Jan. 2. Charles Bertie to the Customs Cashier. You have two letters before you of Aug. 17 last for 180l. for Mr. Gurle, gardener of St. James's Garden, and Oct. 12 for 160l. to same, which Mr. Gurle tells me are not yet satisfied. Take care to pay this money into the Exchequer as soon as conveniently you can, great part of it being by him laid out upon a contract with the King for keeping the Gardens. Same to the Auditor of the Receipt for tallies on the Tenths of York, Exeter, etc., for 500l. for last Christmas quarter on the Countess Dowager of Bristol's two pensions of 1,000per an. each. Ibid.

Royal warrant to the Attorney or Solicitor General for a great seal for a grant to Richard Deerham, Esq., of the office of Comptroller of Customs, Lynn Regis port, in reversion after John Anguish : for (life) : with the yearly fee of 15l. 4s. 4d. and all other fees, salaries and profits thereof. Same to the Clerk of the Signet for a privy seal authorising Mr. Kingdon [the deputy to] the Paymaster of the Forces to pay all sums which by warrants under the hand and seal of James, Duke of Monmouth, Captain General of all his Majesty's troops and land Forces, pursuant to establishments (made and to be made) shall be directed to be paid and for allowing to said Kingdon on his accounts the payments so made or to be made by him "with your Majesty's allowance of what said Lemuel Kingdon, Esq., hath already paid pursuant to such warrants dated as well before as since the 30th of April last." Royal warrant to the Clerk of the Signet for a privy seal for a grant and transfer to Roger Chapman, of Newport Pagnell, co. Bucks (in consideration of the sum of 564l. 17s. 6¼d. paid or secured to be paid by him to the King) all the obligations as follows [being the forfeited Customs bonds of Thomas Chapman, of Liverpool, merchant, and his sureties] and the penalties therein contained and the original debts or duties for which the same were respectively taken and all interest and damages of 12 per cent. and other penalties and forfeitures due or to be demanded for nonpayment of said debts, and also all other bonds, specialities, books, accompts, papers and securities whatsoever relating to the said debts and all lands, tenements, leases, commodities, goods, chattels and other things whatsoever that are, shall or may be extended or taken in execution upon the said obligations or other specialities or for the said penalties, interest and damages or any of them : viz., as follows, an obligation or bond dated 1676, Nov. 17, by Thomas Chapman, of Liverpool, merchant, Arthur Calcote, gent., and William Fleetwood, glazier, for 90l. conditioned to pay 44l. 18s. 2d. to the Customs collector, Liverpool port ; another obligation of same date by the same three for 220l. conditioned to pay 110l. 2s. 3d. to such collector ; two several obligations or bonds dated 1676, Nov. 28, by said Thomas Chapman, William Wattmough, anchorsmith, and James Travers, gent., for respectively 80l. and 33l. conditioned to pay 39l. 18s. 10½d. and 16l. 5s. 9¾d. respectively to such collector ; two obligations or bonds dated 1677, April 27, by said Thomas Chapman, Anthony Wood, ironmonger, and George Moorcroft, innholder, for respectively 100l. and 37l. conditioned to pay 44l. 16s. 0d. and 18l. 5s. 5½d. respectively to such collector ; an obligation or bond dated 1677, May 26, by said Thomas Chapman, Jeffrey Culcheth, merchant, and James Prescott, mercer, for 290l. conditioned to pay 142l. 10s. 0d. to such collector ; two obligations or bonds dated 1677, June 8, by said Thomas Chapman, William Crompton, merchant, and Joshua Fisher, innholder, for respectively 149l. and 62l. conditioned to pay 74l. 9s. 9d., 30l. 7s. 7d. to such collector ; an obligation dated 1677-8, Jan. 10, by said Thomas Chapman, Randolph Hunter, gent., and Saml. Yates, yeoman for 185l. conditioned to pay 92l. 16s. 7½d. to the collector of Lancaster port. All the abovesaid obligations etc., said Roger Chapman in consideration of said 564l. 17s. 6¼d. is to enjoy to his own use and that of his executors, administrators and assigns without any account to be thereof rendered to the King, his heirs, etc., and is hereby to have full power to sue for and recover same in the name of the King, his heirs, etc., or in his own name and to compound and discharge same. Charles Bertie to [the Auditor of the Receipt] to pay out of Recusants' money in the Exchequer, and notwithstanding any former order, 30l. to Gervas Price for half a year to Christmas last on his allowance as chief underkeeper of St. James's Park ; 25l. for last Christmas quarter on his allowance for keeping his Majesty's arms at Whitehall and 14l. 11s. 3d. for same quarter on his fee of 58l. 5s. 0d. per an. as Gentleman of the Bow. Jan. 4. Mr. Christopher Rich desires on behalf of Sir Thomas Skipwith, one of the executors of Mris. Dorothy Skipwith, deceased, that no grant may pass to Mr. David Wood or any other person of a legacy of 250l. given by said Mris. Skipwith to the use of religious places beyond sea till Sir Thomas have notice at his house in Portugal Row, Lincoln's Inn Fields. Caveat Book, p. 37.
