40 marks sterling, of the patronage of laymen (fn. 3), so long void by the death of John Ikella that by the Lateran statutes its collation has lapsed to the apostolic see. Mandate (the pope having been informed by Cornelius Ocathalain, priest, of the diocese of Elphin, that Thady Magoyrecttayth, perpetual vicar of Athassgrach in the said diocese, has dilapidated the goods thereof, publicly kept a concubine, and committed perjury) if and after Cornelius (who on account of the inordinate favours which Thady has in the city and diocese of Elphin has no hope of obtaining justice therein) accuses Thady before the above three, to summon Thady, and if they find the above to be true, to deprive and remove him, and in that event to collate and assign the vicarage, value not exceeding 8 marks sterling, to Cornelius; whether it become void by such deprivation, or be void by the death of Maurice Yfynduayn or Malachy Yallluoyn (sic), or by the deprivation of William Yallluoyn, or in any other way. Mandate to collate and assign to Thomas Makylhauche, priest, of the diocese of Whiteherne, M.A., the perpetual vicarage of Symonthoune in the diocese of Glasgow, value not exceeding 8l. sterling, void by the death of James Wystharde; notwithstanding that the pope lately made him provision of a canonry with reservation of a prebend and a dignity etc. of Dunkeld, and of a benefice with or without cure, wont to be assigned to secular clerks, even if a dignity etc., in the collation etc. of the bishop and the prior and chapter of St. Andrews, which, upon his obtaining the vicarage shall be null so far as regards a benefice with cure or a dignity etc. Litterarum sciencia, vite etc. (A. and Jo. de Millinis. \| A. xx. To the abbot of St. Mary's, Leix (de Lege dei) and the prior of St. Mary's, Hachnkyrt, in the dioceses of Leighlin and Ossory, (fn. 4) and the dean of Leighlin. Mandate to collate and assign to Cornelius Oleaglor, clerk, of the diocese of Leighlin (who was lately dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, and to whom the present pope ordered provision to be made of one or two benefices, even if such one or one of such two had cure or were a dignity etc., in the collation etc. of the archbishop of Dublin and the bishop of Leighlin and the deans and chapters etc. of those churches, and whom the pope by the same letters dispensed to receive and hold such reserved benefice or benefices) the rectory of the parish church of St. Mary alias St. Finntanus, Balletempullriabam, in the diocese of Dublin, value not exceeding 18 marks sterling, in the collation etc. of the abbot and convent of the Cistercian monastery of St. Mary by Dublin, so long void that there is no certain knowledge of the manner of the last voidance and that by the Lateran statutes its collation has lapsed to the apostolic see, upon obtaining which the said other letters shall be null as far as regards another incompatible benefice only. Mandate (the pope having been informed by Andrew Ofortyerd, clerk, of the diocese of Ferns, that Denis Olathasayg, rector of Kyllnamariach in the said diocese, of the patronage of laymen, has dilapidated the goods thereof, kept a concubine and, ignorant of letters, has for several years past neglected to reside and celebrate therein) if and after Andrew (who was lately ordered to be dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, and whom the pope hereby absolves from all sentences of excommunication etc. as far as regards the taking effect of these presents, and who, on account of the inordinate favours which Denis has in the city and diocese of Ferns, has no hope of obtaining justice therein) accuses Denis before the above dean, to summon Denis, and if he find the above to be true, to deprive and remove him, and in that event to collate and assign the rectory, value not exceeding 6 marks sterling, to Andrew, provided that the said patrons consent. Mandate (the pope having been informed by Thomas Ocurbri, scholar, of the diocese of Clogher, that Thady Ogoband, perpetual vicar of Druymaelchi in the said diocese, has dilapidated the goods thereof and publicly kept a concubine) if and after Thomas (who is illegitimate, being the son of unmarried parents, and whom the pope hereby absolves, as in the preceding) has been made a clerk, and accuses Thady before the above three etc. to summon Thady, and if they find the above to be true, to deprive and remove him, and in that event to collate and assign the vicarage, value not exceeding 6 marks sterling, to Thomas; whether it become void by such deprivation, or be void because Eugenius Ocondalaych, [now] abbot of the Augustinian monastery of SS. Peter and Paul, Cluayneoys, in the said diocese, entered and made his profession therein, or be void in any other way. 16 Kal. May. (16 April.) St. Peter's, Rome. (f. 152d.)	