October 5. 597. Royal sign manual directed to the Lords of the Treasury for the issue of 169l. to Thos. Lascelles for inspecting the demolition of Dunkirk in part payment of 123 days to June 24, at 3l. per day.

October 5. 598. Report of Sir P. Yorke, Attorney General, and C. Talbot, Solicitor General, to the Lords of the Treasury on the petition of Francis Charteris. Petitioner was indicted at the general sessions at Hick's Hall, 1729, December 1, for rape of one Anne Bond, and convicted at the sessions of gaol delivery at the Old Bailey, l729(–30), February 25, and condemned to death. On the report of Justice Price, Justice Probyn, and Mr. Baron Thompson, Recorder of the city of London, the King granted his pardon on April 10. The pardon for the felony and attainder passed the Great Seal May 14, and restored all legal capacities to petitioner, but not his estate. Commissions have issued for the inquiry as to his estate in pursuance of directions from the Lords of the Treasury. The annual value of his real estate is 2,807l. 0s. 3d. and his personal estate is 63,035l. 4s.d. Are of opinion that His Majesty may lawfully grant and restore same to petitioner. 3 pages.

Warrant from same to Edward Harley, one of the Auditors of Imprests, authorising him to prepare for declaration and to pass the accounts of Anthony Cracherode, Solicitor for the affairs of the Treasury, from 1728, June 11 to 1729, June 10, for defending and prosecuting suits on His Majesty's behalf and other affairs for His Majesty's service.

October 6. 602. Royal sign manual directed to the Lord of the Treasury, for the issue of 500l. to Joseph Willis, “to be applied towards defraying the expense of a public trial which we are pleased to have made in or near London of the method of making iron in air furnaces with the use of pit coal.”

October 6. 603. J. Scrope to the Commissioners of Taxes, transmitting from the Lords of the Treasury a statement by the Auditor of Land Revenues as to the state of the accounts of the Receivers General of the public taxes which are behind and undeclared to the year 1728 inclusive, and as to several balances due on the account of divers Receivers General still unpaid, many of the said accounts for several years past not being stated at all for want of vouchers to be produced by the Receivers General themselves. Their Lordships direct the utmost diligence in bringing the seven accountants named to pass their accounts forthwith, and further demand a statement of the debts owing to the public from Benjamin Blundell and Mr. Diston, late Receivers General of taxes for Leicestershire and Middlesex. 604. Same to the Commissioners of Excise, conveying the directions of the Lords of the Treasury for their furnishing Mark Kerr's regiment with subsistence money on the commanding officer's drawing bills on the Paymaster General of His Majesty's forces. [Ibid, p. 11.]
October 6. 605. Mr. Goodwyn, in nomination to be receiver of the land tax in part of Norfolk, loco Allen, defaulted, declines the said office. The entries in Allen's cash books to be transmitted to Walter Robertson, of Lynn, to enable an exact account of the outstanding arrears to be made out.
Order for the preparation of a sign manual for 1,500l. to be issued to Mr. Wither upon account for carrying on the work of laying the six ponds in Hyde Park into one, which His Majesty is pleased to have done.
Mr. Wither's report of the 6th instant on Mr. Whitworth's memorial for repairs in Bigshot and Sandhurst Walks, Windsor Forest, read and agreed to, whereby 10l. per annum is to be paid out of wood sales for the hire of a house for an underkeeper in Sandhurst Walk, and 472l. 10s. for repairing the lodge outhouses and rails belonging to Bigshot.
Charles Mason's petition read for stay of process against his estate in Shropshire for his account as late Treasurer and Paymaster of the Transport Office. Their Lordships adhere to their minutes of August 12 last.
The memorial of the Commissioners of the Customs for Scotland for disposing of the “Princess Louisa” sloop and employing two boats in lieu, with two surveyors and 12 able boatmen, read and agreed to.
Mr. Surveyor General's report of 1730, September 5, on the Earl of Cholmondley's memorial for filling up to 50 years his terms in sundry messuages, tenements and premises adjoining the Palace of Richmond, read and agreed to.
Auditor Lowndes's report of 1730, August 2, read and agreed to, and preparation of warrant ordered for 50l. to be allowed for rent of a house for keeping the court and prison within the liberty of the Tower of London, and 30l. for the expense of ironwork.
Thomas Aikinside, at the recommendation of Mr. Jenison, is to be a tidemaster at Newton in Northumberland, loco Samuel Simpson, deceased.
On reading the report of the Commissioners of Customs of 1729–30, February 5, touching the 200l. paid by Thomas Benson, late Secondary of Wood Street Compter, to the hands of a clerk of the Solicitor of the Customs instead of to Mr. Hawes, the Receiver General of the Customs, their Lordships are of opinion that prosecution should go on for recovery of same, which has some time since been levied by Sir Peter Delme and Sir Harcourt Masters, late Sheriffs of London, and is now deposited in the hands of the Chamberlain.
Sir Joseph Eyles' proposal for remitting the subsistence to Minorca and Gibraltar for two months from 1730, October 25, read and agreed to as follows:—
18,000 dollars for Port Mahon at sight, payable in gold at 55d. per dollar.
27,000 dollars for Gibraltar at sight, payable in gold at 54½d. per dollar.

