Nov. 1. Henry Guy to Hugh Boxenham, Mayor of Norwich. The Treasury Lords have considered your letter of the 19th ult. and also the representations from the Excise Farmers and from the Company of Brewers at Norwich. My Lords desire you to restore the licences to the victuallers in your city that have been lately suppressed. If you think it necessary to make further objections before doing so, come to London and speak with my Lords in this matter. Out Letters (General) VI, p. 319.
Nov. 2. Money order for 6,428l. 12s. 6d. to Richd. Kent and Charles Duncomb for last Michaelmas quarter for 6 per cent. interest and for several allowances of reward [on moneys by them advanced for his Majesty's service], as by an account thereof stated by Auditor Anthony Stephens and allowed by the Treasury Lords, Oct. 28 (24). Royal warrant to the Attorney or Solicitor General for a great seal to revoke the patent of July— last which constituted Charles, Lord Cheyne, Visct. of Newhaven, Sir Richard Temple, Sir George Downing, Jno. Upton and Nicho. Butler, Dr. of Physic, to be Commissioners of Customs, and in lieu thereof to constitute and appoint Lord Cheyne, Andrew Newport, Sir Richard Temple, Sir George Downing and Nicho. Butler to be such Commissioners with 1,200l. per an. salary each: and Richd. Prowse to be their solicitor with the like salary as in the former Commission. Nov. 3. Henry Guy to Sir James Shaen. Send me forthwith the five books of the Earl of Ranelagh's account "which you received from hence." (Same to the Auditors of Imprests forwarding the said five books of accounts of said Earl's receipts and disbursements for the years 1677–80. Peruse and report on same.) Nov 3. Treasury warrant to the Customs Commissioners to remit 3l. 18s. 2d. to Malres Comacke, mariner, a native of Fiall, being aliens' duty on 2,000lb. weight of tobacco; he having been long in the service of English merchants, particularly of one Hayman, a merchant of Bideford, where he has been an inhabitant and mariner in said Hayman's ship above 20 years, and has married a wife there and has several children there. Treasury reference to Mr. Graham or Mr. Burton of the petition of Sir John Re[r]seby (as by a favourable reference thereof from the King dated Whitehall, Oct. 27 last): petitioner shewing that his sister-in-law, Mris. Honora Browne, an unmarried woman with a portion of 800l. in her own disposal, came to town about three years since and fell into an acquaintance with several Irish Papists, who upon a pretence that they recommended an acquaintance of theirs to marry her borrowed several sums of money of her, and she, finding herself deceived and that their only design was to get her fortune, fell into a deep melancholy and lingering disease and died in July, 1680, leaving the greater part of her estate to petitioner and his children, although the said party endeavoured to keep her from the sight of her relatives during her sickness; but after her death another will was produced pretending to be of a later date appointing an executor, whom she had never seen, in trust for Mr. Hamilton, a convicted Papist, who by his conviction has forfeited his personal estate to the King; therefore petitioner prays a grant of the small remainder of her fortune so forfeited. The officers of Cardiff have returned no bonds [? for or since] Christmas, 1680. Those of New castle did not return them for 1680, Michaelmas quarter, till 1681, Aug. 20, "and though the same were returned with a duplicate thereof upon their oathes that all the forfeited bonds of the said quarter were then returned, yet they kept back several of them and returned them in the subsequent quarter as appears by their own duplicates delivered upon their oathes as aforesaid, and also have not yet returned their forfeited bonds for Christmas quarter, 1680, to Lady day following."
Nov. 7. Treasury reference to the Customs Commissioners of the petition of _ Weekes (as by a reference thereof from the King dated Whitehall, Oct. 27 last); petitioner shewing that in Oct. 1679, he with others freighted two vessels at Morlaix with French goods with design to transport them to Ireland; said vessel sailed Oct. 30, but by bad weather was forced into Hammoores [Hamoaze], an open road near Plymouth, where the Customs Commissioners seemed at first satisfied but afterwards took out of the vessel linen to the value of 4,000l. and employed Robert Slaughter to exhibit an information in the Exchequer against petitioner for importing French goods and a verdict was obtained against petitioner through the Attorney's ill managing; therefore prays pardon and restoration of the goods on security to transport them to Ireland. Nov. 7. Same to same of Hugh Manwaring's petition for a place as coastwaiter or landcarriageman, London port, in consideration of 50l. per an. granted him by the King for his sufferings as a slave at Fez and Morocco. Ibid.
Same to the Mint Commissioners of the petition of Roger Hawkshead, formerly of the Speedwell, for a commission to seize several sums or parcels of guineas imported, being of greater alloy and less weight than the King's guineas are. Ibid.
Nov. 8. Same to Mr. Graham of the petition of Dorothy Fane as by a reference thereof from the King in Council dated Hampton Court, 1681, June 30; petitioner praying for a moiety of a discovery she made some time past of 700l. lent by father Harcourt (lately executed for treason) to her father in law, Edward Wray, esq., upon a mortgage of lands, the deeds whereof are in the hands of Mr. Graham, petitioner understanding that Mr. Jno. Savage pretends to be the first discoverer of that mortgage. Ibid, p. 407.