To the bishop of St. Andrews, the abbot of Lindores (de Londoris) in the diocese of St. Andrews, and the archdeacon of Hainaut in Liége. Mandate, as below. The recent petition of Walter Stewaert, canon of Glasgow, contained that collation and provision were made to him by papal authority of a canonry of Glasgow and the prebend of Barlarnick, which William, elect [now] of Glasgow, then of Dunkeld, was holding at the time of his promotion made by Eugenius IV to the latter church, and which had become void by the lapse of the canonical time for consecration; but that Alexander Lewinston, clerk, of the diocese of St. Andrews, falsely alleging that the canonry and prebend belong to him, hindered and still does the said collation and provision from taking effect, intruded himself and is still in unlawful possession, taking the fruits, wherefore Walter appealed to the apostolic see; and that the present pope committed the cause of the appeal and of the principal matter, first to Baptista bishop of Camerino, at Walter's instance, and then to Bernard bishop of Bazas (Vasaten.), then [both] residing in the Roman court, the latter of whom has by a definitive sentence declared that the said collation and provision were and are canonical and ought to have taken and to take effect, and the said canonry and prebend to have belonged and to belong to Walter, and adjudged them to him, declared Alexander to have had and to have no right, removed him and inducted Walter etc. condemning Alexander in the fruits taken and costs, which latter the said bishop afterwards taxed at 20 gold florins of the camera. At the said petition, adding that Walter fears lest whilst the suit has been pending others may have intruded themselves or may do so, the pope hereby orders the above three to execute the said sentence, inducting Walter and removing Alexander etc. and to do so even against such other intruders, as far only as regards giving possession to Walter, as if the said sentence had been delivered against them etc. Exhibita nobis. 4 Kal. Sept. (29 Aug.) St. Peter's, Rome. (f. 192.)	To the prior, the archdeacon and the official of St. Andrews. Mandate (the pope having been informed by William Wodman, priest, of the diocese of St. Andrews, M.A., that William Bertram, priest, promised a sum of money to Henry Clerch, sometime perpetual vicar of Swynton in the said diocese, in order that he should exchange another benefice with him; that part of the said sum was paid by Bertram to Henry, and another part deposited by him with another person, and that Henry resigned to James bishop of St. Andrews, who, perhaps ignorant of such promise, payment and deposit, admitted the resignation, and made collation and provision of the vicarage by his ordinary authority to Bertram, who under pretext thereof obtained and still unduly detains possession, incurring the sentences of excommunication etc. for simony) if and after Wodman accuses Bertram before the above three etc., to summon the latter, and if they find the above to be true, to declare the said collation and provision null and void, and remove Bertram, and in that event to collate and assign the vicarage, value not exceeding 20l. sterling, to Wodman. To Bernard Okeanaid, canon of Achonry (Akaden.), Mandate to collate and assign to Cornelius Okearnald [sic], canon of Achonry, priest (whom the pope hereby rehabilitates on account of his having held the perpetual vicarage of Caylconduy (cf. below) in the diocese of Achonry, which had been canonically collated to him, for more than a year without having himself ordained priest) the perpetual vicarage of Cillassar in the said diocese, which is alleged by some to be of the patronage of laymen, and whose value does not exceed 4 marks sterling, void by the death of Thady (Tatrannus, rectius Tatiannus) Ohacgra, summoning and removing Thady (Thateus) Macabrachim, priest, of the said diocese, who has by his own temerity and without any canonical title, unduly detained possession for more than a year (fn. 5) but less than three; whether it be void as stated, or because Magonius Oruam held it [for more than a year] without having himself ordained priest, or by Miletus (rectius Milerus) de Uxonis, sometime vicar of Cillassar, obtaining by authority of the ordinary another incompatible benefice, or be void in any other way; provided that the patrons, if any, consent, and notwithstanding that Cornelius has been received by authority of the ordinary as a canon of Achonry. To Nellanus Maguigye (rectius Maguigyr), canon of Clogher, Mandate (the pope having been informed by Donatus Magrath, scholar, of the diocese of Clogher, that Donald Maguigye (rectius Maguigyr), rector of Culmane in the said diocese, has