Jan. 7. Treasurer Danby's subscription of a docquet dated 1678, Dec., of a grant to John Boswell, Esq., and Francis Colley, gent. (at the petition of John Staley, goldsmith), of all the real and personal estate whatsoever forfeited to the King by the attainder of William Staley his [said John's] son ; according to his Majesty's order in Council. Docquet Book, p. 15.
Money warrant for 27l. 19s. 0d. to Will. Lounds (Lownds), without accompt, in satisfaction of what he has expended during the last Sessions of Parliament to the Clerks of Parliament and others for copies of bills and for his Majesty's service, and for his own pains in relation thereto. Warrant from Treasurer Danby to the Receipt to issue 100,000l. upon any unsatisfied orders in the name of Lemuel Kingdom, "Esq., Paymaster of the Forces, for foreign alliances" : same to be satisfied by tallies on Sir John James, Kt., and Robert Huntington, Esq., two of the Commissioners and Receivers General and Cashiers of Excise. Money warrant for 182l. to Roger Meredith, Esq., for three months (Aug. 24 last to Nov. 23 last) on his ordinary of 40s. a day as Secretary to the Extraordinary Embassy to the States General of the United Provinces : to be by tallies on the Customs. (Charles Bertie dated Feb. 20 to the Customs Cashier to pay said tally in its course according to date and if you shall in the mean time advance the same you are to be allowed 6 per cent. per an. interest and 2 per cent. per an. gratuity till your repayment in course.) Charles Bertie to the Customs Cashier to pay 13l. to Roger Charnock for last Christmas quarter's salary as a King's waiter, London port ; and to bring into the Exchequer 25l. 1s. 10½d. for him for same quarter's salary and board wages as a Serjeant at Arms. Out Letters (General) p. 356.
Same to same to bring into the Exchequer forthwith 620l. 10s. 0d. for the Treasurer of Christ's Hospital, London, viz., 250l. for last Christmas quarter on the ordinary allowance of 1,000l. per an. for the children of the Royal Foundation [the King's Mathematical Boys], and 370l. 10s. 0d. due at the same time for putting forth thirty of the said children [as] apprentices to the masters of ships. Jan. 8. Money warrant for 2,915l. 1s. 2d. to John Baynes, Esq., one of the Commissaries of his Majesty's Musters, as imprest for and towards the pay of the arrears still remaining due to the officers and soldiers of the regiment late under the command of Sir Tobias Bridge (now deceased), lately in the West Indies. Same to be hereby satisfied by tallies on the Receivers General of the Four and a Half per cent. duty in Barbados and the Leeward Islands. Money Book (General) p. 351.
Treasurer Danby's allowance of the 1678, Christmas quarter's salary bill of the Excise Office. (Total, 2,332l. 10s. 0d.) Ibid, p. 352.
Note (on a loose paper in the Money Book on p. 352) of a tally for 875l. payable to Charles Bertie in part of his privy seal for 20,000l. [for secret service] ; same being struck upon the half year's Hearthmoney rent due Sept. 19 next from Anthony Rowe and partners. Followed by : a memorandum that upon the 9th of Dec., 1679, this tally was altered and re-struck upon John Perry and Edward Buckley "late Farmers of the Hearth Office." Ibid.
