A Message was brought from the House of Commons, by Mr. Hemingham and others:

To desire Concurrence in an Ordinance concerning the associated Counties of Norff. and Suff. &c.

The Answer returned was:

That their Lordships will presently take this Ordinance into Consideration, and send an Answer by Messengers of their own.

Ordinance for associating Oxon, Berks, and Bucks.

The Earl of Northumb. reported, "That the Committee have considered of the Ordinance concerning the associated Counties of Oxon, Buks, and Berks, for settling of Committees there; and they think it fit to pass, with a few Amendments:"

And the said Ordinance with the Alterations were read, and Agreed to with these Amendments, and Ordered to be sent down to the House of Commons, to desire their Concurrence therein. (Here enter it.)

Order for 500 l. to Windsor.

Next, the Order to pay Five Hundred Pounds to Windsor Garrison was read, and Agreed to.

Message to the H. C. that the Lords agree to the Ordinance for associating Oxon, &c.;

A Message was sent to the House of Commons, by Sir Edward Leech and Dr. Aylett:

To let them know, that this House agrees to the Ordinance concerning Oxon, &c. with the Amendments, and to desire their Concurrence therein.

about the Minister at The Charter House;

2. To put them in Mind of the Business concerning the Minister of The Charter House.

and about Mr. Winn's Assessment.

3. To recommend unto them the assessing of Mr. Wynn for his Twentieth Part, for the Use of the Town of Lyme.

Complaint from the H.C. of a Breach of Privilege, in the Judgement against Col. King.

The Speaker reported the Effect of the Conference lately with the House of Commons, concerning the Breach of the Privilege of Parliament; which was, "That the House of Commons have taken Notice of a Judgement of this House against Colonel Kings, upon a Charge of his undue procuring of Hands to a Remonstrance in the County of Lyncolne; to which Charge the said Colonel Kinge pleaded and demurred; That the Business was depending in the House of Commons before: But their Lordships, notwithstanding the said Plea and Demurrer, proceeded to Judgement against him for the same, without sending to the House of Commons to know of them whether any such Business was depending in that House. The House of Commons, taking this into Consideration, have (fn. 1) passed a Vote, videlicet,

"Resolved, upon the Question, by the House of Commons, That the Lords proceeding to Judgement against Colonel Edward Kinge, after his Plea pleaded that the Cause (fn. 2) was depending here, is a Breach of the Privilege of this House.

"It was further said by the House of Commons, That this is not only a Breach of the Privilege of Parliament, but of the Liberty and Right of the Subject, who are to have Liberty to appeal to the Parliament for the presenting of their Grievances, that so they may have Redress."

Ordered, That this House will take this Business further into Consideration on Friday Morning next.

Ordinance concerning Leicestershire.

Ordered, That the Committee for the Leycestershire Ordinance shall meet this Afternoon, at Three of the Clock; and the Earl of Lyncolne is added to this Committee.

Mr. Rous's Cause.

Ordered, That the Committee concerning Mr. Rouse's Report shall meet this Afternoon, at Four of the Clock; and the Lord Wharton and the Lord North are added to the said Committee.

Bickley and his Wife.

Ordered, That Bickeley, a Prisoner in The Fleete, shall be brought to this House on Saturday next, in the Morning, to be heard what he can say concerning the Order of this House, made between him and his Wife.

Order for 500 l. for the Garrison of Windsor.

"It is this Day Ordered, by the Lords and Commons, That the Committee at Habberdashers Hall do, at the End of Three Months, or sooner if it may be, pay Five Hundred Pounds for the Garrison of Windsor, with Consideration for Forbearance in the mean Time."

" (fn. 3) An Ordinance of the Lords and Commons assembled in Parliament, to appoint and enable Committees, in the several Counties of Buckingham, Oxon, and Berks, to put in Execution this present Ordinance, and several other Ordinances of both Houses of Parliament.