dilapidated the goods thereof, has publicly kept a concubine or concubines one after the other, pawned part of the fruits etc. of the said church (fn. 6), and neglected for more than six years to celebrate divine offices therein) if and after Donatus (who is illegitimate, being the son of unmarried parents) has been made a clerk, and has accused Donald before the above canon, to summon Donald, and if he find the above to be true, to deprive and remove him, and in that event to collate and assign the rectory, value not exceeding 6 marks sterling, to Donatus; whether it become void by such deprivation, or be void by the resignation of Cornelius Macgillacalina, or by the death of Rory Ymadaduyn, or because John Maguigie (rectius Maguigir) held it [for more than a year] without having himself ordained priest, or be void in any other way. Mandate to collate and assign to John Osichigi, priest, of the diocese of Clogher (who was lately dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure) the perpetual vicarage of St. Molua de Cluayn in the said diocese, value not exceeding 5 marks sterling, void because Cornelius Osichigi, having obtained it by canonical collation, held possession for more than two years without having himself ordained priest, the said Cornelius, who still unduly detains possession, being summoned and removed. Mandate (the pope having been informed by Thomas Ocuynkeannayn, clerk, of the diocese of Tuam, that Nymeas Oruaryg, rector of Kylcorryn alias Corcomogay in the said diocese, has publicly kept a concubine, and dilapidated the goods of the rectory, and committed simony) if and after Thomas (who is of noble birth, and who on account of the power of Nymeas has no hope of obtaining justice in the city or diocese of Tuam) accuses Nymeas before the above prior, to summon him, and if he find the above, or any of them sufficient for the purpose, to be true, to deprive and remove him, and in that event to collate and assign the rectory, of the patronage of laymen and value not exceeding 8 marks sterling, to Thomas, provided that the said patrons consent. Mandate to collate and assign to Nicholas Olachnan, clerk, of the diocese of Tuam, the son of a priest and an unmarried woman, the perpetual vicarage of Killmaclayn (rectius Killmaelayn) in the said diocese, value not exceeding 3 marks sterling, so long void, by the death of Dermit Macgillamuyre, that its collation has by the Lateran statutes lapsed to the apostolic see; summoning and removing Thomas Mackanyliub, priest, of the said diocese, who, having obtained possession by collation made by authority of the ordinary after the said lapse, has detained it for more than a year; whether it be so void, or by the death of Dermit Macgillacomayn, or because Eugenius Macaedagayn, when a secular priest, and holding the vicarage, entered and made his profession as a canon of the Premonstratensian monastery of St. Mary de Cella parva in the said diocese, or be void in any other way. Mandate (the pope having been informed by Richard de Stantona, perpetual vicar of Bugeskera (rectius Burgeskera, as below) in the diocese of Tuam alias Mayo, that John Ocennuayn, rector of the rectory of rural lands of Wallnachdarach in the said diocese, has committed perjury, alienated and uselessly consumed many goods belonging to the rectory, been a notorious fornicator, and detained without dispensation the said rectory (fn. 7) and a certain other church [not here named] with cure of souls, against ‘Execrabilis’) if and after Richard, who is a priest and of noble birth by both parents, accuses John before the above three etc., to summon John, and if they find the above or any one of them sufficient for the purpose to be true, to deprive and remove him, and in that event to collate and assign the rectory, which is not parochial and has habitual but not actual cure of souls, (fn. 8) value not exceeding 12 marks sterling, to Richard; notwithstanding that he holds the said vicarage of Burgeskera, value not exceeding 2 marks sterling, which he is hereby specially dispensed to hold for life together with the said rectory. Mandate (the pope having been informed by William Olachnayn, priest, of the diocese of Tuam, that Nicholas Maeydun (rectius Macydun), perpetual vicar of Kyllynadyma in the diocese of Clonfert, has dilapidated the goods thereof and publicly committed simony in the obtaining of it) if and after William (who on account of Nicholas's power has no hope of obtaining justice in the city or diocese of Clonfert) accuses Nicholas before the above three etc., to summon Nicholas, and if they find the above or one of them sufficient for the purpose to be true, to deprive and remove him, and in that event to collate and assign the vicarage, value not exceeding 5 marks sterling, to William; notwithstanding that the present pope lately granted him provision of a benefice with or without cure, even if a canonry and prebend, dignity etc., in the collation etc. of the archbishop of Tuam and the bishop of Kilmacduagh (Duacen.) and the deans and chapters etc. of those churches, which grant shall, upon his obtaining the vicarage, be null as far only as regards a benefice incompatible therewith. 