Same dormant for 100l. per an. to John Potenger, Comptroller of the Pipe, to be payable half yearly, the first payment to be "this Michaelmas term": being reward for the service of him and his clerks in issuing out in process the several penalties of 20l. per month upon Popish Recusants, for which service they have hitherto received no reward, although they have been always careful to give the most speedy despatch and assistance to the respective receivers for the improvement of that revenue, and although considerable sums have been levied by the sheriffs on such process. The said payment to continue so long as said work shall continue: and to be paid out of the receipt of such Recusants' forfeitures. Same for 9,668l. 9s. 2d. to Anthony Row and partners Farmers of the Hearthmoney: it appearing from two interest accounts stated by Auditor Anthony Stephens and passed by the Treasury Lords the 24th Oct. last that there is due to said Row and partners 9,744l. 11s. 0d. for 6 per cent. interest and 4 per cent. reward for divers sums advanced by them for his Majesty's service, but 76l. 1s. 10d. being to be defalked therefrom for the like interest and reward on 6,665l. 14s. 2d. to them allowed as paid to Mr. Toll, Mar. 15 last, whereas the same was not satisfied till several days after that time, as appears by said Toll's account, supra. The present sum is to be satisfied by tallies as follows on said Row and partners, viz. 1,445l. 18s. 11½d. (besides 72d. defalked as above) on the Hearthmoney farm rent payable Sept. 19 last, 5,606l. 15s. 1½d. on same payable 1681–2, Mar. 15, and 2,615l. 15s. 1d. on same payable 1682, Sept. 19. Further in regard that in the said two accounts hereof there is allowed 1,081l. 6s. 5d. for interest and reward of 8,000l. lent 1680, Nov. 16 and Dec. 8, by William Bridges, one of the said Farmers, memorandums are to be made in the office of the Auditor of the Receipt to prevent the King being doubly charged thereupon. The Treasury Lords to the Earl of Chesterfield. The Admiralty Lords have represented the want of timber for several uses of the Navy whereon the King has directed a sign manual to us for felling in New Forest this winter 1,000 oaks (part of 5,250 lately marked there as serviceable for the Navy) and 33 beeches; and also 327 oaks in the Lea baylywick of Dean Forest, and as many of 128 beeches lately marked there as will make 50 load of 4-inch plank. (Two Treasury warrants dated Nov. 8 to Tho. Agar and Charles Strode, Surveyors of Woods, Trent South, for the felling of said timber and for delivering same by indenture to the Surveyors of the Navy. Nov. 12. Treasury reference to the Attorney General of the report from Sir James Shaen on a former and a later petition of Walter Galeway (Gallwey) and on the report thereon from the Lord Lieutenant and Privy Council of Ireland. In said report the Lord Lieutenant and Council advise royal bounty for petitioner's relief, he having lost his ship and goods and suffered in his credit abroad. In his second petition Galleway prays that such relief may take the form of a grant of lands to the value of 330l. per an. over and above the quit rents payable thereout, with liberty to place deficiences thereon. The said Shaen in his report presumes to offer no opinion on all the said papers, considering them more fit for the consideration of some of the King's Counsel. Reference Book I, pp. 408–9.

II, c. 13] was to continue for six years and thence to the end of the next session of Parliament. The six years expired 1677, June 26. At the Parliament's session begun 1676–7, Feb. 15, said Act was continued for three years from the end of the session and thence to the end of the first session of the next Parliament. The three years expired in May, 1680. The first succeeding session of Parliament thereafter was from 1680, Oct. to 1680–1, Jan. 10. Query: whether the said continuing Act of 29 Car. II. be expired or in force?
(b) Sir Robert Sawyer's opinion hereon, not dated. In case the session of 29 Car. II. ended in May, 1677 (which doth not appear in the printed statutes of that year but is fit to be ascertained by the Lords' Journals) I am of opinion that the said Act is expired.

Nov. 15. The Treasury Lords to the Duke of Ormonde, Lord Lieutenant of Ireland. We are informed by the Earl of Arran that you are under some difficulty concerning the payment of the army, which in our letter of Sept. I we desired might be effected by way of imprest until you received the King's further directions. We sent for Sir James Shaen, who has assured us that by the posts of both Tuesday and Saturday last he has written to his partners to pay in so much money by way of imprest as will pay the army for three months. In answer to your letter of Sept. 27 we are informed that there are several precedents for recalling, altering and dividing warrants and [for] paying the army by imprests which [said precedents] may be found in the three months' pay to the army due after Christmas, 1670, when the contract of the Earl of Ranelagh and his partners did commence; as also at the commencement of the present farm; and in the warrants for pay of the Forces intended for Scotland in 1678; and afterwards in those sent and intended to be sent to Tangier from Ireland.
As to taking off the restrictions laid on the present Farmers by order of Council in Ireland, we beg to put you in mind of the King's letter dated 1680, April 26 last (ut supra, Calendar Treasury Books VI, p. 507) which orders the superseding the same.
