To the abbot of Abbeygormacan (de Nova via) in the diocese of Clonfert, and the archdeacon and the official of Clonfert. Mandate to collate and assign to Malachy Oclunayn (rectius Oclumayn), clerk, of the diocese of Clonfert (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure) a canonry of Clonfert and the prebend called de Ballenouolloryht, value not exceeding 2 marks sterling, void by the death of Nicholas Odugilla, and also the rural rectory of Macmuach in the said diocese, which has been so long void that the mode of its last voidance is unknown and that its collation has by the Lateran statutes lapsed to the apostolic see, is in the collation etc. of the abbess and convent of the Augustinian monastery of Kilcreevanty (deocasta silva, rectius de Casta silva) in the diocese of Tuam, has habitual but not actual cure of souls, (fn. 2) and whose value does not exceed 12 marks sterling. To the abbot of St. Mary's, Abbeygormacan (de Via nova), in the diocese of Clonfert, the archdeacon of Clonfert and William Ohanceynd, canon of the same. Mandate (the pope having been informed by Henry de Burgo, clerk, of the diocese of Clonfert, that Donatus Omuregayd, canon of Clonfert, committed simony on the occasion of his resigning lately the rectory of Dundaygre in the said diocese of Clonfert in favour of David de Burgo alias Ocybayn, priest, of the diocese of Kilmacduagh (Duacen.), by receiving from the said David a sum of money in accordance with a bargain previously made, and that Ca[r]bricus Maccegayn, priest, of the said diocese of Clonfert, being excommunicate and publicly proclaimed excommunicate, has taken part in divine offices, even in contempt of the Keys; that Donatus has dilapidated the goods belonging to the said canonry and the prebend of Kylltessgyll, and Ca[r]bricus other goods belonging to certain parcels of tithes of Kyllrykyll, Kyllcule, Drumkyyt, Ballenakylle, and Tullachmachrusglaynd, called of the community of the church of Clonfert, and wont to be assigned as a title of a perpetual benefice without cure (fn. 3) ) if and after Henry (who is illegitimate, being the son of a priest and an unmarried woman related in the double fourth degrees of kindred and of a great race of nobles, and who was formerly made a clerk) accuses Donatus and Ca[r]bricus before the above three, to summon them, and if they find the above or enough thereof to be true, to deprive and remove them, and in that event to collate and assign the said canonry and prebend and parcels, whose value does not exceed 2 and 10 marks sterling respectively, and all of which can be canonically held together, to Henry; notwithstanding that the pope recently ordered provision to be made to him of the said rectory [of Dundaygre], value not exceeding 12 marks sterling, on its becoming void by the deprivation of the said David, to be made by papal authority, and dispensed him, notwithstanding the said defect, to be promoted to the other (ad reliquos), even holy orders, and receive and hold the rectory. Mandate (the pope having been informed by Thomas Ohanceynd, clerk, of the diocese of Clonfert, that William Ofathe, canon of Clonfert, formerly notoriously committed fornication, and has dilapidated the goods belonging to his canonry of Clonfert and prebend of Drochte) if and after Thomas (who is illegitimate, being the son of a priest, professed of the order of St. Augustine and in the abbatial dignity, and an unmarried woman, [both] of noble race, and was lately dispensed, by authority of the ordinary to be promoted to minor orders, and, after he had received them, by papal authority to be promoted to all holy orders and hold a benefice even with cure, and who from fear of William's power has no hope of obtaining justice in the city and diocese of Clonfert) accuses William before the above prior, to summon William, and if he find the above, or either of them sufficient for the purpose, to be true, to deprive and remove him, and in that event to collate and assign the said canonry and prebend, value not exceeding 6 marks sterling, to Thomas; whether they become void by such deprivation, or be void by the death of Duriacus Yceallayd, or in any other way. Mandate to admit by papal authority for this turn only the resignation which Walter Stewart, canon of Moray, proposes to make of his canonry of Moray and prebend of Abberlour and Butrufyn therein, and to collate and assign them, of the patronage of laymen by papal privilege which has not yet been derogated from, value not exceeding 12l. sterling, to William Lython, perpetual vicar of Enroury in the diocese of Aberdeen; notwithstanding that he holds the said vicarage, value [likewise] not exceeding 12l. sterling. Mandate to collate and assign to Thady Oclunayn, clerk, of the diocese of Clonfert (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which he had himself made a clerk) a canonry of Tuam and the prebend called Tetachsacxan (rectius de Tachsacxan), value not exceeding 2 marks sterling, so long void by the death of Thomas Olondgayn that by the Lateran statutes their collation has lapsed to the apostolic see; summoning and removing Thady Brecachanach (also written ‘Breachanach’), priest, of the diocese of Tuam who, under pretext of a collation made to him by the ordinary after the said lapse, has unduly detained possession for more than four years but less than five, and from fear of whose power Thady has no hope of obtaining justice in the city and diocese of Tuam. Mandate to collate and assign to Thomas Okearnaid, priest, of the diocese of Achonry, a canonry of Achonry and the prebend of Killmathaigin, value not exceeding 2 marks sterling, void because Philip Oclunan, [now] a friar of the third order of St. Francis, called [the order] of Penance, entered and made his profession in the house of Rosich, of the said order and diocese, although [the said Philip] has without any canonical title for more than three years unduly detained possession (fn. 6); summoning the said Philip and others concerned, (fn. 7) and removing Philip and any other unlawful detainer. Mandate (the pope having been informed by William Omuregaid, perpetual vicar of Lochryach in the diocese of Clonfert, that David Ocallanayn, canon of Clonfert has dilapidated and misapplied the goods belonging to his canonry and the prebend of Kyllaspuchmaellayn, and that William Ocorgrayn, canon of the same church has done likewise with the goods belonging to the parcels of tithes of Kyllconhyerynd, Lychyrgych, Hys hertthelercayn (i.e. Hyshertth Clercayn) and Kyllhillayn, called of the community of the church of Clonfert, wont to be assigned as a title of an ecclesiastical benefice to secular clerks, (fn. 9) that they have both neglected to reside at the said church, that David has committed simony and that William has publicly kept a concubine) if and after Omuregaid (who has studied canon law for several years and had himself made a clerk, and who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which he less than a year ago obtained, canonically collated to him, the said vicarage) accuses David and Ocorgrayn before the above three, to summon them and if they find the above or enough thereof to be true, to deprive and remove them, and in that event to collate and assign David's said canonry and prebend and Ocorgrayn's said parcels, value not exceeding 2 and 2 marks sterling respectively, to Omuregaid; notwithstanding that he holds the said vicarage, value not exceeding 5 marks sterling.
