2469l. 12s. 10d. value at 6s. 10d. per ounce for white plate and
10s. an ounce for gilt plate: the present Earl first releasing and

Col. Fr. Nicholson, Lieutenant and Governor General of Virginia,
to the Treasury Lords. I wrote to you June 10 last by Capt. John
Aldred, Commander of Her Majesty's ship Essex prize, who convoyed
our Fleet which I hope in God is safe arrived in England long before
this. With my letter I sent copies of accounts. By one of my
instructions, (a) below, I am ordered to report to you concerning
the place of Receiver and Accomptant being in the [hands of the]
same person with that of Auditor. I find that William Byrd had
a commission from James II to be Auditor of Virginia &c. I
enclose copies from the Council Book of his commission &c. In
the Council Office there is a duplicate of the grant to William
Blathwayt of the office of Surveyor and Auditor General of all the
revenues arising in America but with an exception to an Auditor
General of Virginia (which I think was given to one Mr. Aldworth).
I enclose a copy thereof, annexed to which is a copy of a letter of
Charles II to Lord Colepeper as also another of the Treasury Lords
to his lordship concerning said grant. |

I think it is for his Majesty's interest that the Receiver be a
distinct person from the Auditor so that one may receive and pay
all his Majesty's revenues and the other audit his accounts in general
and others in particular; and that each of them have a room in the
public building where all their accounts and papers may be lodged
and that they be obliged to live where the public seal of Government
is and that they attend certain times of the year at their offices:
for at present Mr. Auditor Byrd keeps all the original accounts and
papers at his own house where I think they are in more danger than
they will be in the public building where all the chief records of the
country are (God willing) to be kept. The last account to hand of
him was that he was ill of a fever. In case of his death it would be
a disservice for his papers to fall into private hands especially "when
he hath, as now, in his hands a considerable sum of his Majesty's
revenues. The inhabitants though they may be well to pass yet
have little money in specie by them (at present it being not of
much use here): what estates they have of that kind are in the hands
of their merchants and factors in England but most in London.
So that if the said merchants or the heirs of the inhabitants etc.
should secure their English estates (which 'tis probable they will
endeavour to do) then perhaps their Virginia estates which consist
of negroes and some white servants, stocks of cattle and household
goods (and often appraised not for much above the half) will not
answer the bond [given by Byrd] to his Majesty, he having given
bond only in Virginia. And if they do it, it may be a twelvemonth
before they can be compelled by law to do it and in that time his
Majesty's affairs may very much suffer for want of his revenue in
other people's possession. His Majesty's revenue of 2s. per hogshead and of the quit rents is received by Auditor Byrd and they are
commonly paid him in bills of exchange: and he pays the annual
salaries, contingent charges &c. by his own bills of exchange. He
hath 7½ per cent. for his salary but first the Captains and Commanders
of ships and vessels have 10 per cent. of what they pay of the 2s.
per hogshead and then the Receiver of the Virginia Duties hath
10 per cent. more. So that there is 27½ per cent. taken out of his
Majesty's revenue of the 2s. per hogshead. |

According to my duty I have endeavoured what in me lies to
improve his Majesty's revenues and Auditor Byrd hath had several
orders from myself as also from his Majesty's Honourable Council
[of Virginia] and myself as likewise Bartholomew Fowler Esq. his
Majesty's Attorney General, for to draw up a scheme concerning
his Majesty's revenues of all kinds, to be communicated to the
Committee for revising the Laws in order to be laid before our
Assembly, which (God willing) is to sit the 23rd of Oct. next. |

For the better improvement of his Majesty's revenue of quit rents
I proposed to Auditor Byrd to have an exact rent roll taken of all
the rents held of his Majesty here. I found that for several years
past there had been a great cheat practised by peoples taking up
land for the importation of negroes; but in our General Court I
made an order against it for the future; of which I enclose a copy.
For it was contrary to King Charles II's charter to this colony and
dominion and I enclose a copy of my Instructions which was
petitioned and recorded in our General Court by order of the Council
and myself. And another cheat was by the clerk selling "rights"
as they called 'em i.e. 50 acres for every person [servant] imported
according to the said charter: the importer being obliged to enter
and swear at the General County Courts, to the names and numbers
of the persons by them so imported. But the clerks for half a crown
a "Right" would give them certificates for what number they
wanted. But I made orders of Council concerning this affair as
by copy herewith [missing] as also concerning Auditor Byrd's
giving necessary directions about waifs, strays &c. |

I intend by this ship to send to the Customs Commissioners lists
of ships &c. with a particular account concerning the ship Mary Ann
of London Capt. George Hands Commander. The latter end of
June it began to rain and so continued less or more for nigh a month
which hath done a great deal of damage to the tobacco so that there
is like to be no very great crops. I have an account that there is
very few hogsheads of old tobacco left in the country which I am
very glad of because it is for his Majesty's interest "as it will be
also that there come ships and vessels enough to carry away this
year's crop of tobacco." |

Prefixing: (a) copy of the Lords Justices' Instructions to said
Nicholson " Forasmuch as it seems incongruous that the place of
Receiver or Accomptant should be (as it hath been of late years) in
the same person with that of Auditor, which is in the nature of and
ought to be a check or controal thereunto" you are to report
thereon: and in the meanwhile to take care that his Majesty's quit
rents be not only duly gathered but (in order to the improvement
thereof) that they be sold every year openly by inch of candle to
the highest bidder in the respective County Courts; and that due
notice be given of the time and place of any such intended sale in
such manner as may make it most publicly known to all people a
competent time before hand. |

(b) Copy of one of the Instructions given to said Nicholson, Lieut.
and Governor General of Virginia, dated 13 Sept. 1698. His Majesty's
will and pleasure is that all servants that shall come to be transported
to his Colony of Virginia shall serve their respective masters for the
term prescribed by the laws of that Colony: and the said servants
shall at the end of the said term have 50 acres of land set out and
assigned to every of them respectively, to have and to hold to
them and every of them, their heirs and assigns for ever under the