Ordinance to associate the Counties of Bucks, Oxon, and Berks, and to raise Money there, &c.

"For the better Execution of the Orders and Ordinances of Parliament, in the several Counties of Berks, Buckingham, and Oxon, and for the raising of Money and Forces within the said Counties, for suppressing the Rebels there, and for the Maintenance of all such Garrisons within the said Counties as are or shall be erected by Authority of Parliament, for the better Defence of the same; the Lords and Commons assembled in Parliament do hereby constitute and appoint,

Berks.

"For the County of Berks; William Lenthall Esquire, Speaker of the House of Commons and Master of the Rolls, Sir Francis Knollis Knight Sir Francis Pile Baronet, Sir Robert Pye Senior, Sir Benjamin Rudyard, Richard Whitehead, Edmund Dunch, Henry Martin, Peregrine Hobby, Tanfield Vachell, Daniel Blagrave, Serjeant Major General Richard Browne, William Ball, John Packer Senior, Robert Packer, and Cornelius Holland.

"For the County of Oxon; Thomas Lord Viscount Wenman, William Lenthall Speaker of the House of Commons and Master of the Rolls, James Fines, John Fines, Esquires, Sir Peter Temple Knight and Baronet, Sir William Cobb Knight, John Doylie, Thomas Knight, William Typping, Robert Scrope, Edward Clerke, Edmund Dunch, and Bulstrode Whitlocke, Esquires, Sir Peter Wentworth Knight of the Bath, Sir Nathaniel Brent Knight, and Serjeant Major General Richard Browne:

"To be Committees of Parliament for the said several Counties respectively; and do hereby authorize them, or any Three of them respectively, to put in Execution, within the said several and respective Counties, the several Ordinances of Parliament ensuing; videlicet, the Ordinance for voluntary Loans and Contributions to the Parliament, the Ordinance for Weekly Assessments, the Ordinance for the Fifth and Twentieth Part, the Ordinance for the Sequestration of Papists and Delinquents Estates, according to the true Meaning of the said Ordinances; and the said Committees of the several Counties, or any Three or more of them respectively, shall have Power, within their several Counties, to assess, tax, and levy, or cause to be assessed, taxed, and levied, upon the said Counties, what Sum or Sums of Money they shall think the said Counties are severally able to pay, not exceeding Four Hundred Pounds a Week upon any One of the said Counties, with such Power for the assessing, levying and collecting the same, and with such Allowances, as by the Ordinance of the Weekly Assessment is provided: And it is hereby Declared, That the several Sums of Money, raised, or to be raised, within the said Counties, and also all such Sums of Money as shall be hereafter raised within the said several Counties by virtue of the Ordinances of Excise, be received and disposed of, for the raising and maintaining of all such Forces as are or shall be raised, for the Reducing and Defence of the several Counties aforesaid.

And it is further Ordained and Declared, That the several Committees, or the major Part of them, within their several Counties respectively, shall appoint a Treasurer, who shall receive all such Monies as shall be assessed and collected within the said Counties respectively, and shall from Time to Time issue out such Monies, for the necessary Uses of the said Counties, for the Purposes aforesaid, as any Three or more of the Committees of the said Counties respectively shall, by the Vote of the major Part of the respective Committees, or of any Three of them then present, order, and shall by Writing under their Hands appoint, and not otherwise.

"And it is also Ordained, That every Collector shall have Four Pence in the Pound for every Sum of Money by him collected and paid to the Treasurer; and also Two Pence in the Pound shall be allowed to the Treasurer for all Monies by him received and issued out by Warrant as aforesaid: And be it Ordained, That the said Committees, or any Three of them respectively, shall have Power, from Time to Time, to assign, and by their several Ministers and Officers to cut and take, sufficient Timber, standing or being upon the Lands of Papists or Delinquents, for the making of Fortifications in such Towns and Places of any of the said Counties, as by Three or more of the Committees of every of the said Counties respectively shall be thought fit, expressing the same by Warrant under their Hands.