Charles Bertie to the executors of Sir Edmd. Berry Godfrey. Treasurer Danby some time since deposited 300l. in said Sir Edmundberry Godfrey's hands towards making the new sewer by St. James's Park ; and is certified by the Commissioners of Sewers that the work is finished. His Lordship directs the money to be paid to said Commissioners, and I desire your ready complyance herewith, Sir Edmundberry having given a note under his hand for paying the money to this use. Warrant from Treasurer Danby to the Customs Commissioners to pass, Customs free, several naval stores and provisions which by the Admiralty Lords have been shipped on board the Loyall Merchant, Joseph Knapman commander, to be transported to Jamaica for the use of his Majesty's ships the Jersey and Hunter, as is certified by the Navy Commissioners to Treasurer Danby. Jan. 9. Information having been given that Laurence Corbet, one of the patent waiters of London port, has absented himself from his trust and declined the doing his duty either by himself or his deputy, Cave that no deputation be allowed from him till the matter against him be examined ; and if [such deputation] be sought for, notice is to be given thereof to Mr. Wardour. Warrant from Treasurer Danby to the Customs Cashier to forthwith pay 3,675l. to Samuel Maydwell for defraying the charges for one year to Christmas last of the bills of Impost upon wines at the rate of of 42s. per ton to the noblemen and others who have usually been paid and allowed the same, of which bills of Impost said Maydwell is Clerk and Paymaster. Money warrant for 500l. to Sir Stephen Fox for last Christmas quarter on the 2,000l. per an. as by the privy seal of 1674, July 27 : (in the margin : for the Earl of Lichfield) : and same for 500l. to said Fox for same quarter on the 2,000l. per an. as by the privy seal of 1674, Aug. 25 : (in the margin : for the Earl of Sussex). Same for the several sums following, amounting in all to 1,650l. to Isaac Legouch, Esq., his Majesty's Jeweller, viz., 350l. for a jewel with his Majesty's picture given to Monsieur Bellow [Bulow], Envoy from the Duke of Luneburg and other princes of Germany ; 300l. for a ring given to Baron S[ch]werin, Envoy from the Prince Elector of Brandenburgh ; and 1,000l. for a jewel which was to have been given to the late Portugal ambassador, deceased, and [which is] now given by the King to the Countess of Penalva, said ambassador's sister : all as by a certificate thereof dated Dec. 18 last from the Earl of Arlington, Lord Chamberlain of the Household. Charles Bertie to [the Auditor of the Receipt] to pay 47l. 4s. 2d. to Sir Robt. Croke, for one year to Sept. 29 last on his fee as Clerk of the Pipe : when the Customs Cashier brings in the money. Out Letters (General) p. 357.
Warrant from Treasurer Danby to the Customs Commissioners and to Sir John Shaw, Surveyor of the Navigation Act, to register as a free ship of England the Friendship, of Yarmouth, and to grant certificate thereof in the usual form.
Prefixing : Secretary Williamson's certificate dated Whitehall Jan. 6 that it appears by "the entry books in the Earl of Arlington's office whilst Principal Secretary of State, now remaining in my custody" that a warrant was signed by the King 1674, May 9, for so making free the said ship Friendship, of Yarmouth, Joseph Amis master, of about 260 tons burthen.

Same from same to the Trustees for sale of Fee Farms (in the form of a subscription by Treasurer Danby under the contract form as follows) to convey to Phillip Packer and his heirs the fee farm rents as follow on the production of a tally purporting payment of the purchase money.

