To William Symond, rector of Staunton Harecourt in the diocese of Lincoln, bachelor of canon law. Grant and dispensation as below. Martin V dispensed him to hold for five years with the parish church of Muresley in the diocese of Lincoln any benefice with cure or otherwise incompatible, even if another parish church etc., and to resign them, simply or for exchange, as often as he pleased; and, upon his setting forth to the said pope that in virtue of the said letters he had obtained the perpetual vicarage of Ambresdon in the said diocese, and had held it for some time with Muresley, and that, having resigned the said vicarage he had obtained the parish church of Bukynhull in the said diocese, and that the end of the said period was at hand, the said pope prolonged it by other seven years; and upon its being set forth on his behalf to the present pope that in virtue of the said other letters he had successively resigned Muresley and Bukynhull and obtained Staunton Harecourt and Stanlake in the said diocese, the pope prolonged the said seven years to William's life, by letters in which it was stated that he was of noble race and a completed (fn. 2) bachelor of canon law, and that the value of the said two churches did not exceed 40 and 20 marks sterling respectively. At his recent petition (containing that he is not of noble birth, that although he is a bachelor of canon law he is not a completed bachelor, and that the said value is not in marks but in pounds sterling, and that therefore, as also because the said letters do not mention that he was holding at the date thereof a canonry and prebend in Lismore, value not exceeding 10l. sterling, he fears that they may be held surreptitious) the pope grants that his said letters and their consequences shall nevertheless hold good from the date thereof, and dispenses him to hold two incompatible benefices for life, even if two dignities etc., and to resign them, simply or for exchange, as often as he pleases, etc. notwithstanding his late ordinance to the contrary [see above, p. 5], etc. Litterarum etc. (An. and G. de Elten. | An. l. April anno 9 [1439, above, p. 62] (to hold for life with the said church, value not exceeding 10l. sterling, any benefice with cure or otherwise incompatible, or, if he resigned them, any two other benefices with cure or otherwise incompatible, even if two parish churches etc., and to resign them, simply or for exchange, as often as he pleased) shall hold good, as well as its consequences, as if it did not state that he was of noble race, which, as his recent petition contained, he cannot fully prove. To Hugh Blakton, clerk, of the diocese of Dublin. Grant, at his recent petition—containing that on the voidance of the canonry and prebend of Swords (de Swerdys) by the resignation to archbishop Richard of William Cruys, the said archbishop made collation and provision thereof to Hugh, who was then attaining (tunc ... attingebas) his twentieth year; and adding that by the statutes of Dublin the said prebend is sacerdotal and can only be collated to a priest or to one who can be ordained priest within a year, and that under pretext of the said collation and provision he obtained the said canonry and prebend and still detains them, taking the fruits—the said collation and provision being null, and the said canonry and prebend, value not exceeding 53 marks sterling, being still void as above, that the said collation and provision shall hold good from the present date, as if at the time thereof he, who is in or about the said year, had been a priest; with indult hereby to hold them without being bound to be ordained priest before reaching the lawful age. To Thomas Penven, priest, of the diocese of Glasgow, M.A. Grant (he having recently resigned to the pope his alleged right in or to the parish church of Lilliscleff in the diocese of Glasgow, and the pope having ordered provision to be made of the said church to Robert Turnbul, priest, of the said diocese) for life, or until he obtains a benefice of the value of 20 marks of the money current in Scotland, of a yearly pension of 15 marks of the said money upon the fruits etc. of the said church, to be paid in the town of Edynburch in the diocese of St. Andrews, under stated penalties, by Robert, who has consented, and by his successors, half at Whitsuntide and half at Martinmas. Rehabilitation, he, who is by both parents of a race of barons, having, on the voidance by the death of Robert Zons (i.e. Yong) of the deanery of Dumbar in the diocese of St. Andrews, a principal dignity with cure, been presented, when in his twenty-first year, by king James, to whom the presentation by special papal privilege belongs, to bishop Henry, who instituted him by his ordinary authority, under pretext of which presentation and institution he obtained and has held possession for more than a year. Mandate, at the petition of Alexander de Seton, layman, and Elizabeth de Crychton, of the dioceses of Moray and St. Andrews—containing that after the said Alexander and the late Egidia de Hay, having obtained a papal dispensation on account of their being related in the fourth and fourth degrees of kindred, had contracted per verba legitime de presenti and consummated marriage, and had offspring, he, asserting that the said marriage was null on account of the said impediment, denying that the said dispensation had been obtained, and hiding it in his house (apud se), caused Egidia to be summoned before Henry Horvy (sic), archdeacon of Moray, to whom the above bishop had given commission by his ordinary authority to hear and end the cause, and who promulgated a definitive sentence against Egidia, who did not appeal; that Alexander and Elizabeth, who was ignorant of the said marriage, contracted before Egidia's death, which Elizabeth in no wise compassed, marriage per verba legitime de presenti, solemnized it before the church, and have lived together for some (aliquot) years—to absolve Alexander from excommunication etc., enjoining penance, and to dispense him and Elizabeth to contract marriage anew, decreeing past, if any, and future offspring legitimate. To Roger Dounvyll, rector of the parish church of Lymme, wont to be governed by two rectors, in the diocese of Lichfield, I.U.B. Decree as below. Martin V dispensed him, when holding one (aliam) portion or part of the said church, to hold for ten years therewith any benefice with cure or otherwise incompatible, even if a parish church etc., and to resign both, simply or for exchange, as often as he pleased [Cal. Lett. VIII, p. 148]. At his recent petition, containing that he obtained by canonical collation the other (reliquam) portion or part of the said church, and is still holding both portions or parts, value not exceeding 40l. sterling, and that some doubt the force of the said dispensation as far as regards the said other (reliquam) portion, the pope decrees that the said dispensation extended and extends to the said other (reliquam) part or portion, and that he could and can hold it with the above-mentioned part or portion; with special dispensation hereby to hold the said portions together for life. Mandate, at the recent petition of the Cistercian abbot and convent of St. Mary, Tintern (de Tynternia alias de Voto), in the diocese of Ferns—containing that formerly the late Thomas, bishop of Ferns, appropriated to them, with the consent of the dean and chapter of Ferns, the parish church of Kynnech in the said diocese, in the bishop's gift, on its voidance by the resignation of the late Nicholas Fitznicholl' to the said bishop, and reserved a portion for a perpetual vicar; and that they hold possession of the said church, whose value, after deducting the said portion, does not exceed 6 marks sterling, that of the said monastery not exceeding 100l. sterling—if they find the facts to be as stated, to confirm the said appropriation. Mandate, at the recent petition of the Augustinian prior and convent of St. Mary, Bridgetown (Villepontis de Fermoy) in the diocese of Cloyne—containing that on the voidance of the rectory of the parish church of St. Lachtain (Lactinus), Balchayth, in the said diocese by the resignation to bishop Jordan of John Walsch, Maurice, son of John de Rupe [and] lord of Fermoy [and] baron of Muskeyghtrog, the patron, gave the right of presentation to them, in order that the said rectory might be appropriated to them, and that the said bishop, with consent of the chapter of Cloyne, appropriated the said rectory to the said priory, value not exceeding 7½ and 100 marks sterling respectively, reserving a portion for a perpetual vicar to be presented by the said baron and his successors—if they find the facts to be as stated, to confirm the said donation, appropriation etc. Sacre religionis.