October 7. 606. Order for the office to be supplied with the daily papers and weekly journals, Mr. Barnsley to take care thereof.
The Treasurer of the Navy's memorial of the 7th instant read for 10,000l. for Greenwich Hospital and 2,000l. for victualling. Order for the issue of the 2,000l. only, the 10,000l. for the hospital being to remain upon the deficiency of this year's supplies.
The report of the Attorney and Solicitor General for Col. Charteris's real and personal estate to be restored to him, read and agreed to.
A memorial of Lieutenant Bayliff, of Jersey, and others, for transmitting the pay of the non-commissioned officers and private men in the invalid companies there in British halfpence and farthings, read and referred to the Paymaster of the Forces.
Order for the payment by Mr. Lowther of 50l. royal bounty to Mr. Whatley.

October 7. 607. J. Scrope to the Auditors of the Imprests, conveying the directions of the Lords of the Treasury for the executors of Sir Peter Rich, Samuel Atkinson, Robert Henley and others, or Peter Crank, their chief agent, to pass their accounts for the same, with the allowance of certain sums for incidentals, &c. and to pay into the exchequer such part of the said allowances for which vouchers shall not be produced so as to free the accountants, who are many in number, from the danger to which they will always be liable while their account lies open and unpassed.

Warrant from the Lords of the Treasury ordering in pursuance of the letters patent of September 21 last, which appointed Commissioners of Customs for Great Britain, that certain of the Commissioners, viz., Sir Walter Yonge, Sir John Evelyn, Sir John Stanley, Thos. Walker, Sir Charles Peers, Bryan Fairfax and John Hill, should reside in the port of the city of London, and Sir James Campbell, Humphrey Brent, John Campbell, Henry Hale and George Drummond, and also Gwynn Vaughan and George Ross should reside within the city of Edinburgh. October 8. 612. J. Scrope to the Paymaster of the Forces transmitting from the Lords of the Treasury for report, the memorial of the officers in Jersey, praying that the pay of the non-commissioned officers and men may be sent in British halfpence and farthings.

613. Same to the Commissioners of Customs and Commissioners of Excise, transmitting from the Lords of the Treasury for report the petition from the traders at Norwich, complaining of the decline of their trade caused by smugglers on their coast.

Warrant from the Lords of the Treasury to the Auditor of the Receipt, the Clerk of the Pells, &c. out of the Exchequer bills for 550,000l. made forth in pursuance of an Act of the last session of Parliament to direct and apply 79,355l. 15s. 7d. together with 644l. 4s. 5d. remaining unapplied of the land tax, 1728, to discharge the whole principal remaining unsatisfied at 1730, September 30, on the orders of loan registered on the said land tax for 1728, and to clear interest on the said unsatisfied loans to 1730, September 30, the time of setting off the same.
Appending:—Certificate, dated Exchequer, 1730, September 30, by the Earl of Halifax, that “the principal money now remaining undischarged on the loans on the land tax for 1728, called tenth 3s. aid, amounts to 80,000l. towards which there remains in cash upon the said land tax, 644l. 4s. 5d. but what may be due for interest upon the said principal sum cannot yet be known.”

October 9. 615. Report of Sir P. Yorke, the Attorney General, on the petition of Mr. Henry Hole of Barbadoes, merchant, for His Majesty's license to collect the effects unknown to the Crown belonging to Stede Bonnet, convicted of piracy, in order to satisfy a debt of 1,707l. Barbadoes money, with interest and costs, due to him from the said Bonnet. Petitioner recovered judgment against Mary Bonnet, Stede Bonnet's wife and attorney in 1717, June 14. But Stede Bonnet having been since convicted of piracy, petitioner is entirely without remedy for his just debt, unless His Majesty authorise him to collect debts due to Bonnet in the Leeward Islands. His Majesty may lawfully gratify petitioner's request, the proper method of doing it being by grant to petitioner under the Great Seal of Great Britain of all the debts in the Leeward Isles due to Bonnet at the time of his attainder, with power to sue and recover same, accounting to His Majesty for any residue above his just debt. 10 pages.

