Aug. 17. Treasury warrant to the Customs Commissioners to direct the payment of the 1696, June 24 quarter's salary bill of the outports: total, 5,624l. 1s. 3d. for established salaries and 557l. 15s. 0d. for additional salaries or 6,181l. 16s. 3d. in all. Money Book XIII, p. 183.
William Lowndes to the Customs Commissioners. I have read to my Lords your report of the 5th inst. on the information concerning fraudulent practices in the export of coals from Newcastle, for preventing which you propose for the future that the officers concerned therein be at least exchanged and removed to some other port. Treasury warrant, dormant, to the Deputy Auditor and to the Receiver of the Duchy of Cornwall for payment of the fee or salary of 6l. 13s. 4d. per an. to Henry Remfry as steward of several hundreds in county Cornwall and parcel of the Duchy of Cornwall: notwithstanding the omission of said fee in the patent of grant lately made to him of said office. Same to the Customs Commissioners. In your presentment of July 18 last you laid before my Lords a memorial of Robert Williamson for preventing fraudulent practices in drawing back money by debentures. Having heard you and Williamson and the patent officers of London port thereon my Lords direct you to reconsider the said proposal and to report the best method of obviating frauds in the obtaining or paying of debentures. Ibid.
Aug. 18. William Lowndes to Mr. Blathwaite. The office of Comptroller of the Accounts of the Customs is void by the death of Mr. Gyles Lytcott. The business of that office and the salary annexed to it are very considerable as appears by the enclosed report [missing] of the Customs Commissioners. My Lords think it absolutely necessary for his Majesty's service at this time (as well with regard to the greatness of the public expense as the inconveniences which the revenue must suffer by the present scarcity of money) to reduce his Majesty's charge in every office where it may be done and are inclined to believe that this place may be supplied by one who hath been bred up in that office for less than half the [old] salary, whereby they hope to save 600l. a year or more and the service performed as well or better than ever it has been. My Lords desire you to make it their humble request to his Majesty not to dispose this place at present until they can recommend a person. Ibid., p. 149.
Treasury warrant to the Customs Commissioners for Henry Wolstenholm to continue to receive the Subsidy and Impositions on Plantation goods and for Sir John Shaw to take the charge of computing the same and to keep a due charge as well of the money as bonds upon the said Receiver: and for the other patent officers to keep a comptroll thereof as if received by Sir John Shaw: all on consideration of the proposals as in the said Commissioners' presentment of July 17 last concerning the receipt of the impositions on Plantation goods and Sir John Shaw's paper wherein he proposed to compute the imposts arising thereupon (so as that he is not charged with the receipt of the money) and to keep a due charge of both money and bonds. The said Commissioners are hereby to represent what is reasonable to be allowed to them [Wolstenholm and Shaw] for trouble and pains in this matter. Out Letters (Customs) XIII, p. 281.
Same to same to direct the Customs officers, London port, to observe the instructions as follows with reference to the account of the Impost Duty on tobacco: as proposed by the said Commissioners.
Appending: the said "particular instruction"
(1) that from 1696, May 1, the patent comptrolls in London port take notice of the Impost Duty on tobacco distinguishing by several columns in their books the bonds from money paid, in order to cheque the receipt of the Collector Inwards for both, who is to be charged for the future with the accounts of this Duty "being by this Act made payable only by the importer and subject to the rates and methods of the Customs in the whole management thereof both as to the entry and the account."
(2) that at the end of every week the balance as well in bonds as cash be transmitted from the particular Receivers to the Receiver General [of Customs] that so the Comptroller General may charge him distinctly with both and that all debentures be paid by one hand.
