Sharpe versus Thomas.
Upon reading the Petition of John Sharpe; praying, That his Cause, which is appointed to be heard the Twentieth Instant, may be put off to some longer Time, he being indisposed:"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel, at the Bar, on Tuesday the Four and Twentieth Day of this Instant November, at Eleven a Clock in the Forenoon.
Trott versus Le Cle & al.
After hearing Counsel upon the Petition and Appeal of Nicholas Trott Esquire, from a Decree made in the Court of Chancery, the Seven and Twentieth Day of June One Thousand Seven Hundred and One, on the Behalf of Reignier Le Cle, John Henry Muyskin, John Gillis, and Jeremy Vander-Meer; and praying the Reversal thereof; as also upon the Answer of the said Reignier Le Cle, John Henry Muyskin, John Gillis, and Jeremy Vander-Meer, put in thereunto; and due Consideration of what was offered thereupon:
Judgement affirmed.
It is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of Nicholas Trott shall be, and is hereby, dismissed this House; and that the Decree from which he appealed shall be, and is hereby, affirmed.
Votes of H. C. about the Bp. of Worcester:
The House being moved, "To take into Consideration the Votes of the House of Commons, in relation to the Lord Bishop of Worcester:"
And after Debate thereupon :
Committee to draw an Address about them:
The Lords following were named a Committee, to draw an humble Address to Her Majesty, upon the Debate; (videlicet,)
Then the House adjourned during Pleasure; and the Lords withdrew into the Prince's Lodgings.
After some Time, the House was resumed.
And the Lord Steward reported from the Committee, the Address drawn by them.
Which was read, and agreed to, as followeth; (videlicet,)
Address:
"We, Your Majesty's most dutiful and loyal Subjects, the Lords Spiritual and Temporal in Parliament assembled, humbly take Leave to represent to Your Majesty, That it is the undoubted Right of every Lord of Parliament, and of every other Subject of England, to have an Opportunity of making his Defence, before he suffer any Sort of Punishment; and therefore humbly desire Your Majesty, that You would be pleased not to remove the Lord Bishop of Worcester from the Place of Lord Almoner, nor to shew any Mark of your Displeasure towards him, till he be found guilty of some Crime by due Course of Law."
Lords to attend the Queen with it.
ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Lord Steward, the Duke of Somerset, and the Earl of Burlington, do humbly attend Her Majesty, with the Address agreed to this Day.
Adjourn.