Warrant under the royal sign manual to the Lords of the Treasury for the issue of 880l. 5s.d. out of the duty of 4½ % in the Barbadoes and Leeward Islands to Sir John Bruce Hope appointed by letters patent, of date 1721, August 30, Lieutenant Governor and Commander-in-Chief of the Bermuda or Summer Islands, in America, Bruce having been paid his allowance of 340l. per annum only up to 1725, Lady Day, and he being in arrear from that date to 1727, October 30, on which day he was succeeded therein by John Pitt.

October 14. 620. Mr. Ferrier is to be receiver of the land tax for that part of Norfolk lately under the receipt of Mr. Allen. The agents to attend to-morrow to settle the receipt and give an account of Mr. Pacy's affair, receiver for the same county, now deceased.
The report of the Paymaster of the Forces of the 13th instant, on the memorial from Jersey, for the pay of the Independent Companies there to be transmitted in British halfpence, read and agreed to. The transmission ordered accordingly and entrusted to the agents of the said companies, with allowance for carriage and insurance.

Petition of Peter Nice read for the King to bear the charge of pursuing an information qui tam brought by him against Sir John Lambert for concealing 20,000l. of his late father's effects, who was one of the directors of the South Sea Company. Their Lordships cannot advise the King to be at any such expense.
Order for the preparation of the warrant for Anthony Corbière to be commissioner of the wine license revenue, loco Daniel Dering, deceased.

October 14. 621. Warrant from the Lords of the Treasury to Charles Wither, Surveyor General of the Woods, agreeing that one of the underkeepers in Windsor Forest be fixed in Sandhurst Walk, with a cottage not costing more than 10l. per annum, and consenting to the proposed works and repairs at the lodge out-houses and rails belonging to Bigshot Rails and Sandhurst Walk, the whole charge not exceeding the estimated 472l. 10s. and to be defrayed out of wood sales.
Prefacing:—Wither's report to the Lords of the Treasury dated October 6, of the ruinous condition of the lodge owing to its exposed situation in the midst of barren heath, and that the inclosure called the Rails, which contains about 100 acres of land designed for the quiet layer of the deer, is down and lies open to the common cattle; and recommending the fixing of an underkeeper somewhere in Sandhurst Walk, as it is very extensive and well situated for His Majesty's hunting and for maintaining a large head of red deer.

October 14. 622. J. Scrope to the Commissioners of Taxes for their attendance on the Lords of the Treasury to-morrow in order to the settling the receivership of Norfolk.

October 15. 626. The report of the Agents for Taxes read touching Mr. Pacy's debt to the Crown as late receiver for Norfolk. The Commissioners are admonished of their tediousness and are to attend on Monday next with a state of Mr. Wilkinson's affair, and to attend Mr. Attorney concerning the difficulty of wording the commission for the receivership of Norfolk.
Christopher Capper, a creditor of the late King for purveyances in the Cofferer's office, is to be paid his arrears.
Mr. Arnall is to be paid by Mr. Lowther 147l. 10s. for copies of the “Free Briton,” delivered at the post office from 1730, July 23, to the 15th instant.

Warrant from the Lords of the Treasury to the Commissioners of Excise, authorising them to permit Robert Carter and others, merchants, importers of brandy and rum, to reduce their brandy to proof or to make a post entry so as the single duty of brandy and rum may be paid for the whole, as has been the practice in like cases.

Warrant under the royal sign manual to same for the preparation of a bill to pass same to revoke the letters patent which appointed Daniel Dering, since deceased, Richard Plumpton, John Jolliffe, Joseph Ferrers and Gilbert East, Commissioners for granting Wine Licences, and to appoint as Commissioners in their place Richard Plumpton, John Jolliffe, Joseph Ferrers, Gilbert East and Anthony Corbière, at a salary of 300l. per annum each. October 19. 635. Warrant from the Lords of the Treasury to the Auditors of His Majesty's revenues in Scotland, the Receiver General and Cashier of the Customs, and the Comptroller General thereof in Scotland, directing that out of the moneys collected for the coinage duties in Scotland since the Union, 12d. in the £ be passed and allowed to be divided as follows: to every collector at Leith and the outports of Scotland, 4d. per £ for the money by them respectively collected; to the Comptroller General of the Accounts of the Customs in Scotland 4d. per £, and to the Receiver General and Cashier of the Customs of Scotland 4d. per £: same being in accordance with several Acts for granting and continuing the coinage duty and with the usage in London.