(3) and for a more regular adjusting the weekly certificates and computing the exact sum chargeable with the particular Receivers, arising from the several Duties on the daily warrants (on the due examination whereof the whole trust of the comptroll at the Custom House terminates) it is recommended to the patent officers of the bench that they all meet every Saturday in the afternoon themselves or by their immediate sworn deputies to compare, examine and make up their weekly accounts, that the certificates thereof being regularly signed by all the proper comptrolls be a just voucher to the Comptroller General of the Accounts of the Customs to charge the respective Receivers with the sums particularly mentioned therein. Aug. 18. Treasury warrant to the Customs Commissioners to insert on the establishment 20l. per an. for Thomas Moore, Surveyor of Yarmouth port, for the care of the warehouse there: by reason that said service was formerly paid by an allowance of 20l. per an. by incidents but the said Moore has behaved himself well therein and has otherwise well deserved of the revenue wherefore said Commissioners desire that said allowance may be established. Entry of the Treasury Lords' signature of the docquet of a lease to John Gartrell at the nomination of John Congdon of a tenement in Tregrove alias Tregoffe, county Cornwall [sic for tenement called Tregoffe in the manor of Climsland Prior], ut supra, Treasury Calendar IX, pp. 1231–2, for 99 years terminable on the lives of John Gartrell, Mary his wife and Richard his brother: at 8s. 2d. per an. rent. Same of same of an in custodiam lease under the Exchequer seal to Nicho Guest of several lands and tenements in County Stafford being part of the estate of Joseph Simcox outlaw: at a rent of 2s. 8d. per an. and fine of 5s. 4d. Ibid.
Treasury warrant to Phillip Ryley, Surveyor General of Woods Trent South, to fell 15 oaken timber trees (unfit for the service of the Navy) in the King's woods in the manors of Cookham and Bray in Windsor Forest or in the seven Hundreds of Cookham and Bray in county Berks and to deliver same to the Mayor, Bridgemasters and burgesses of Maidenhead for the better support and repair of the bridge there and is in satisfaction for the last 15 years past on the allowance granted in James 1st's letters patent of incorporation of 1604, Aug. 4, for such repair, viz. of three oaken timber trees every third year out of such woods as above: it appearing that said bridge is very ruinous and in decay and in great danger of falling and the said Corporation being very poor and not able to repair and new build the same without the help of the said trees which they have not had for 15 years past. The Treasury Lords to the Lords Justices, Ireland, to report on the enclosed petition [missing] of Lambert Blackwell praying the benefit of the late Queen's letter for granting reprizalls to his father John Blackwell, Esq. for forfeited lands in Ireland taken away from him in August, 1660. Aug. 18. Warrant by the Lords Justices, England, to same for a pension of 2s. a day to Jaspar de Lanalve on the Military List of pensions on the establishment of Ireland in consideration of his being disabled in his Majesty's service: to commence from June 1 last. Ibid., p. 132.

Aug. 18.] The Treasury Lords to same to direct payment of the arrears of the Earl of Inchiquin's entertainment of 20s. a day as Governor of Kinsale: said Earl having petitioned that for the future his said entertainment may be applied to the discharge of his quit and crown rents: which petition the King (on the late Lord Deputy's report) has not thought fit to grant but has directed the payment of the said arrears. Aug. 18. Entry of a Treasury caveat on behalf of the Lady Dorothy Bourk that no grant pass of any part of the estate late belonging to Col. Patrick Sarsfeild in Ireland until she be heard. Notice to be given to Mr. Carew, one of the Tellers of the Exchequer. Caveat Book p. 44.
Aug. 19. Money warrant for 250l. to Peregrine Bertie, Charles Bertie and Charles Osborne for 1696, June 24 quarter, on the annuity of 1,000l. granted by Charles II, 1678–9, Mar. 20, to them in trust for Bridget, Countess Dowager of Plymouth: same having been satisfied by tallies on the revenue of the Alienation Office until Lady day last but by reason of the Receiver of Alienations having lately paid into the Exchequer the produce of the said revenue which remained in his hands in clipt money the said annuity cannot be satisfied for the said quarter. Same is hereby to be satisfied out of the new money proceeding from the said clipt money. Money Book XIII, p. 187.
William Lowndes to the Auditor of the Receipt to issue 500l. to Thomas Neale, Master and Worker of the Mint, on the unsatisfied order on his name for the service of the Mint: to be applied towards defraying the charge of the several Mints erected or to be erected in the country. Disposition Book XIII, p. 168.