4 Kal. Sept. (29 Aug.) St. Peter's, Rome. (f. 306d.)	To the bishop of Clonfert. Mandate, as below. The recent petition of Maurice Ymulcairill, priest, of the diocese of Clonfert, contained that he formerly obtained from the apostolic see letters to the ordinary of the place, by which commission was given to the said ordinary to dispense Maurice by papal authority, notwithstanding his illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure; that Maurice, in ignorance of the law, presented them, not to the said ordinary, who was then absent (qui tunc agebat in remotis), but to the metropolitan, who in course of a visitation of his province had come to the said diocese, and had himself dispensed by the said metropolitan; that, the perpetual vicarage of Cluayncayncayirill in the said diocese being void, [now] by the resignation of John Ymulcairill, then by the death of Donald Ymulcairill, perpetual vicar of the said church (fn. 9), and being so long void that by the Lateran statutes its collation had lapsed to the apostolic see, he caused collation and provision to be made to him thereof by the said metropolitan, by his ordinary authority; that (after under pretext of the said dispensation, collation and provision he had taken possession of the vicarage, and had held it for some time, taking the fruits, and had had himself promoted to the said orders, and had celebrated masses and other divine offices, and had for some time exercised the cure of souls of the parishioners) he had himself dispensed anew by the said ordinary (who confirmed the above dispensation, collation and provision), and had collation and provision made to him anew thereby, by his said ordinary authority, and, on the occasion of the said collations, gave sums of money both to the said collators and to the archdeacon of Clonfert, thereby incurring the sentences of excommunication etc. for simony. At the said petition (adding that under pretext of the said dispensations, collations and provisions he has unduly detained the vicarage more than four years but less than five, taking the fruits), the pope hereby orders the above bishop to absolve him from simony etc. and from the said sentences etc., enjoining penance, dispense him on account of irregularity contracted by celebrating as above when under the said sentences, dispense him to minister in his said orders, and rehabilitate him, and moreover to collate and assign to him, if found fit and after he has resigned it, the said vicarage, value not exceeding 2 marks sterling, whether it be void as above, or by the resignation of John Ymulcairill, or in any other way. Non. Sept. (5 Sept.) S. Maria Maggiore, Rome. (f. 309d.)	To the bishop of Clonfert, the abbot of Abbeygormacan (Nova via) in the diocese of Clonfert, and William Ohauceynd, canon of Clonfert. Mandate to make provision to Dermit Odonelean, clerk, of the diocese of Clonfert (who, notwithstanding his illegitimacy as the son of a priest and a married woman, the said priest's gossip (fn. 10), was lately dispensed by authority of the ordinary to be promoted to minor orders, and after he had received them, was dispensed by papal authority to be promoted to all, even holy orders and hold a benefice even with cure; and who subsequently, without having obtained other dispensation in regard to the said defect, was received by authority of the ordinary as a canon of the church of Clonfert, in which although there are separate prebends, yet there is no fixed number of canons) (fn. 11) of a canonry of the said church of Clonfert, and to collate and assign to him the rectory of Magrarnayn in the diocese of Tuam, with cure and value not exceeding 8 marks sterling, so long void by the death of John Omuleoyn that by the Lateran statutes its collation has lapsed to the apostolic see; summoning and removing Murianus alias Mulruony Omuleoyn, clerk, of Clonmacnoise (Cluanen.), who under pretext of an acceptance and provision (made on the strength of letters granted to him by Eugenius IV, but after the present pope's revocation at his accession of the graces and expectative letters of Eugenius which had not taken effect) has detained the said rectory for some time but not more than a year, and from fear of whose power, as regards the said rectory, Dermit has no hope of obtaining justice in the matter in the city and diocese of Tuam.
