To the bishop of Ardagh, the abbot of Lara alias Granard in the diocese of Ardagh, and the official of Ardagh. Mandate to collate and assign to Geoffrey de Lemara, rector of Molifernan in the diocese of Meath (whom the pope has this day by other letters [below, f. 62d.] ordered the above to cause to be admitted as a canon of the Augustinian priory of Trysternach in the same diocese and to receive his profession; and whom the pope has required to resign thereupon etc. the said rectory, value not exceeding 20 marks sterling, and who was lately dispensed by papal authority, on account of illegitimacy as the son of an unmarried nobleman, of a race of knights and barons, and an unmarried noblewoman, to be promoted to all, even holy orders and hold a benefice even with cure, after which, having been so promoted, he obtained by canonical collation the said rectory, and who from fear of the below-mentioned Walter has no hope of obtaining justice in the city and diocese of Meath) after he has made his profession as above, the said priory, which is conventual and elective and has cure, value not exceeding 60 marks sterling, which became void by the death of Richard Hylle, and reserved under Eugenius IV's reservation of all conventual priories, void and to be void, had not been disposed of by the said pope at the time of his death, and therefore remains reserved under the present pope's continued reservation of priories and other benefices reserved and not disposed of by the said predecessor at the time of his death; summoning and removing Walter Nonlla, canon of the said monastery, who took possession of his own temerity and with the help of lay power without any canonical title, and has unduly detained it for more than ten years. Mandate (the pope having been informed by Fergallus Occurryn, a monk of the Benedictine monastery of Millau (de Miliano) in the diocese of Rodez (Ruthenen.), that Thady Obrien, prior of St. Mary's, Glascarig, of the same order in the diocese of Ferns, has publicly kept a concubine, dilapidated the possessions of the priory, and committed simony) if and after Fergallus (who is illegitimate, being the son of a priest, a professed monk of the said order, and an unmarried woman, and who, after making his profession in the said monastery [of Millau], had himself made a clerk) accuses Thady before the above three etc. to summon Thady, and if they find the above to be true, to deprive and remove him, and in that event to collate and assign the priory, which is not conventual nor a dignity nor a personatus, is dependent on the monastery of St. Dogmael's of [the order of] Tiron (sancti Doumelis Trenecen., rectius sancti Dogmaelis Tironen.), of the said order, in the diocese of St. Davids, and is wont to be governed by monks thereof, and whose value does not exceed 40 marks sterling, to Fergallus; whether it become void by such deprivation, or be void by the death of Donatus Ylaissi, or in any other way. Mandate to collate and assign to John Obrogan, [a friar] professed of the order of the third rule of St. Francis, called [the order] of Penance, priest, of the diocese of Clonfert, the perpetual vicarage of Kyllimaelcoysny in the said diocese, value not exceeding 4 marks sterling, so long void, by the death of Maurus Oscobta, that its collation lapsed to the apostolic see; summoning and removing John Omynathain (also written ‘Omynathan’), priest, of the said diocese, who, under pretext of a collation made to him by the ordinary after the said lapse, has unduly detained possession for more than two years, and from fear of whose power Obrogan has no hope of obtaining justice in the city and diocese of Clonfert; whether it be void as stated, or because Donatus Ymulalay held it for more than a year without having himself ordained priest, or it be void in any other way. To the archbishop of York and the bishops of Lincoln and Bazas (Vasaten.), Mandate, as below. The petition of the prior and convent of the Augustinian priory of Giseburn in Cleveland, in the diocese of York, contained that although there belongs to them, and although they have from time immemorial been in possession of, the right of taking two entire thirds of the tithes of sheep's wool and of lambs, which are pastured within the bounds of the towns (villarum) of Staynton, Malteby, Thornton, Ingleby Berwyk, Staynesby, Hemlington and Colby, in the said diocese (fn. 6), and an entire part of the tithes of hay growing in the lands and fields (in terris campis et agris) within the bounds of the towns of Staynton, Malteby and Thornton, and the entire tithe of the emoluments from the mills of the towns of Staynton and Ingleby, a moiety of the oblations made on the feasts of Christmas and Easter, the Purification of St. Mary the Virgin, and SS. Peter and Paul, in the church of the said town of Staynton, which church is appropriated to the said monastery, nevertheless Thomas Thode (rectius Todde), perpetual vicar of the said church, falsely alleging that the said right does not so belong to them, had unjustly hindered and was hindering them from the complete enjoyment of the said right (fn. 7), and had also taken, and refused to restore, certain mortuaries due to them; that they caused him to be summoned before Robert Ayscogh, doctor of canon law, then deputed, in accordance with the custom of the court of York, commissary of Robert Dobbes, official of York; that afterwards Robert Thornton, bachelor of canon law, then similarly commissary of the said official, proceeding wrongfully (perperam) in the cause, pronounced by his definitive sentence that the right of taking a moiety of the tithes of lambs and wool and the entire tithe of hay, together with the spiritual emoluments therein (i.e. in the said church) had belonged and did belong to the said Thomas and to the said vicarage, condemned Thomas to restore to the prior and convent the said mortuaries or a certain sum of money, and condemned him in the costs incurred before him (Robert Thornton) in the cause, reserving the taxation thereof to be made later; that the prior and convent appealed from the said sentence, in so far as it was delivered against them, to the apostolic see; that the cause of the appeal was committed by Eugenius IV to Master Alfonsus Segura, a papal chaplain and auditor, [now] of the present pope, then of the said pope (fn. 8), and by the present pope, for certain reasons, to Simon, bishop of Ossero (Ausaren.), then as now (etiam tunc) holding the place of a papal auditor, who by his definitive sentence pronounced bad and reformed the sentence of the said Robert Thornton in that part in which he adjudged the right of taking a moiety of the tithes of wool and lambs and the entire tithe of hay, together with the said spiritual emoluments to Thomas and the said vicarage, pronounced the appeal of the prior and convent to have been good, adjudged to them the right of taking two entire thirds of the tithes of lambs and of the wool of the said sheep and an entire part of the tithes of hay of Staynton, Malteby and Thornton, and also the entire tithe from the emoluments of the mills of Staynton and Ingle by, and a moiety of the oblations on the said feasts, imposed perpetual silence in regard thereto upon the said Thomas and the vicars for the time being, and condemned him in the costs incurred in the cause before him, which he afterwards taxed at 32 florins of gold of the camera. At the said petition, adding that the prior and convent doubt whether Thomas will obey the said bishop's sentence, the pope hereby orders the above three solemnly to publish it, cause payment to be made to the prior and convent of the said parts of tithes, and moiety of oblations adjudged to them, and satisfaction to be made to them in respect of the said costs, aggravating the processes as often as expedient, and invoking, if need be, the aid of the secular arm. Indult, at his recent petition—containing that he, who was recently elected prior of the said monastery, which is governed by an abbot, fears lest he may in course of time be removed from the priorship, which is claustral, by reason of some of its monks (who might desire to lead an unhonest and dissolute or irregular life, and whom he might therefore wish to reprehend) and for other unreasonable causes, whereby he would sustain no small detriment—that while he lives he shall and can be prior, and that he cannot be removed without great and reasonable cause, and that if he resign on account of infirmity or old age or from any other cause, he may have his stall in choir and voice in chapter, with other rights, pertinences and accessories like the abbot or prior for the time being (fn. 9), in accordance with the customs anciently observed there.