Same to the Customs Commissioners to report on the enclosed memorial from the Resident of Denmark concerning the Duties demanded by the Customs officers for salt imported in the ship Old Crowned Hope together with the tonnage [Duties] for said ship: same being referred by the Privy Council to the Treasury Lords. Treasury reference to same of the petition of Don Diego James Cupelac secretary to the Spanish Ambassador shewing that "they" had consigned to him 49½ tons of Spanish, Navarre and Chicolins wines in the Noster Seniora de la Sumpsion, Capt. Bapt Orella commander, and received certificates with them that same were of the production of the said Spanish Navarre: therefore desiring that same may be delivered on payment of customs. Aug. 20. Treasury order to the Tellers (in the form of a money order) for the delivery and payment to the Receiver General of the General Letter Office of 9,000l. proceeding from the clipt moneys of his office which are applicable to the payment of tallies of pro or assignment or other tallies in course. Aug. 21. William Lowndes to the [Principal] Officers of the Mint. My Lords have signified to the several gentlemen (who are nominated by them to receive the new money proceeding from the silver sent or to be sent down to the several Mints in the country to exchange for clipt moneys which shall be brought in at the rate of 5s. 2d. per ounce and 6d. an ounce by way of recompence) that the officers of the said Mints are to keep accounts of the deficiency thereof. Please give order to the said officers to keep fair entries in their books of the tale of the clipt moneys brought into the respective [said] Mints to be recoined and of the tale of the new money proceeding therefrom, to the end the said deficiency or difference between the same may appear. Same to the [Principal] Commissioners of Prizes enclosing the report [missing] of the Customs Commissioners on the petition of Thomas Ward praying the King's share of 25 chests of prunelloes seized and condemned pursuant to the Act prohibiting trade with France. Please certify my Lords whether the prunelloes were sold at Cadiz and the produce of them applied to the King's service. Ibid.

Royal warrant dated "at our Court at Loo" to the Lords Justices, Ireland, for an account to be forthwith stated of what remains due from Walter Delamare on the custodiam of lands in Ireland as granted to him under the late Queen's letter of 1692, April 1, and to cause same to be allowed him in part payment of debt as follows; and to obtain from the Revenue Commissioners, Ireland, their opinion what allowance will be reasonable to be made to him in consideration of the remainder of said debt, viz. as a fine on a 21 years' lease to be passed to him of the said custodiam lands: and thereupon to pass a patent of such lease (except as to the lands granted to James Roach) from Lady day next subject to the payment of the quit rents and crown rents formerly payable thereout and such further part of the present reserved rent of 443l. 10s. 0d. per an. as will remain after the deduction as above in consideration of the fine or debt [of] 90l. per an. for the said lands granted to the said James Roach and of the yearly allowance of 80l. per an. for his [Delamar's] maintenance: all by reason that the said letter of the late Queen directed such custodiam grant to said Delamare as above and further directed an account to be stated of what pay remained due to him and his Troop for the time he served the King and just satisfaction to be forthwith made him: whereupon lands as follows were granted to him at the full improved rent of 443l. 10s. 0d. per an. for 3 years expiring at Lady day next: and further by the King's sign manual of 1695, Aug. 11, the King released 80l. per an. of the said rent towards the maintenance of the said Delamar: and further the said Delamar having by petition set forth that the account of pay due to himself and his Troop was stated and allowed by the Commissioners of Accounts there to be 719l. which in regard of the lowcondition of the King's revenue there could not be paid him: wherefore he prayed a lease with allowance of deductions as above: which petition the King reflecting upon petitioner's greatservices is pleased to grant on the report of the Attorney General and late Lord Deputy of Ireland.

