Remembrancer to stay process against James
Smith, late Receiver of Hearthmoney, co. Sussex,
he having represented that he was only surety
for his brother, former Receiver there, who died
leaving his receipt in a distracted condition, and
that many of the Collectors ran away with their
receipts, so that petitioner was forced to take upon
himself said receipt and pay a great part of the said
money, and is now in suit with some of the said
Collectors.

Lands for a particular and ratal of Burges close,
in the manor of Stratton super Fosse, co. Somerset,
and other premises as below, with a view to
extension of lease thereof to John Tooker.
Prefixing : said Surveyor General's report dated
July 15 on said Tooker's petition for same. Said
close may probably be the same which was granted
by Car. I, 1628, June 14, for 31 years by the name
of Newmead, valued at 4l. per an., and since granted
by copy to James Hedges for three lives under the
old rent of 13s. 4d., and 26s. 8d. increase and 30l.
fine, which was not good in law : therefore recommends
a lease to some person for the same lives
with power to change one, and that the rent of
26s. 8d. be discharged by a fine of 20 marks : and
that the church house and cottage in the manor of
Midsomer Norton (granted for three lives at 10l.
fine and 5s. 4d. per an., valued at 21s. per an. above
the said rents) and the profits of the fair and fishing
there valued at 4s. 4d. per an. be inserted in the
same lease for three lives, and under the same
rents, and that Buckborow and Great Buckborow
be also inserted in the same lease, for the same
lives, at the old rents of 2s. 6d. and 3s. 4d. and a fine
of 5 marks.

Warrant from Treasurer Danby to Sir Robert Croke,
Clerk of the Pipe, for a lease to Richard, Lord Arundell
of all those lands, meadows, pastures, feedings,
gardens, orchards, houses and buildings within the
precincts of the late disparked parks of Lanteglos and
Hellesbury, viz., for 99 years at 10l. 13s. 4d. per an.
said lease to commence after the several leases
formerly granted to Sir Richard Buller and Henry
Seymour in case those leases be good in law : with a
grant or release from henceforth to said Lord Arundell
(as the assignee of Henry Seymour's interest)
of the 30l. per an. rent (reserved upon the premises
during the estate which was granted to said Henry
Seymour). But if the present leases be not good
in law, then to demise same to said Lord Arundell
for 99 years, and without fine by the King's direction,
in consideration of said Lord's services. And
further to demise the water and poole of Sutton
"and other things mentioned" [sic] in the particular
below to said Lord Arundell for 15 years at
13l. 6s. 8d. per an., after expiry of his present
31 years' lease therein, in case the present lease
be good in law : and if same be not good, then to
demise same to him for 31 years henceforth at the
like yearly rent : and with a release and discharge
to him of the increased or improved rent of
31l. 13s. 4d., parcel of the rent of 45l., reserved
by said Lord Arundell's present lease : which lastmentioned
grant and discharge are in consideration
of said Lord's great charge in defending the King's
title against the town of Plymouth, and are to be
without fine.
Prefixing : (a) Particular (made by James Symes,
deputy auditor of the Duchy of Cornwall) of the
parks of Hellesbury and Lanteglos, parcel of the
Duchy of Cornwall and demised 1627, May 5, to
Sir Richard Buller for 99 years, terminable on the
lives of John and Anthony and William his sons, and
demised 1664, April 26, to Henry Seymour in
reversion thereof for 99 years, determinable on the
life of Edward Seymour his nephew.
(b) Same by same of the water and pool of Sutton,
co. Devon, parcel of said Duchy, demised 1660-1,
Feb. 7, to Richard Arundell, Esq., of Trerice.
(c) The Surveyor General's report and ratal dated
May 3 last on said particulars : "a special clause
is to be inserted in the lease now to be granted
to empower his Lordship to build and erect houses
upon such part of the ground and soil of the said
pool as shall be convenient for the use and benefit
thereof, and of the trade there used and no
prejudice or damage to the harbour there."

to permit, customs free, the shipment and
export of 56 guns, 100 barrels of powder, 10 tons of
shot, with small arms put on board certain Swedish
ships now lying at Queenborough, same being
for the proper use and defence of said ship,
and which Thomas Sutton, merchant, prays may
pass, customs free : the officers of London port
having on said Sutton's petition reported that they
have not known any strangers' ships to have ever
taken in any arms or ammunition in the said port,
but that English ships do commonly take in such
quantity of arms and ammunition as is necessary
for their own defence, without payment of custom.

