reason of trusting persons to return his moneys

Petitioners set forth ut supra ibid. We have
referred same to Guiciardin Wentworth, esq,
secretary for the affairs of the Duchy of Lancaster,
and Auditor William Aldworth. Their report is as
follows and we consider the matter to be truly and
fully stated therein; and we concur therewith. |
|
|
Prefixing: (a) said order of reference from the King in
Council. (b) Treasury order of reference dated
April 21 last. (c) Said report from Wentworth
and Aldworth, dated May 24 last. The late King
granted to Thomas Windham under the Duchy
seal all arrears due to the King [in said Duchy]
from 1660 to 1682, Michaelmas. Thereupon the
several auditors of the North and South [parts of
said] Duchy were directed by the then Chancellor,
Sir Thomas Chichly, to make out schedules of said
arrears and amongst same of this sum of 126l. 2s. 2¾d.,
which sum arises not from one entire fee farm rent
of 10l. 8s. 0d. per an., but from several rents as in
the schedule below, and was made out by the
auditor only for the Chancellor's information and
not otherwise. The messenger, Benjamin Ayloff,
before he went down to levy, did not attend the
auditor of the premises to receive instructions as
in this case was requisite, but went only to the
Receiver, whose books of receipts were shown to
him and copies offered him, which had he accepted
it would then have appeared that the petitioners
Dickenson, Robinson and Lumpkin had duly
answered their respective rents. As to Mayden, we
do not find that he holds any of the lands out of
which these rents are issuing, so that there could
be no pretence of making any distress upon him:
and Smyth produces acquittances to clear his rent.
We are of opinion that the 122l. 15s. 0d. was unduly
levied upon the petitioners and ought to be forthwith
paid them with such reparations and allowances
for their loss and charges herein as the Treasury
Lords think fit. |
