L. President chose Speaker for Lord Mohun's Trial.

The House unanimously chose the Lord President Speaker, for the Trial of the Lord Mohun, pursuant to the Order of the House.

Who took his Place on the Woolsack.

And then he presented a Commission from His Majesty, for Speaker; which was read, as followeth; vi delicet

To Our Right Trusty and Right Well-beloved Cousin and Counsellor Thomas Marquis of Carmarthen, President of Our Council, Greeting: Know ye, that We, trusting in your approved Fidelity, Wisdom, and Discretion, and to the End such Matters and Business as to the Place and Room usually supplied by the Lord Chancellor or Lord Keeper of the Great Seal of England, in Our Upper House of Parliament, may be in all Things executed as appertaineth, in the said House of this present Parliament now holden at Westminster, amongst the Lords Spiritual and Temporal there assembled, as by the said Lord Chancellor or Lord Keeper hath been accustomed; We have named and appointed, and by these Presents do constitute, name, and authorize you, from Day to Day, and from Time to Time hereafter, during Our Pleasure, to use, occupy, and supply, the said Room and Place of the said Lord Chancellor or Lord Keeper, in Our said Upper House of Parliament, amongst the said Lords Spiritual and Temporal there assembled; and then and there to do and execute all such Things as the said Lord Chancellor or Lord Keeper of the Great Seal should or might in that Behalf do, if he were there personally present, using and supplying the same Room: Wherefore We will and command you the said Marquis of Carmarthen to attend and execute the Premises with Effect; and these Our Letters Patents shall be your sufficient Warrant and Discharge for the same, in every Behalf. It was moved, "To know, Whether, if any Lord came after the Evidence given, he shall be called to give his Vote?"

And it was also moved, "How the Counsel or Witnesses shall address themselves; whether to the Lord High Steward, or to the Lords?"

ORDERED, That the Prisoner, Counsel, and Witnesses, shall address themselves to the Lords; and that the Lord High Steward be desired to let them know it.

ORDERED, That the Lord Great Chamberlain do take Care to clear the House in the Hall.

Lords go to Westm. Hall.

Then the House was called over; and all the Lords present answered to their Names.

Which done, the Speaker adjourned into Westminster Hall.

Then the Lord High Steward went to the Chair.

L. Mohun at the Bar.

Proclamation was made, for bringing the Prisoner to the Bar, and his Precept.

Who being come, the Lord High Steward asked Leave to come to the Woolsack.

And the Lord High Steward told him, "He was not to hold up his Hand when arraigned;" and acquainted the Prisoner, Counsel, and Witnesses, "That they must address themselves to the Lords."

And then he acquainted the Lord Mohun upon what Account he was brought hither.

Which being done;

Indictment read.

The Indictment was read to the Lord Mohun again, by the Clerk of the Crown, in English.

Arraigned.

Then he was arraigned, and asked, "Whether Guilty, or Not guilty?" He said, "He was Not guilty."

And being asked, "By whom he would be tried?" He said, "By GOD, and his Peers."

Proclamation was made, for Witnesses to be brought into Court.

Then the Lord Mohun desired Pen, Ink, and Paper.

Which was allowed.

Counsel and Witnesses examined, and Counsel for the King heard.

Mr. Serjeant Thompson opened the Indictment; and Mr. Attorney and other Counsel and Witnesses were heard on His Majesty's Behalf; as also Witnesses for the Prisoner; and Mr. Solicitor heard, to sum up the Evidence.

Lords adjourn to the House.

The House was adjourned to the House of Peers; and the Lords and Attendants went back in the same Order as they came down.

The Lords being come to the House of Peers, the Lord High Steward resumed the House.

Bishops Protestation delivered.

Then the Lord Archbishop of Canterbury, for himself and the rest of the Bishops, delivered in a Protestation; which they desired may be entered.

Which was read, as followeth:

"The Lords Spiritual of the House of Peers do desire the Leave of this House, to be absent from the Trial of the Lord Mohun; by Protestation, saving to themselves and their Successors all such Right in Judicature as they have by Law, and of Right ought to have."

Then the Bishops asked Leave to withdraw;

Which was granted.

House not to proceed in L. Mohun's Case:

Upon Debate,

"Whether the House shall now proceed in the Case of the Lord Mohun?"

This Question was put, "Whether the House shall now go on?"

It was Resolved in the Negative.

"Dissentient:

Protest against that Resolution.

"Because it may be of dangerous Consequence, in Case of Blood.

After the abovesaid Question, the Orders following were made:

Peers absent when the House called.

"It being moved, To consider what shall be done to any Peer or Peers that shall be absent upon calling over the House presently: It is ORDERED, by the Lords in Parliament assembled, That all the Peers that were present at the Trial of the Lord Mohun, and are now absent, shall severally pay One Hundred Pounds to the Clerk of the Parliaments, to be disposed of for the Benefit of the Poor of the Parishes in Westminster; and, in Default of Payment thereof on or before this Day Sevennight, they shall be committed to The Tower of London."

Lords present at the Trial, called over.

Then the Peers being called over that were present at the Trial this Day; and the Earl of Fauconberge, Lord Viscount Newport, Lord Lovelace, and the Lord Leigh, being absent; the following Order was made:

Lords present at the Trial, and absent now, fined 100 1. each.

"ORDERED, by the Lords in Parliament assembled, That Thomas Earl of Fauconberge, Francis Lord Viscount Newport, John Lord Lovelace, and Thomas Lord Leigh, who were now absent at the Calling of the House after the Adjournment out of Westminster Hall, shall severally pay, or cause to be paid, to the Clerk of the Parliaments, the Sum of One Hundred Pounds, to be disposed of to the Poor of the Parishes in Westminster; and, in Default of Payment thereof on or before Tuesday the Seventh Day of February, next, they shall be committed to Their Majesties Tower of London; and that the abovesaid Lords be summoned to attend the House To-morrow, at Ten of the Clock in the Forenoon."

Peers at the Trial, if absent Tomorrow, to be committed.

ORDERED, by the Lords in Parliament assembled, That if any Peer or Peers who were this Day present at the Trial of the Lord Mohun, shall be absent, and not attend this House To-morrow; he or they shall be committed to Their Majesties Tower of London.

L. Mohun remanded:

It is ORDERED by the Lords in Parliament assembled, That Charles Lord Mohun shall be, and he is hereby, remanded Prisoner to Their Majesties Tower of London.

To the Right Honourable Rob't Lord Lucas, Chief Governor of Their Majesties Tower of London, his Deputy and Deputies.

To be brought To-morrow:

ORDERED, by the Lords in Parliament assembled, That the Lord Lucas, Chief Governor of Their Majesties Tower of London, do bring Charles Lord Mohun, now Prisoner there, to the Bar of this House in Westminster Hall, To-morrow, at Ten of the Clock in the Forenoon.

Counsel and Witnesses to attend.

ORDERED, by the Lords in Parliament assembled, That Their Majesties Counsel, Witnesses, and all other Persons concerned in the Lord Mohun's Trial, shall attend this House To-morrow, in Westm. Hall, at Ten of the Clock.

Consideration of the absent Peers adjourned.

ORDERED, by the Lords in Parliament assembled, That the Consideration of what shall be done to the absent Lords that were summoned, shall be adjourned until after the Trial of the Lord Mohun.
