Warrant from Treasurer Danby to the Customs Commissioners to discharge the seizure of the ship Fortune, of London, John Allen master, with her lading of timber and deal boards : said master undertaking his voyage at Portsmouth, not having been able to provide himself a sufficient number of English mariners sent to his owners in London to be furnished from thence, whereupon six men were hired, but three ran away and had to be replaced by two strangers who were inhabitants of this Kingdom, married to English women and kept houses there : so that he returned with three other strangers before hired on the said ship and ten English. On the 24th you represented to me that a quantity of salt was imported into Harwich for the use of the Royal Fishery, but contrary to a clause in the Act of Frauds prohibiting the importation of salt from Germany or the Netherlands. I have acquainted the King therewith, who directs that since the said salt is a sort not to be had in England or elsewhere in the King's dominions, nor can the design of fishing be carried on without it, same may be imported for the account of the Royal Fishery, notwithstanding the above prohibition. It is to pay Custom as for foreign salt. You are hereby to observe this. Ibid, pp. 189-90.
Aug. 2. Entry of the reference to the Customs Commissioners of Mr. Hoppey's report to the Master of the Ordnance containing an information of some abuses committed in the Customs : to report how such frauds may be prevented in future. Ibid. p. 189.

Same from same to same for a commission to be issued out of the Exchequer for setting out and assigning wharves and keys in the port of Lynn Regis and members thereof, as below, being according to a precedent agreed to by the Attorney General and remaining in your custody.
Prefixing : draft of said Commission directed to the Mayor of Lynn Regis, Charles Osborne and Giles Dunstar, General Surveyor of Customs, Richard Godfry, customer there, John Anguish, comptroller there, Edward Bromley, searcher there, William Lynstead, Edmond Tassell, Owen Godfry and John Arden, gent. The draft recites the Acts of 14 Car. II. and 1 Eliz., notwithstanding which there are some ports, creeks and places where customers, collectors, comptrollers and searchers and other servants had time out of mind been resident, to which no commissions were sent, nor places, keys or wharfes appointed as by said latter Act directed : also that by reason of the alteration of rivers, streams, channels and sands, some places then appointed are become unfit and useless, and others much more convenient and commodious as well for traffic and commerce as for landing and shipping : also that the keys and wharfes in said port of Lynn and its members are by the above reasons in part or whole unsettled, unlimited and unbounded or in part unfit, etc., as above : therefore said commissioners are to survey, set out and appoint and settle the extents of keys and wharfes in said port and its members and creeks ; certifying the Exchequer herein three weeks from Michaelmas next at latest.

Aug. 10. Warrant from Treasurer Danby to the King's Remembrancer to stay process against William Tindall (Tyndall) a surety of James Collins, late Receiver of Hearthmoney for Yorks, West Riding and York City, who is indebted on his receipt thereof about 2,000l. : the said Tyndall having paid 1,000l. of said arrear, which is more than his proportion thereof : the King having lately released Thomas Hebur, who was the best and principal of the said sureties. Warrant from Treasurer Danby to the Customs Commissioners and Sir John Shaw, Surveyor of the Act of Navigation, to enter and register as a free ship the Thomas and Francis, of London, and to grant the usual certificates.
Prefixing : royal warrant to same dated 1674, May 9, for the naturalizing of said ship, a foreign-built ship, John Redman, master, of 80 tons burden or thereabouts, bought by and solely belonging to the King's subjects ; the King "taking into consideration the great scarcity of merchants' ships occasioned by the late war between us and the States General of the United Netherlands, and which cannot in a long time be supplyed by building."

Same from same to same to discharge the seizure of the ship St. Andrew, of London, William Greene, master, who sailed from London to Norway about ten months since with 12 men, nine of them English and three strangers, but was driven into Amsterdam by stress of weather and wintering there "the Lords ordered him to put off his men with half wages," and when afterwards he had need of his men to continue his voyage, he was necessitated to employ some foreigners, and so returned with 14 men, four of them strangers. Aug. 14. Same from same to the King's Remembrancer to stay process against George Pley, collector of Weymouth port : his case being referred to the Lord Treasurer by order in Council July 21 last : said Pley's security being sufficient to cover his debt, and he desiring time to put himself in a condition to satisfy same. Warrant from Treasurer Danby to the Surveyor General of Crown Lands for a particular or constat of 10 acres called Bolswith Wood within the manor of Penline, co. Cornwall, parcel of the Duchy of Cornwall, with a view to lease thereof to John Day for three lives or 31 years under the yearly rent of 5 groats and fine of 20l.
Prefixing : Said Surveyor General's report dated July 17 on said Day's petition for same. The wood ground is a customary tenement, and the herbage thereof granted at the assession from seven years to seven [years] at 6d. per an. rent, but the underwood belongs to the Crown, and it may be no disservice to grant a lease thereof to Richard Kendall, son of Walter Kendall, gent., the present tenant, for three lives or 31 years at the same rent (the profit of the underwood which hath not been fallen under 24 years' growth or more having been very small and is subject to be worn out and come to nothing as now it is) for a fine of 20l. or increase rent of 20s. per an., with covenants for preserving the wood from spoil and harm, and so to leave it at the end of his term. "If the said Richard Kendall in respect of the great charge of passing a lease of this small parcel shall desire rather to take it at the next assession per ordinem Domini Thesaurarii Angliae including the underwood, as a customary tenant, I think it may be so granted without any prejudice."

Same from same to the Clerk of the Pipe for a lease to Bevill Skelton, one of the Grooms of the Bedchamber, of a messuage near the gate leading from the dung yard of the Mews to Hedge Lane, with a small yard adjoining, containing in the whole 1,675 square feet abutting south or east on a space or yard belonging to Edward Gould, and north on the Dung yard and within the parish of St. Martins in the Fields, and now in said Shelton's occupation : with all structures, passages, etc., etc., for 99 years at 26s. 8d. per an. rent.
Prefixing : Surveyor General's constat of the premises (grounded on Sir Christopher Wren's plan and the Duke of Monmouth's warrant dated 1674, Sept. 10, as Master of the Horse) and ratal by same dated July 21 : advises a clause of re-assumption by the Crown on payment of expenses in building : the lessee to repair buildings, etc., and only to erect other buildings by agreement with the Surveyor General.

Yarmouth, of a small piece of land or garden in the precinct of the Palace of Whitehall, in a place or garden called the Bowling Green, in St. Margaret's, Westminster, abutting west on the wall of a house now to be built by the Earl of Oxford, extending west 54 along said wall and in width in the middle about 54 feet and abutting south on an old wall of the palace or garden aforesaid : all for 31 years at the rent of 3s. 4d. per an.
