PRAYERS.
Foubert & al. versus Turst & al.
After hearing Counsel, at the Bar, upon the Petition and Appeal of James Foubert and Charlotte his Wife, and Esther Duplate, from Part of a Decree made in the Court of Chancery, in Michaclmas Term One Thousand Seven Hundred and Two, in a Cause there depending, wherein the Petitioners were Plaintiffs, and Thomas Turst and others were Defendants; and praying "the Reversal of the said Decree, as to all but the Eight Hundred Livers and Interest therein mentioned;" as also upon the Answers of the said Thomas Turst put in thereunto; and due Consideration of what was offered thereupon:
Judgement.
It is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Decree as complained of in the said Appeal shall be, and is hereby, reversed; so far as that the Estate in Common after the Eight Hundred Livers decreed to the Appellants are paid, and Three Hundred Livres allowed to the Respondent Turst, according to the Marriage Contract, are deducted, and other just Allowances to be retained by himself, the Respondent Turst is to accompt for the Residue, and give Security to the Court of Chancery, answerable to the Value of the Moiety thereof, to pay such Moiety to the Appellants, and other Heirs of the Respondent's late Wife, at the Respondent's Decease, or within Three Months after: And it is further ORDERED, That the Court of Chancery do give Directions, that the same be done accordingly.
