On reading your memorial of the 15th inst. for 17,693l. 6s. 5¾d. to discharge offreckonings and clearings to Dec. 22 inst. of the Troops and Regiments under your pay and upon considering your proposition for satisfying the said sum by assigning thereto tallies and orders on several funds (to wit 6,037l. 19s. 2d. on Candles Duties anno 1710 for clearings to said date; and 11,655l. 7s. 3¾d. in tallies on the General Mortgage anno 1710 for offreckonings to same date) my Lords approve your proposition, on the assurance which you have given them that the said tallies and orders shall not be delivered out so as to be sold at a discount to the prejudice of the public credit. Treasury reference to the Attorney General of the petition of William Paule and Christopher Clitherow Esqrs., plaintiffs in a writ of error in Parliament against Sir John Shaw bart., defendant, shewing that they brought the writ of error into the House of Lords early last Session of Parliament and were ready to have argued it that Session, but it being a cause that relates to the revenue they could not bring it on before the Parliament was prorogued and that, being obliged to instruct new Counsel, they can't conveniently have it argued till after Xmas: therefore praying that the defendant may not be permissed to move to dismiss their suit or to petition the House of Lords that it may be argued, since they are in earnest to bring it on themselves with all speed. Same to the Customs Commissioners enclosing a letter [missing] from [Secretary] Lord Dartmouth with the copy of a letter [missing] from the Admiralty Lords wherein they propose that pilots going on board ships that come from infected places should perform quarantine in the said ships because the little boats they usually sail in cannot bear the sea in bad weather. Lord Dartmouth signifies her Majesty's pleasure to have this method observed. You are to give the necessary orders accordingly. Further it is her Majesty's pleasure that the Customs officers and the Commanders and other officers of her Majesty's ships should be assisting to each other in the [insistence on the] due performing of quarantine. Dec. 19. William Lowndes to John Howe [Paymaster of Guards and Garrisons]. The Treasury Lords have agreed that the sums due to Col. Jones's Regiment in the West Indies shall be satisfied to them in the manner you proposed in your report of the 9th inst. But in regard the greatest part thereof is to be paid out of the tallies and orders remaining in your hands on fonds that are somewhat remote you are to take care that the said tallies and orders be not delivered out for the use of the said Regiment until they can be disposed of at par or security be given to your satisfaction that they shall not be sold or disposed of at a discount to the prejudice of the public credit. Treasury reference to the Agents for Taxes of the petition of Thomas Albert, late Receiver General of Taxes [for Co. Worcester] shewing that there is due from him a great arrear occasioned by Fletcher Albert's misapplying of the public money he entrusted in his hands; that he has taken out an extent against the said Fletcher Albert and by inquisition taken Dec. 13 inst. before the Sheriffs of London has found that the Royal Africa Company is indebted to him in 52 bonds amounting to 11,087l. 14s. 10d.: therefore praying that the money may be secured on the said extended bonds. Same to George Granville, Secretary at War, to prepare a royal warrant for paying Col. Jones's Regiment in the West Indies as follows.
Prefixing: reports by said Granville and by John Howe, Paymaster of Guards and Garrisons, on the case of said Regiment. By the Queen's Regulation the Regiments in the West Indies shall be mustered every two months and the muster rolls and duplicates thereof signed as prescribed and transmitted home by the first shipping. They are to be paid and kept subsisted six months in advance. Jones's Regiment is cleared to 20 May 1709 and from that time only 2,000l. has been issued to it upon account; and in order to clear the Officers and effectives to Nov. 23 inst. 13,888l. 9s. 10d. is required, but the muster rolls are generally so imperfect that they will not be sufficient to vouch any part of the pay thereof before the Auditors, save by Treasury authorisation. The reasons for the imperfections of the muster rolls are that neither Col. Jones nor any of his Officers had any notice of the time and place of the musters frequently taken by the Governor, Col. Parke, although they were in the same island and the said Governor refused to muster any man not on the spot though known to be absent on detachment or on board her Majesty's ships of war attending that station &c. Other imperfections in the rolls (such as want of Officers' hands or dates endorsed on the outside only instead of being writ at the head of the document) seem to arise by the persons being unacquainted with the required forms. The pay due from 21 May 1709 to Dec. 22 following according to the muster rolls is computed at 7,230l. 5s. 6d. From Jan. 19 last no muster rolls are returned. The subsistence advancable according to the regulation is 5,468l. 12s. 8d., whereof 2,000l. is already paid in part and 2,000l. more on account has been ordered by the Treasury Lords. Dec. 20. Privy seal for 3l. a day as ordinary to George Delaval Esq. as Plenipotentiary to treat with the King of Portugal and with the Emperor of Fez, Morocco, Taffilette and Suze: to commence from Dec. 3 inst.: to be payable quarterly and the first quarter to be paid in advance. [?] The Treasury Lords to the Lord Lieutenant of Ireland to report on the enclosed petition of the Earl of Ranelagh shewing that he is entitled as one of the Privy Council in Ireland to a yearly allowance of three tuns of French wines and one butt of sack for the provision and store of his house by virtue of an Act of Parliament of 14 and 15 Car. II. [Act 28 Eliz., c. 4, as confirmed by 14/15 Car. II., Sess. 4, c. 9, section 16] and that he being detained in England on public service from 1692 to 1708 neglected to demand the said Duty: therefore praying that the said Duty may be paid him for the said period to 1708 "from which time he hath received the same."
