a week. Please take the King's pleasure herein and acquaint him that
there is great importunity for this and other pensions and that at
his Majesty's last departure from England he was pleased to take
a list of pensions with intention to mark such of them as should be
paid and then to return same for my Lord's guidance. My Lords
apprehend that his Majesty's weighty affairs have occasioned his

report because it would give them just reason of resentment, for that
Mr. Vanburge has instructed himself for that employment and has
depended so long upon it. They therefore persuade themselves that

to be made of copper pursuant to indenture between the King and
Sir Joseph Herne et al; and in place thereof to grant the said office
to Phillip Shales: during pleasure: with the fee or salary of 200l.

Same dated same to the Clerk of the Signet for a privy seal for taking
off surcharges in the Plantation Duty account as follows. By the Act
of 25 Car. II [c 7] there were imposed the Plantation Duties and regulations as to Plantation bonds for commodities as therein. Pursuant
thereto Commissioners were appointed to manage the collection
of the said Duty in the Leeward Islands, whose books of their receipt
coming to be examined by the Comptroller of the Customs, England,
he has surcharged them as follows, viz. 136l. 5s. 9d. upon the Antigua
Book A from 1689, Dec. 24, to 1690, June 24; 234l. 6s. 6d. upon the
Antigua Book B from 1690, June 24, to 1690–1, Jan. 1; 95l. 9s. 6d.
upon the Antigua Book C from 1690–1, Jan. 1, to 1691, July 1;
406l. 3s. 2d. upon the St. Christopher Book No. G from 1688, Dec. 24,
to 1689, June 24; 286l. 12s. 8d. upon the Montserrat Book B from
1690, June 24, to 1690–1, Jan. 1; 50l. 12s. 11d. upon the Nevis Book
B for same period; all which surcharges amount to 1,209l. 10s. 6d.
and arose by the said Commissioners not taking the Duties upon goods
shipped from the other Leeward Islands to Nevis and partly for goods
shipped from one Leeward Island to another and partly for goods
shipped from the Leeward Islands to Barbados. But the executors
of the said Commissioners (who are all dead) have produced in explanation an order of Sir Christopher Codrington of 1689–90, Feb. 27, ut
supra, p. 217, reciting that "at the request of the Assemblies and
Councils of the respective islands and also at the request of the other
inhabitants, there being no ships to carry their commodities directly
for England whereby to furnish themselves with necessaries and
provisions for their families and plantations and especially with arms
and ammunition for the defence of our said Islands and without which
supplies he was sensible that our said Colonies must run a great risque
of being utterly ruined, he having then certain information that
the French intended a sudden assault upon some of those said islands"
and under the conditions, detailed in full, of the said order the said
executors pray discharge of the said surcharges, producing certificates
that the Leeward Islands have always been esteemed one Plantation
and sloops and boats carrying from one island to another have always
been esteemed as no other than coasters and that the said Commissioners do usually reside at Nevis and all the collectors are responsible
to them. It is therefore hereby directed that accounts of the said
Commissioners be passed and allowance therein made for the surcharges

Treasury reference to the Excise Commissioners of the petition
of Francis Johnson, collector of Excise, shewing that he delivered to
William Somes some 776l. of his collection of his Majesty's money,
to carry same to Hoggesdon [Hoddesdon] in county Herts but Soams was
robbed in the highway in Stevenage in the Hundred of Broadwater
and petitioner prosecuted an action of Hue and Cry against the said
Hundred and obtained a verdict against it at the Lent Assizes before
Chief Justice Treby, it appearing that he was robbed near the Hundred of
Cashio though plainly within the said Hundred of Broadwater; but
the inhabitants of Broadwater in Easter term moved the Common
Pleas to set aside the verdict on pretence that the robbery was committed
in divisis hundredorum, viz. between the said 2 hundreds, and the
Lord Chief Justice, to petitioner's great surprizall [ordered] that the
defendant Hundreds should pay 520l. part of said 776l. whereby
petitioner is become indebted to the King for the remaining 256l.,
besides 169l. expended in the suit: therefore praying to be allowed
the said 2 sums and 15l. for his horse which was killed. Reference

