My Lord finds that this proposition has been approved by the Lord Admiral's Council on condition that security be given for performance. the same “a farthing and a farthing” per ton for English ships & a penny per ton for foreign ships, subject to the rents of 5l. & 5l. to the Crown of England: & Customs officers within the ports of the Northern Coast were forbidden to receive any entry or “cocket” or certify any “cocquet return,” Victualling Bill or Discharge or to permit any landing or shipment of goods or to suffer any ships (liable to the said payment) to pass by or from them without a note from the said Justinian Angell or deputy testifying the payment of the said dues: that the premises are vested in petitioner & that several masters of English & foreign ships refuse to pay the dues, yet the Customs officers receive their entries. |

Prefixing: memorial to Treasurer Godolphin from the Customs Commissioners. By the second clause in the Act of the last Session [6 Anne c. 64] for the encouragement of the Trade to America it is enacted that the Flag Officers, Commanders, Officers & seamen of every ship of war shall have the sole interest & property of all vessels & goods they shall take in America when adjudged prize in any Court of Admiralty & subject to the Customs & Dues payable to her Majesty as if the same had been first imported into Great Britain & thence exported. The next clause says the same [as to] prizes taken by privateers. We have consulted her Majesty's Solicitor General & he has given his opinion that the goods thus taken in America and carried into any of the ports there are to be chargeable with such Duties as would be “left” in England if the same had been exported after an importation hither. The house or lodgings is an ancient building fronting the Green & consisting of an entry or hall & one parlour on the ground floor, 4 bed chambers, a small closet & withdrawing room above stairs, 3 small rooms or garrets at top & a kitchen & some conveniences below together with yards, gardens & a small terras next the Thames, a stable 21 foot by 18 foot next the store yard & a coach house shed 17 foot by 9 foot, the whole containing 42 foot broad by 328 foot long from the Green to the Thames. They are old & decayed & will be expensive to repair. They adjoin, on the east, land & buildings in lease to Mr. English which did sometime belong to the Housekeeper's lodgings or apartment. The greatest objection I foresee to the petitioner's lease may be the want of lodgings for the successors in his office though I find in the new buildings of the Court there is a small drawing room & entry 16 foot by 17 foot which will remain to the Surveyor and that there was (on new building the Palace) a good building made towards the Green adjoining to the store yard for the officers of the Works in general to meet in, which I find hath not of late been made use of, those officers sitting all together at Scotland Yard. If it be thought fit [some] conveniency may be made out of this building for a future Surveyor if he wants it. As the premises have never been in lease before, a rent of 10l. per an at least must be reserved to the Crown as a third part at least of the clear yearly value according to the Civil List Act [1 Anne c. 1]: and then considering the state of disrepair, the petitioner's arrears of 341l. 3. 4 are of as much or more value than the lease desired. In pursuance of an order of the Treasury Lords dated 6 Nov 1690 for giving certificates to the masters of [transport] ships engaged in the reduction of Ireland for one moiety of the money then due to them a certificate was made & delivered to the petitioner as attorney of Henry Gittins for 54l. 4. 0 in part of what was due for hire & freight of this ship. Petitioner claims a right to this certificate upon a just consideration. In 7 Wm. III an Act [6–7 Wm. & Mary c. 7] passed empowering the Commissioners for Transportation to make out debentures for the whole money due to the several ships employed in the reduction of Ireland and in order thereto the moiety certificates made out in 1690 as above were recalled into the Office [of Transports] “for that none of these had ever been satisfied.” Although the petitioner may have a just right to 54l. 4. 0 it has not been practicable in the whole Transport affair to make out more than one debenture upon one contract or for one immediate service. In this case a debenture ought to be made out for 101l. 6. 8 (being the total hire less the said 55l. & 50l. 7. 4) to the person legally entitled, the said Samuell Gittings & family being dead. Upon the death of any freeman who leaves a son or unmarried daughter under 21 years of age the executor is summoned before the Court of Orphans & obliged to give recognizance to exhibit an inventory & then to give recognizance to pay within 2 months what is due to the orphans on the foot of the inventory & to account for what shall afterwards come to his hands; after this they are to give recognizance to pay the [City] Chamberlain for the use of the orphans when they shall be of age (if son) or married (if daughter) the sums due to them & to maintain them in the meantime. If the Duty of a double 5s. be paid for every recognizance taken in the Orphans Court it will be a heavy tax upon executors. I consider the Stamps Acts of 5 & 6 Wm. & Mary [c. 21] & 9 & 10 Wm. III [c. 25] were not intended to apply to these recognizances, and the Stamps Commissioners have not looked upon them as so applying until very lately. 'Twould be well if this matter were cleared by an Act of Parliament. But if this be inconvenient, as taking away some part of the fund on which great sums have been lent, your Lordship may direct the Stamps Commissioners to go on in the usual methods they have been in until some informer bring this matter to a judicial determination in the Courts at Westminster. Prefixing: memorial from said Postmaster General. The packet boats between England & Portugal have of late met with several disasters. The New Allyance a year since was taken in her outward voyage through the Channel by 2 French privateers, each of a much superior force, after a very sharp engagement with them both for above 8 hours. The Old Allyance in Feb last was cast away in the mouth of the river at Lisbon by striking on a sand which had been shifted by violent storms & great land floods occasioned by 6 weeks incessant rains, at which time several ships were lost in the said river. The Expedition was taken some time before by 3 French men of war on the coast of Portugal having first lost all her masts in a great storm but was afterwards, on the proposal of the French commanders, ransomed by Capt. Clyes for 550l. “which we must acknowledge was a very reasonable & advantageous agreement.” These accidents have put us to great difficulties to supply the said correspondence, & we have been forced to order a small packet boat which had formerly been employed between Dover & Ostend to proceed to the Lisbon station & at the same time we had to order our deputies at Plymouth & Falmouth to hire such vessels as were to be had at either of those
ports till we could provide proper boats; & accordingly two boats have been hired but so small & defenceless that nothing but absolute necessity could have induced us to entrust her Majesty's mails & despatches therein at a time when the English Channel & the coast of Portugal has been infested with such a number of the enemy's privateers. We have therefore agreed for the building of a new packet boat in the river about 200 tons & she is now ready to sail to Falmouth. The Expedition is since refitted at Lisbon out of the Queen's stores there. These with the Queen & the Prince which are “reigning” [running] in the service are all proper vessels for that station. But in order to carry on a weekly correspondence with regularity & despatch one more packet boat at least is required, five boats being barely sufficient to perform that service by reason of the great distance of the passage, the boats seldom making their voyage out & home in less than a month and at their return to Falmouth requiring some time to be cleaned and repaired.