Aug. 25. Royal warrant under the King's sign manual dated "at our Court at Loo" to the Lords Justices, Ireland, for a grant to Col. Henry Lutterell of the forfeited estate of Col. Simon Lutterell in Ireland (of which a custodiam was directed for the said Henry by the sign manual of 1694, April 24, Treasury Calendar IX, p. 600) to be held by him and his heirs for ever in free and common socage as of the castle of Dublin: with a clause that in case Henry Lutterel do not in his life time by his last will and testament or by legal conveyance dispose of the manors as therein the same shall immediately from his decease descend to the next heir of the said Henry exclusive of Simon Lutterel and all others attainted as therein and that all gifts, or conveyances which the said Henry shall make to the said Simon shall be null and void: all by reason that the said Henry has petitioned praying a grant of the said estate to him and his heirs for ever pursuant to a promise made to him by the Earl of Athlone upon the surrender of Limerick and pursuant to the directions formerly given by the King, to have the same secured to him by proviso in an Act of Parliament to be passed in Ireland relating to forfeitures: which petition has been reported on favourably by the Attorney General, Ireland. Godfrey Richards, late Purveyor of the Train of Artillery in Ireland, upon account of purveyance to the said Train as by an account stated and allowed by the Commissioners of Accounts there, a great part of which is owing to several persons in Ireland: in accordance with the report dated July 4 last from Sir Charles Porter then sole Lord Justice of Ireland on the said Richards' petition wherein the said Porter reports that he has nothing to object to the said payment but "the same" [petitioner's office] not being upon the establishment of Ireland the payment could not be charged upon the money given by the Parliament for satisfying the arrears of the army nor upon the constant revenue of Ireland without the authority of a royal warrant. Royal warrant under the King's sign manual dated "at our Court at Loo" to the Lords Justices, Ireland, for a lease or custodiam of lands as follow to Brigadier William Wolsely for 3 years from date hereof under the yearly rent of 609l. and the quit and crown rents formerly payable out of said lands: it appearing from a letter of the late Lord Deputy, dated Sept. 24 last [1695], that the said Wolsely brought to him the King's letter of 1694–5, Feb. 20, for a grant to him of a custodiam for 3 years of lands as in a schedule thereto to the clear yearly value of 1,000l. above charges and reprizals but when the said Lord Deputy came to examine the state and condition of those lands he found that the King had before disposed of most of them and some of them so encumbered with debts that the Brigadier has passed a custodiam only of 2 of the said estates to the yearly value of 371l.: wherefore the Brigadier presented to him a further schedule of forfeited lands as below to make up the deficiency of the 1,000l. [per an.] intended by the King to be granted to him, which schedule the late Deputy referred to the Commissioners of Forfeitures who reported the value to be 609l. per an. and the Solicitor General, Ireland, has reported that a grant thereof may be made.

Treasury warrant to the Customs Commissioners to allow the compounding for parcels of coal stopped at Hull as follows: it appearing from the said Commissioners' memorial of the 5th inst. that on Treasury intimation as to frauds in the export of coals from Newcastle which happened to be discovered upon several ships that fell into the port of Hull and were there examined by the Customs officers, the said Commissioners sent over Ja. Housman, surveyor of Hull, to Newcastle to make enquiry into the behaviour and practice of the officers at Newcastle: from which it was learned that several Dutch junks and doggers which had laden coals at Newcastle and Sunderland for Holland, fell into Hull port, where the Customs officers believing upon a view of some of the ships that the cocquets which they produced from Newcastle and Sunderland did not contain by a very considerable difference the quantity of coals which seemed to be on board, they proceeded to unload and measure the said ships whereby it appeared that some of them had on board a fourth, others a third and some a moiety more of chaldron of coals according to the Hull measure than were mentioned in the cocquets: and thereupon the masters, in order that their voyage might not be interrupted, re-loaded their coals under agreement with the said officers to abide the determination of the Exchequer Court upon information of devenerunt for the 313 chaldron of coals for which there appeared no cocquets on board 43 vessels which at 18s. a chaldron amount to 281l. 14s. 0d.: whereupon a person who is concerned and appears for the said Masters has taken out licences from the Exchequer to compound this matter with the officers and they are now making an agreement the terms whereof usually are one third the value of the goods to the officers besides their charges and then the King's fine is rated in the same proportion: the said person also appears for [a further lot of] 315 chaldron of coals now remaining on shore at Hull under seizure being taken from on board some of the ships which at the same time fell under the examination of the officers, which are appraized at 283l. 10s. 0d.: but the officers allege that they have been at very extraordinary charge in the landing and securing this latter parcel of coals wherefore the said person relinquishes his claim thereto hoping that in the composition he is to make for the former parcel [of 313 chaldrons] he may be considered and the terms of the composition moderated from the usual proportion of a third to a less value.
