Report from Treasurer Danby to the King on the
petition of Richard Brett, Esq. (as by the order
of reference of Feb. 25 last). By patent dated
1662, July 25, he was granted an annuity of 250l.
per an. out of the logwood duty, to be paid by the
Commissioners or Farmers of the Customs. On
Sept. 23 of same year said duty was let to farm
to John Pincomb under the rent of 500l. per an. In
1676 said rent of 500l. per an. was granted to
Lawrence Hide without taking any notice of the grant
to Brett, whose annuity is in arrear 2,812l. 10s. 0d.
to Midsummer last as is certified by the Auditor of
the Receipt. In lieu of said annuity for life and
the arrears thereof petitioner prays a settlement
of interest as the bankers' debts are settled. "But
in regard there seemed to be some doubt whether
the petitioner's pretensions to said 250l. per an.
were good in law to charge the said [logwood] Customs,
your Majesty having disposed of the said Customs
and the rent reserved upon the grant thereof."
I referred same to the Attorney General, who has
reported to me his opinion that the petitioner
will be entitled to so much of the rent as will satisfy
him his annuity. If such grant as he prays be made,
the annuity for life may be reasonably valued at
seven years' purchase, amounting to 1,750l., which
will make 4,562l. 10s. 0d. if the abovesaid arrears
be added thereto and the interest thereof at 6 per
cent. would be 273l. 15s. 0d. per an. : "but
whether your Majesty will grant the same to the
petitioner in the form desired by him or what other
satisfaction your Majesty will think fit to make
unto him" is humbly submitted.