And be it further Ordained, That the Committees of the said Counties, or any Three of them respectively, shall hereby have Power and Authority from Time to Time to demand and take an Accompt of all Musters that shall be made by the several Commissaries of the said Counties; and that every Captain both of Horse and Foot, and every other superior or inferior Officer, whose Pay comes to Ten Shillings a Day or above, shall take but Half the Pay due unto him, and respite the other Half upon the Public Faith, until the War shall be ended; and every Officer, whose Pay cometh to Five Shillings a Day or more, and under Ten Shillings a Day, shall accept of Two Parts of Three of such Pay due unto him, and respite the other Third Part upon the Public Faith, until the War be ended; and when there is Three Months Pay due unto any of them, a Certificate thereof under the Hands of the said Committees, or any Three of them respectively, shall be a sufficient Warrant to such Officer to demand and receive the said Monies owing upon the Public Faith as aforesaid.

"And be it further Ordained, That Nine or more of the Committees aforesaid, whereof Three at least of every of the said Counties respectively, shall have Power to assemble themselves together as often as they shall think fit, to advise and direct all Things that they shall think fit, for the more speedy and effectual Execution of this Ordinance, in all or any of the said Counties.

"And be it likewise Ordained, That the Committees of the said several and respective Counties, or any Five or more of them respectively, shall have Power to secure the Persons of all dangerous Delinquents residing in the said several Counties, and to call before them, or any Five or more of them respectively, all Ministers and School-masters that are scandalous in their Lives, or ill-affected to the Parliament, or that have deserted their Cures, or ordinary Places of Residence, not having a sufficient Ground for their Absence; and they, or any Five or more of them respectively, shall have Power to examine any Complaint against them, upon the Oaths of such Persons as shall or may be produced to give Evidence against them; and the said Committees, or any Five of them respectively, shall have Power to administer such Oath accordingly, and shall have Power (upon Proof of their Delinquency) to remove such as they, or any Five or more of them respectively, shall judge unfit for their Places, and sequester their Estates and Revenues, and to place other well-qualified Persons in their room, such as shall be approved by Three Godly and Learned Divines residing in any of the said Counties respectively.

"And be it Ordained, That the said Committees, and every One of them respectively, and every other Person or Persons that shall be aiding or assisting to them, or any of them respectively, in the doing or executing any Thing by virtue of this Ordinance, shall be defended and saved harmless therein, by Authority of both Houses of Parliament.

"And be it further Ordained, That the said Committees in the said several Counties, or any Three or more of them respectively in each several County, shall have Power to administer the National Covenant to such Person or Persons as they shall think fit; and to send up all such as shall refuse to take the same Covenant unto the Committees of Parliament for Examinations, to be proceeded against as the said Committee of Examinations shall think fit.

"And be it further Ordained, That there shall not any Monies or Provision be raised, in any of the said Counties, during the Continuance of this Ordinance, by virtue of any former Ordinance or Order, other than such as shall be employed for the Purposes, and in such Manner, as in this present Ordinance is provided.

"And be it further Ordained, That the Persons herein named for Committees, or any other Person or Persons, who have advanced, or shall advance, any Horses, Plate, Arms, or Money, or maintain any Soldiers, Horse or Foot, for this Service, shall be fully satisfied and re-paid all such Monies as they shall disburse, with Interest after the Rate of Eight Pounds per Cent. and the Value of such Horses, Plate, and Arms, as they shall furnish and maintain for this Service, out of the Monies to be raised by the new Excise, and out of such Monies as shall be raised by virtue of this Ordinance; which Payments shall be made to them by such Treasurer or Treasurers, that shall be appointed for the several Counties aforesaid respectively, upon a Warrant given to that Purpose by Three or more of the said Committees in each County respectively.

"Ordered, by the Commons assembled in Parliament, That this Ordinance be forthwith printed and published.
