You are to treat with Mr. Styles, the Russia merchant, mentioned
in your letter of the 16th inst., to obtain what tar you can that way
and you are to order Mr. Gould and Mr. Hall to try to have some
from New England and you are also to endeavour to procure some
from thence at a certain price by contract, which you conceive to be
a much better way.
In response to your opinion that the bulk of this commodity is
to be expected from Sweden the Lord Treasurer will press for the
assistance of the King's Envoy in Sweden to Mr. Gould and Mr.
Hall for a quantity to be delivered at Stockholm. The order of
Council for permitting the import of pitch and tar in the Queen's
ships was sent from the Treasury to the Customs Commissioners

Appending : (a) Statement of opinion by Sir Edward Northey,
Attorney General, dated Feb. 5 on a case as follows : viz : touching fish
imported from Ireland and the debenture allowances (on exportation
thereof) in respect of the Duties on Salt ; the said allowances,
detailed, being so great by the Salt Duty Acts that it has been found
by experience that many frauds have been committed by exporting
fish that were cured with salt that had not paid the Duties and by
re-landing and re-importing fish which had obtained the said allowances :
for prevention whereof provision was made as in the Act of
1 Anne c. 21. The said case hereunder is as follows : "A. B.
merchant at L. has imported there from Ireland 157 barrels of white
herrings which as he alleges were cured in that kingdom : the officer
of the port at L. seized the said herrings, no oath being made as
required by the abovesaid Act of 1 Anne : (1) are the said herrings
forfeited and double value thereof ? (2) If the taking and curing
in Ireland be deemed not to be English taking under the statutes
giving allowances upon exportation by virtue of the Act of Frauds
of 14 Car. II c. 11, are the herrings thereby forfeited ?
Hereupon the Attorney General is of opinion (1) that fish taken
and cured by the Irish in Ireland and imported into England are
not within the Act of Anne and therefore are not forfeited for want
of the master's oath as therein. By 15 Car. II, c. 7, [clause 7] English
taken fish is such as is imported in English built ships or ships belonging
to England, Wales and Berwick with three fourths English mariners :
(2) the importing this fish is not prohibited by 18 Car. II, c. 2, "for
that the Irish are not foreigners and aliens to this kingdom but
Denizens though they are not Englishmen." The Act of 14 Car. II,
c. 11, is not material as it concerns not fishing but only shipping.

Royal warrant to the Earl of Ranelagh to compute the pay from
1701-2 March 23 to 1702 June 1 of the three Troops of Col. William
Cadogan's Regiment of Horse that came from Ireland and landed
in England the 23rd March 1701-2 according to the muster taken
of them on their landing in Holland : they having been mustered
complete from March 23 to April 24 according to the Holland Establishment
but from April 24, being in their passage through England
to Holland, there was no muster taken of them till June 1 following
when they were mustered complete in Holland. Queen's Warrant