October 19, 636. The Agents for Taxes deliver in a representation, dated 17th instant, informing of the proceedings in Wilkinson's case.Their Lordships are of opinion that the Agents, with the Remembrancer, should fix a peremptory day for disposal of the estates.
The same Agents are also to pursue the Attorney General's opinion with respect to the fixing and ascertaining the charge on Wilkinson with respect to the duties on houses, to try the validity of the estate settled by Wilkinson on his son Andrew's marriage.
The Agents also present Mr. Attorney General's opinion on Mr. Allen's case, late receiver for Norfolk, with the alterations necessary in the bond to be given by the new receiver.
The Agents are to attend Mr. Scrope and consider with him whether the country or the collectors may not come in as creditors under a commission of bankruptcy, to recover the money wrongfully received by Allen.
Orders for the following issues out of the supplies, 1730: for the Hessians, in further part, 10,000l.; to the Treasurer of the Ordnance, 20,000l.
Order for the issue to the Paymaster of the Works of 6,695l. 0s.d. to clear the debt in that office for Michaelmas quarter, 1730.

Order from the Lords of the Treasury for the execution of a warrant, dated 1730, September 19, from the Duke of Grafton to the Duke of Montagu, for the delivery to Grey Maynard of the following for the Prince of Wales's bedchamber at St. James's, viz. a new bed of yellow Genoa damask with four posts, a counterpoint of the same with a complete set of bedding, two pairs of window curtains, valances and cornices to draw up, an armed chair, a drawing chair, and six square stools stuffed and covered with the same damask and trimmed with silk arras of the same colour, For the drawing-room: two pair of crimson taffeta window curtains to draw up, with cornice and valance, an armed chair, and six square stools, to be covered with the old damask window curtains now in the room; a hanging pier glass in a gilt frame, table and stands ditto; four pairs of large glass sconces with gilt frames, two arms each. The Presence Chamber: a hanging pier glass in a walnut-tree frame, table and stands ditto, a chimney glass with a walnut-tree frame, six pairs of wrought brass arms.

October 20. 640. Same from same for execution of same, of date 1730, September 19, from the Duke of Grafton to the Duke of Montagu, for the supply of the following to Grey Maynard for His Majesty's service at Windsor, viz. a leather mattress stuffed with hair, an otter-down quilt covered with white satin and lined with a taffeta of the same colour, 3½ yards by 3½ yards.the squares of the quilting 10 inches each for the King's bed, two night chairs for their Majesties, and 107 yards of white silk taffeta for window curtains in the Queen's bedchamber. Likewise to give orders for repairing the carved work and gilding of two table frames in the Queen's apartment at So. James's, and to repair the frames and seats of 12 walnut-tree matted chairs, 12 maplewood chairs with matted seats, three cane chairs, six stools covered with yellow worsted camlet, and a little chair in the Duke's apartment at St. James's. Also to order the upholsterers, joiners, and cabinet makers to take down the King and Queen's damask bed and all the furniture in their apartment at St. James's, the Duke's bed, &c. and his servants', the woman of the Queen's bedchamber's bed, and to put up the furniture again after the lodgings are whitewashed.

Statement of opinion by the Attorney General, Sir Philip Yorke, on certain cases submitted as follows, on the position of the collectors in part of Norfolk who had made payments amounting to 4,000l. to Wm. Allen, late Receiver General of the Taxes there, for the first quarter of 1730:—
(1.) Have the collectors who paid than money to Allen a right to come in under the commission of bankruptcy, in order to their receiving a satisfaction for same in proportion with Allen's other creditors?
(2.) Will it be proper for His Majesty's Commissioners for the Affairs of Taxes to intermeddle in this affair on the collectors' behalf? 1 page. [Treasury Board Papers CCLXXIV. No. 45.]

Scrope to Mr. Carkesse, concerning the complaint addressed to Horace Walpole and himself by several tobacco merchants of the import of great quantities of tobacco from the Caracas. October 31. 644. Same to the Barons of the Exchequer in Scotland, transmitting certain observations of the Lords of the Treasury on the abbreviate account of receipts and payments on His Majesty's revenue of Excise, Scotland, for the quarter ended 1730, Michaelmas, and concerning the claim of 4,983l. 7s.d. for many years continued and brought forward as remains in cash undisposed, notwithstanding that the Fish Debentures and the annuity for the Equivalent are postponed in their payments for want of moneys sufficient to answer same. Desire the application of the said remains to improve the credit either of the said Fish Debentures or the Equivalent Fund.