Treasury warrant to the Customs Commissioners to grant a supplemental debenture for [half subsidy of] 3,000 poundweight of tobacco
part of 34,800 poundweight exported by John Taylor of London,
merchant: he having imported in April and June, 1694, several
parcels of Virginia tobacco containing 34,800 lbs. and paid the subsidy
inwards and entered same outwards for Rotterdam, 1694, Jan. 26,
but on taking out his certificate (which is the foundation of the
debenture) in order to pass his cocquet outwards the clerk omitted
3,000 in the certificate when in truth the whole was actually shipped:
the Customs Commissioners having found from the books of the
Collector Inwards that the said omitted 3,000 stands clear and not

Treasury reference to the Excise Commissioners of the petition
of the salt refiners of the city of Bristol shewing that at the time of
the making the first Act of Parliament that laid a Duty on salt
[they] have ever since traded in rock salt and refined the same
in fountain water and not in salt water so that no increase of
salt was made thereby; and being informed that they were
not chargeable with any Duty for the salt so refined and also
upon several informations exhibited against them by the Excise
officers for recovery of the said Duty, having had judgments given for
them against the King; and they also sold the same salt without
any consideration in the price for the said Duty: but there is a clause
in the Act which passed the last session [7–8 Wm. III, c 31] whereby
all refined salt is charged with 1½d. per gallon and they are now
charged with the said Duty on all the salt they have so refined since
the making of the said first Act, although they are ready to pay the
growing Duty for salt refined since May 17 last: therefore praying
to be discharged the Duty on the salt refined before that date in regard
they are not capable to make out what salt has been [so] refined and
in regard of their not taking a price for their salt according to the

buy cattle in the Isle of Man and that coming to Whitehaven they
met with And. Huddleston collector of Customs there, who told them
that the commodities of the said island might be imported customs free;
that they entered into an open boat called the Patrick of Peel Town
intending to go to the said island and the said Huddleston seized his
money to the value of 248l. 10s. 0d. under colour that he exported

The Treasury Lords to the Lords Justices, Ireland. The Earl of
Scarborough has represented to us that such use has been made of the
King's letter of April last, supra, pp. 112–3, to you in favour of Miss
Charlotte Sarsfeild as to endeavour the taking off the King's hands
from the forfeited estate of Patrick Sarsfeild before the said Earl's
debt [charged] thereupon be satisfied as directed by the King's warrant
of 1694, March 28, supra, Treasury Calendar, Vol. IX, p. 554. We
cannot but apprehend it was the King's intention that the said Earl
should be first satisfied out of the said estate, and we supposed that
debt had been accordingly discharged. But finding it otherwise
we desire that a stop may be put to the doing anything further on
Mr. [sic? Mris.] Sarsfeild's letter till that debt be paid off. If you
think it necessary to have the King's pleasure further signified herein
we will take care to send into Flanders to obtain the same. Out

Commissioners of Prizes "in all which cases the officers of the Customs
seem to insist on a Duty [on goods] which ought to go free": therefore

Warrant by the Lords Justices, England, to the Clerk of the Signet
for a privy seal for taking in a further 300,000l. in loans on the Salt
Act [7–8 Wm. III, c 31] at 7 per cent. interest, in continuation of the
privy seal of April 30 last: the lenders to be at liberty up to Sept.
14 next to make such loans in clipt or diminished moneys or pieces
of silver (of those which were lately current) by weight at the tale of
5s. 2d. per ounce. Further hereby 30,000l. is to be paid to Tho.
Hall, Esq., upon account to pay such persons who shall so make their
loans in clipped etc. moneys a reward of 6d. per ounce over and above
the principal and interest as above: such reward to be paid to them
at the time of making such loan: and also that the said Tho. Hall
shall out of the money so to be imprested to him defray the whole
charge of the recoining the clipt moneys [so to be lent] and replacing
into the Exchequer 5s. 2d. in new money for every ounce Troy so lent
as aforesaid. An exact account is hereby to be kept in the Exchequer
of the deficiencies of the said clipt money, that is to say the difference
between the tales thereof and the produce of the same at the said
rate of 5s. 8d. per ounce. Such clipped money so lent is hereby to
be melted and new coined into lawful moneys of the realm and to
be placed in the Exchequer to the account of loans on the above
Act and not to be diverted to any other use, intent or purpose whatsoever. (Treasury warrant dated Aug. 17 hereon to the Receipt
accordingly. This warrant quotes the privy seal as dated Aug. 17.
