Report by William Blathwaite as Auditor of the Plantations [to
William Lowndes] in reply to the said Lowndes's letter of "the
25th inst." [May] supra p. 282. I have considered the report of
Mr. Travers, the Surveyor General of Crown Lands, on the grant
desired by my Lord Cornbury of mines and minerals within the
counties of Ulster and Albany in New York. It is usual in the
Plantations before the dividing of Provinces into counties or shires
to purchase the interest of the Indians on behalf of the Crown,
which is done at a very small rate. I am well assured that no
Indians do any ways pretend to an interest in the lands of these
two counties. But for a further caution I have nothing to object
against a clause to be inserted in the grant obliging the patentee to
satisfy the Indians or other just claims and to work the same
effectually within 3 years after the date of the grant ; "and whether
mines royal to be discovered within the intended bounds shall be
excepted is humbly submitted to my Lord Treasurer ;" such a clause
seeming to discourage as I conceive the discovery of silver mines
in the Plantations, which cannot be well wrought there otherwise
than by a private undertaking. Nor do I remember any exception
of silver mines in the grant made to the Duke of Albemarle and others
of mines and minerals in the Plantations. For other particulars I
do likewise refer to my former report hereunto annext [missing see
supra Tr. Cal. Vol. VIII pp. 1071-2, 1231-2], to which I have to add
that upon discoursing at large herein with Sir Edmund Andros,
who has been many years Governor of this Province, he particularly
informs me that these mountains are waste lands on which no other
improvement is like to be made and that he does not conceive any
prejudice can arise to the Queen or her subjects of New York by
such a grant as is desired. But if my Lord Treasurer shall desire from
me according to your letter a more particular description of the
premises I will direct my Deputy in New York that as full and
perfect description and survey be taken of those counties and the
mountains therein as may be satisfactory to his Lordship, a return
whereof cannot well be expected during the war in less than 10 or
12 months by reason of the time necessary for this work and the
uncertainty of convoys going to and from New York. Out Letters

a small coppice called Tentengellan [? Fentongollan] Wood within
the manor of Tewington in Cornwall and to allow Joseph Sawle to

Prefixing : said Surveyor General's report on Sawle's petition for
same. On enquiry the gentlemen of the country find that 20l. is
the worth of the same to be converted to coal which is the best
advantage her Majesty can make thereof and that the same doth
yearly lessen in value. I don't find that this coppice has been felled
since 1660. It was formerly accounted 12 acres but in the Civil
wars the greatest part was by the licentious and greedy neighbours
shrubbed and pillaged and it now contains about 5 acres of wood
only.
The petitioner holds the weeding and pasturage thereof under a

Treasurer Godolphin to the Revenue Commissioners in Ireland. I
have received yours of May 28 relating to the Order in Council that
the masters of ships and vessels trading from Ireland to Holland,
Norway and other parts of Europe between the same should give
bond to go to no other parts. You desire to know whether this order
comprehends foreigners in amity with the Queen and her Majesty's
subjects of Scotland who in many respects are esteemed as foreigners.
"I do not think the said order was intended to extend further than
to her Majesty's subjects ; but in case you think it necessary that
the same should extend further in order to obtain the end designed
by her Majesty and Council I desire you to make a representation
thereof to me that I may lay the same before the Queen in Council."