Warrant under the royal sign manual, authorising and
requiring Arthur, Earl of Anglesey, John, Earl of
Bath, and Sir John Ernle to signify the King's
pleasure to the Judge Advocate and other officers
of the High Court of Admiralty, to sue or cause to
be sued in the said Court in the most speedy manner,
all persons, their heirs, etc. and sureties, who are
yet in arrear to the Crown for prize goods as under
the Act of 14 Car. II, empowering such suits for
prize goods taken at any time since 1642-3, Jan.,
and before 1660, May 29, and not accounted for
(on which Act several considerable sums of money
have been in the said court adjudged to the King
and paid into the Privy Purse) "wee being given
to understand that several persons still living
and the heirs, executors and administrators of
several persons that are dead are still in arrear
to us for such prizes and prize goods." Power
is hereby given to said Earl of Anglesey, etc., to
compound with and discharge such persons, and to
receive the goods and moneys recovered, allowing
a moiety thereof to persons employed in the discovery
and prosecution of same : the remaining moiety
to be paid as the King shall direct.

Antho. Parsons, that the whole charge amounts
to 3,208l. 2s. 0d., whereof there is allowed to him
73l. 19s. 11d. for salaries to himself and others
and 2,463l. 12s. 1d. for money paid into the Receipt
whilst the following sums are set in super, viz.,
560l. 13s. 0d. upon divers constables in said county
for several sums of [Hearth] money by them received
within the time of said accompt., and unpaid to
the accomptant (as appears by the oath of Francis
Sawle, deputy to said accomptant) : 26l. 1s. 0d.
and 83l. 16s. 0d., set upon divers other persons
for sums of money behind and unpaid to said
accomptant : said supers amounting to 670l. 10s. 0d.
and so balance said account, "but by reason that the
schedules of arrears belonging to the said account
(which were formerly left with Mr. Pollard, late
deputy auditor for said county, for passing the
account) cannot be found, the said supers, as
aforesaid, are charged only in general sums on
high constables, petty constables and several other
persons, without mentioning them in particular
and therefore said account cannot regularly be
declared without special warrant." On the
petition of the executors of said Oliver Sawle
(who is dead) and the barons of the Exchequer
having recommended it as a matter for the King's
grace and favour it is hereby provided that said supers
be set in said account in a general manner, as aforesaid,
and said accounts to be declared and finished
as if such supers were duly and regularly set upon

to a lease thereof for three lives to the petitioner

rent upon surrender of his present estate by copy
of Court roll : to be without fine in consideration
of such surrender and of petitioners' service in
reviving the said rent of 20s. per an. to the Crown.
Prefixing : said Surveyor General's report dated
June 28 on the petition from John Tooker and
John Salmon for such lease. Sir John Duncombe
formerly granted said coalworks to said Tooker
by copy of Court Roll for three lives at 20s. per an.
rent, "and that having seen Mr. Attorney General's
opinion upon a case made by Mr. Long touching
the said coal mines, he [said Surveyor General]
conceives that in case the same were well granted
by copy according to the custom of the manor, if
a lease were afterwards granted by a right owner
of the manor and enjoyed for any considerable
time the custom would be thereby destroyed, and
cannot be legally revived. But it not appearing
that any such lease had been granted, I [said
Surveyor General] thought the customary estate
was not lost, and that a new admittance of the said
Mr. Tooker would be good, but if there were no
such custom, then a grant thereof by copy would
be of no effect. And Mr. Long (from whose
ancestors the said manor was recovered by Prince
Henry as parcel of the Duchy of Cornwall)
pretending that there was no such custom as to
the said coal mines in Plummers Close and Perthill,
I have, upon your Lordship's warrant, made him
a constat (the auditor having no record to ground
a particular upon) for a lease thereof to be
granted to him, if your Lordship shall think fit,
for the same three lives by which he holds by copy
of Court Roll [viz., of] the tenement called Vaggs
(whereof the said Plummers Close is parcel) at
the rent of 20s. per an. Now these petitioners
[Tooker and Salmon] having possessed themselves
by virtue of the said admittance granted by Sir John
Duncomb's warrant of the said coal mines in both
the said places called Plummers Close and Perthill
and paid the said rent of 20s. per an. for three
years past and been at great charges in opening
and clearing the coalworks there, do humbly desire
to have a lease to strengthen their interest, in case
the said admittance should prove defective. I
do conceive that if the said customory estate be in
force, then they may by virtue thereof legally
open the said coal mines, and make benefit of the
same, giving the tenants reasonable satisfaction
for the damage they sustain there, but if there
be no such custom in force, then I think a lessee
cannot enter upon any of the tenants' land other
than his own, without their consent, which is as
much as I can say in this case."

