On the voidance (after the present pope's reservation of all major cathedral dignities void and to be void) of the deanery of Ossory, a major dignity with cure, by the deprivation, made by Thomas bishop of Ossory by his ordinary authority, of Thomas Belian, on account of his faults and demerits, the chapter, to whom, when there are no papal reservations, the election belongs by ancient and hitherto observed custom, elected (perhaps in ignorance of the said reservation, and even after Belian had appealed to the apostolic see) Thomas Archere, priest, of the diocese of Ossory, who, likewise ignorant, consented to the election and had it confirmed by the said authority, and under pretext of the election and confirmation took and still detains possession. Seeing that they do not hold good, and that, as Archere's recent petition added, it is alleged by some that even Belian has no right in or to the deanery, the pope hereby orders the above abbot to summon Belian, hear and decide the said appeal, causing his decision to be observed by ecclesiastical censure, and if he find that Belian has no right, and if he find Archere fit, to collate and assign to him the deanery, value not exceeding 40 marks sterling. To the bishops of Aquila and Moray, and the prior of St. Mary's, Beaulieu (de Bello loco), in the diocese of Ross. Decree etc. as below. It was set forth to Eugenius IV on behalf of Patrick Fraser, priest, of the diocese of Moray, that (after he had been dispensed by papal authority on account of illegitimacy, as the son of an unmarried baron and an unmarried woman, to be promoted to all, even holy orders and hold any compatible benefices with or without cure, of any number and kind even if canonries and prebends, dignities etc. and to resign them, simply or for exchange, as often as he pleased, [and] had obtained possession of the deanery of Caithness, a major dignity with cure, collated to him by the said authority) he and Thomas de Spens resigned, for purpose of exchange, their respective benefices, namely, the succentorship of Moray, an office without cure and the archdeaconry of the same, a non-major dignity with cure, to John bishop of Moray, who carried out the exchange, making collation and provision of the succentorship to Thomas and of the archdeaconry to Patrick, who was then also holding the said deanery and who, in ignorance of the law and believing the said dispensation sufficient for the purpose, detained both deanery and archdeaconry together for about two years and was still detaining them, without dispensation in the matter, against the constitution ‘Execrabilis.’ The said pope therefore, under date Id. Feb. (13 Feb.) anno 16 [1447], rehabilitated him, requiring him to resign both deanery and archdeaconry, as is contained in letters of the present pope, those of Eugenius not having been drawn up before his death [see above, Reg. Lat. CCCCXLIII, f. 35]. The deanery being thus void by the said obtaining [of the archdeaconry], and the archdeaconry being void and reserved by the said constitution, the same pope on the same date as above absolved Patrick from all sentences of excommunication etc. as far only as regarded the taking effect of his letters, and granted that the said deanery and archdeaconry, value not exceeding 30l. and 40l. sterling respectively, should be collated and assigned to him, after his duly resigning them, dispensing him to receive and hold them for life. Seeing that on account of the death of the said pope the letters of the grant and dispensation were not drawn up, the pope hereby decrees that they shall take effect from the above date and that these presents are sufficient proof, and orders the above three to collate and assign to Patrick the said two benefices. Jan. (20 Dec.) anno 16 [1446], reserved it, value not exceeding 12 marks sterling, to his gift, for collation to the above John; and also granted that, upon its becoming void as above or otherwise, it should be collated and assigned to him, notwithstanding that he held the above parish church and a canonry and prebend of Cork, value not exceeding 20 and 3 marks sterling respectively, and was litigating in the Roman court about a canonry and prebend of Ossory, value not exceeding 10 marks sterling; the same pope further dispensing him to hold for life the said archdeaconry and parish church, and to resign the latter, simply or for exchange, and hold another benefice incompatible with the archdeaconry, even if a dignity etc. Inasmuch as the said pope died before his letters were drawn up, the pope hereby grants that the reservation and the grant and dispensation shall take effect from the above date, and that these presents shall be sufficient proof.