Upon his so relinquishing his claim to the said 315 chaldron the officers are hereby to make such composition with him for the other parcel as the Commissioners shall think reasonable. Out Letters (Customs) XIII, pp. 282–3.

Treasury warrant to the Surveyor General of Crown Lands for a particular of premises (being some small things in county Radnor) in order to a lease thereof to Tho. Harley in trust for John Richards.
Prefixing: (a) note of said John Richards' petition: (b) said Surveyor General's report dated Aug. 20 inst. on said petition. This petition was referred to me in Feb. last but has not been further prosecuted till now, the petitioner being advised by counsel that a lease under the Exchequer seal would not enable him to try the King's title against a person that claims an inheritance in the greatest part of the lands therein, and the value thereof being not sufficient to defray the charge of a great seal. But he now desires that same may be granted with divers other small parcels in the same county whereof a lease is preparing for Thomas Harley ut supra, p. 234.
In 1664 Charles II granted to John Richards (petitioner's late father, who was deputy auditor of Wales) a piece of land called Closemaur, a meadow called Low Mead (Cowmead) and an acre of land thereto near Radnor Park in South Wales for 31 years from 1663, Sept. 29, at rents of 20s. and 12s. The piece of ground called the Castle Green, being the scite of the Castle of New Radnor, has been held by petitioner and his late father without any title but upon payment of 12d. per an.; and the other lands called Errowalls Wirglod are already included in the particulars prepared in order to Mr. Harley's lease ubi supra. I am informed that this petitioner never had possession of the first parcel called Close Maure, the same being enjoyed by one Wadely of Hereford who claims the inheritance thereof and received same from petitioner's father 20 years since. It was not noticed in the Commonwealth Survey in 1650 but was, with Cowmead, etc., a discovery of petitioner's father. The Cowmead has been formerly let at 3l. per an. and the scite of the castle which lay waste in 1650 was then valued at 40s. a year though this petitioner affirms he receives but a noble a year for it now.

Aug. 27. Treasury reference to the Customs Commissioners of the petition of Jno. Reynolds and Corn[eliu]s Dennis merchants, shewing that their agents at St. Sebastian shipped 30 tun of wine for England which is stopped in London port on pretence that the ship is not duly qualified: whereof petitioners are not to be judges but do verily believe that their agent was misled touching the English laws of Navigation: therefore praying a non pros and the rather because the Customs which they have paid will be more than his Majesty can possibly get of the condemnation. Aug. 27. Same to same of the petition of Giles Heysham, William Heysham and Thomas Duboys, Barbados merchants, shewing that by the Act for Tunnage and Poundage it is provided that if any goods (after payment of Customs) be taken by the enemy they shall be allowed to ship other goods, Customs free, to the like value; but that no such relief is provided in the case of the Four and a Half per cent. duty: that they (having sustained great losses at sea) have cheerfully paid all other Duties to the King but desire relief for such goods as are lost according to the usage of owners or mariners of ships who never expect freight or wages unless the ship and goods arrive safe at their port: therefore praying direction to the officers in Barbados that upon proof made before the Governor or Exchequer Court there of losses at sea they may be permitted to ship the same quantity of goods, Custom free, as have been lost. My Lords have read the petition of Matthew French of county Cork shewing that he was collector and customer of Kinsale port by patent for life and hath been employed in the revenue above 20 years but at the reduction of Ireland not being able to make timely application to the then Commissioners of the Revenue another was put into his place and hath continued there ever since: therefore praying some employment in consideration of his great sufferings.