Report from same to the King on the Lord Lieutenant's report on the petition of Col. Thomas Dungan. Said petition sets forth that Edmund Nugent, of Culvin, in co. West Meath, Ireland, by decree of the late Court of Claims in Ireland in execution of the Act of Settlement has (upon a deed of conveyance made by Jno. Nugent, his father, of certain lands and hereditaments mentioned in said decree and of the value of about 200l. per an. sterling limited by the said John Nugent to several uses) been restored as an Innocent person to a remainder in tail of the said lands and hereditaments to him, the said Edmond, and his heirs male with divers remainders over ; so that by virtue of the said Act of Settlement the remainders or reversions expectant upon the said estate tail of the said lands and hereditaments are and remain vested and settled in the Crown. Petitioner Dungan is of near relation and kindred to said Edmund Nugent and has on several occasions loyally served the King. He therefore prays a grant of the said reversions and remainders under the like crown rents and services as are now answered to the King out of the said estate. For such grant of the said reversions "your petitioner hath obtained the allowance and consent of the Duchess of Cleveland, whom your Majesty was pleased to concern in the reversions and remainders of that nature vested in your Majesty." Said petition being by order dated Whitehall, Aug. 15 last referred by the King "being well inclined to show the petitioner all reasonable favour" to the Duke of Ormonde, Lord Lieutenant of Ireland, the latter reported thereon Oct. 25 last as follows. I have considered same and consulted therein Sir William Domvile, Kt., Attorney General of Ireland, who has stated petitioner's case and delivered his opinion thereon to me as follows, viz., said John Nugent of Culvin was seized in his demesne as of fee of several lands in cos. West-Meath and Longford, and by deed of feoffment dated 1626, Sept. 22, conveyed several lands in the abovesaid decree mentioned to certain feoffees (amongst other things since determined) to the use of said Edmond Nugent, his eldest son and his heirs male, with remainder to Walter Nugent, second son of said John and his heirs male, and failing that with remainders to Laurence, Robert and Francis, younger sons of said John successively : all which sons were declared innocent by the late Commissioners for adjudication of the claims of Innocents and were by decree dated 1663, July 27, restored to their respective estates in remainder. All the said younger brothers of said Edmond Nugent are since dead, and said Edmond is still living without issue male "and it doth not appear unto me [Domvile] by the said decree but that the reversion in fee after the particular estates ended and determined was still in John, the father of Edmond, and his heirs." And as said John the father was not declared innocent, and as Edmund the son was not restored to any other estate than what was limited to him, said Domvile therefore thinks the reversion in fee may be in the King's gift, and may be by the King granted to said Dungan. This opinion of Attorney General Domvile, the Duke of Ormonde humbly certifies to the King. Thereupon by order dated Nov. 14 last said report of the Duke of Ormonde with said petition, etc. was referred to Treasurer Danby, who thereupon reports the present 9th inst. "I am able to certify noe more in the case of the petticoner then has been stated to your Majesty by his Grace the Duke of Ormond." Ibid, pp. 272-5.
Jan. 10. Allowance by Treasurer Danby of the 1678 Christmas quarter's salary bill of the Custom House [sic for of the Customs officers, London port], amounting to 5,996l. 6s. 8d. Money Book (General) p. 354.
Warrant from same to the Customs Commissioners to direct the respective collectors of the outports to pay the abovesaid quarter's salaries to the outports officers, "taking particular receipts for the same." Ibid.
Charles Bertie to the Navy Commissioners. Treasurer Danby desires you to make out bills of imprest to Mr. Brett and partners, Victuallers of the Navy, pursuant to their contract [and] for the ensuing year [and] according to the declaration sent to them for Sea Victuals and [also for the same year] at the usual rate and allowance for Harbour Victuals. You are to assign said bills from time to time for payment by 1,000l. a week out of the weekly sum of 2,500l. which will be duly paid to the Treasurer of the Navy out of the Customs for this [abovesaid] year to begin the 1st inst. Out Letters (General) p. 357.
Same to Sir Anthony Deane. The Victuallers of the Navy desire to forthwith account for the service of the year ended Dec. 31 last, which Treasurer Danby is very willing they should be assisted in. As soon as you possibly can you are to take and examine their accounts for said year accordingly and make a state thereof for his Lordship's perusal, inserting therein their claims for repairs, interest of money and for victuals not taken off according to contract. Ibid.
Charles Bertie to the Treasurer of the Navy. Treasurer Danby has directed the issue out of the Exchequer to you of 5,000l. out of the January portion of the Hearthmoney Contractors' advance money. You are to issue same to Mr. Brett and partners, Victuallers of the Navy, upon bills of imprest signed by the Navy Commissioners and assigned for payment out of such money as Treasurer Danby shall appoint. Same to the Customs Cashier to pay off Lady Villiers's executors' order for 150l. for last Christmas quarter on their pension payable out of Coinage money. Ibid, p. 358.