Whitehall and John Grymes, and against the
executors of Isaac Meynell, the said Whitehall and
Grymes having been security with said Meynell,
their late partner, who was Receiver General in
London, Westminster and Middlesex of the late
subsidy : they having been charged with the receipt
of 50,841l. 5s. 10d. of which they have paid all
except 434l. 2s. 3d., which sum they left with John
Watts, who was head collector of that tax in
Westminster and Middlesex, to be paid into the
Exchequer and clear the account, but said Watts
having since run away with said money.

profits, as well of the Queen's jointure as of other
revenues of the Crown (many of which arrears now

and other accomptants of said revenue (many of
whom are in arrear and have not answered their
just debts) : the said Queen's Council having
complained hereof and desired the assistance of
the Lord Treasurer herein. In case of refusal, etc.,
you are to levy by distress, or take into custody.

Windsor Castle. The Dean and Canons of Windsor
have a prebendal house situate on the outwall of the
castle, and in a ruinous and decayed condition, and
desire it to be repaired by the officers of the Castle
Works. "And whereas I being willing to be satisfied
by whom the said wall ought to be repaired, did desire
his Majesty's Attorney General to examine what
records or other matter the said Dean and Canons
could produce for their discharge herein." Upon a
view of several proceedings in 1606 he has reported
that the wall is to be repaired by his Majesty
and the said Dean and Canons are to have in the
wall so to be repaired such lights for easiments
of their houses as antiently they had, which lights
are to be by them maintained. You are therefore
to repair said wall.

(4) You are to have a second trial (at the King's
charge) with the Farmers of the Prizage and
Butlerage as to whether wines imported by natives
in foreign shipping be liable to the duty of Prizage
and a bill of discovery is to be established against
them to give an account "of what money they have
received for the duty of Butlerage which belongs
to his Majesty." (5) You are to permit Abraham
Dixon to ship at Newcastle the like quantity of
coals for over sea as he has already paid the over-sea
duty for, but by stress of weather was forced to
unlade in the Isle of Wight. (6) You are to cause
Mr. Aslaby, collector of Bridlington, to be discharged
of the sum surcharged on him by Mr. Dawson
for omitting to receive 8s. 9d. per chaldron for
coals exported in a foreign-built ship, his omission
arising from want of advice to govern him therein.

Instruction from Treasurer Danby to Sir John Shaw,
Surveyor of the Act of Navigation, to observe an
order in Council as follows.
Prefixing : Said order of the king in Council dated
July 28 that the Principal Secretaries of State
do cause lists of all such warrants as have passed
their respective offices under the sign manual and
privy signet for making foreign-built ships free
since the last Dutch war to be transcribed and
sent to Sir John Shaw, Surveyor of the Act of
Navigation, who is hereby required to compare
the same with the entries of the warrants in his
office for making ships free, and if he shall find
any warrants there entered which are not contained
in the lists so sent him by the Secretaries of State,
that he make a schedule of such, and present same
with all convenient speed to Treasurer Danby,
who is to give order for the stop of all such ships
mentioned in the said schedule as soon as they
shall come into any ports of this kingdom, and
having caused their particular cases to be examined,
then to make report thereof to the king in Council.
