Prayers.

Forefeited Estates.

THE House, according to former Order, this Day resumed the Debate upon the Amendments to the Bill for Sale of several Lands and Estates forfeited to the Commonwealth for Treason.

Mr. Garland reports from the Committee to whom the said Bill was referred, the Resolution of the said Committee; viz. "Provided always, that this Act shall not extend to take away the Benefit of any Articles of War; but the full Benefit of such Articles, and all Complaints thereupon, are hereby reserved to the several Persons interested therein, as fully and amply, as if this Act had never been made."

Resolved, That the Word "are" be put into this Clause, instead of the Word "expect."

The Question being propounded, to agree to the said Resolution of the said Committee, so amended;

And the Question being put, That this Question be now put;

The House was divided.

The Noes went forth.

So it passed with the Negative.

Resolved, That the first Four hundred thousand Pounds that shall be raised upon this Bill, either by Composition or Sale, shall go to the Use of the Publick only, for the Supply of the Army, Navy, and Stores.

Resolved, That this Report be re-committed, upon the Debate of the House: And that the Committee do consider, how those Persons, who have any Charge upon this Bill, or such of them as they shall think fit, may be satisfied by Lands in Scotland or Ireland: And to report their Opinion to the House.

Ordered, That it be referred to the same Committee, to consider how Lands, either in Scotland or Ireland, which have been, or shall be, granted by the Parliament, may be conveyed; and present their Opinion therein to the Parliament; and to bring in an Act to that Purpose, if they see Cause.

The Question being put, That the Proviso concerning Colonel Rookesby do stand in this Bill;

It passed with the Negative.

The Question being put, That the Proviso touching the Earl of Salisbury do stand in this Bill;

It passed with the Negative.

Ordered, That the Cases of Colonel Rookesby and the Earl of Salisbury be referred to the same Committee, to consider of them as of the rest of the Persons who have any Charge upon this Bill.

Claims from Cheshire.

Sir Wm. Brereton reports from the Committee for Cheshire.

WHEREAS, upon the 16th of July 1652, upon Report made touching the Cheshire Gentlemens Engagements, it was Ordered, by the Parliament, that the several Sums of Seven hundred Fifty-one Pounds One Shilling, and of Two thousand One hundred Forty-five Pounds Eighteen Shillings and Four-Pence, should be allowed unto them as a Debt due by the Commonwealth; and referred it back again to this Committee, to consider how, and in what Manner, and out of what, the said Sums may be paid; and report it to the House:

Upon serious Debate had this Day, of the whole Business, this Committee humbly offer it as their Opinion, That Fifteen hundred Pounds, part of the aforesaid Sums, be charged upon the Treasury for Sale of Delinquents Estates, and the rather, for that the whole Sum of Four thousand Ninety-two Pounds was formerly, by Order of Parliament of the 21th of August 1648, charged upon the Moiety of the Excise in Course, and upon Delinquents Estates; and that the Residue of the said Sums, being One thousand Three hundred Ninety-six Pounds Nineteen Shillings and Four-pence, together with the Interest and Charges of Suits, by them to be incurred since the Report made the said 16th of July 1652, may be charged upon such Lands in Ireland as the Petitioners shall propose; and that the same be set out, by the Commissioners of Parliament for managing Affairs in Ireland, in as large and ample Proportion, and with as large Privileges, as was to be allowed to any Adventurer or Adventurers by any Act of Parliament in 1641 or 1642, or by an Ordinance of Parliament made the 14th of July 1643; and that in the mean time, till they be possessed of the said Lands, they may be allowed, out of the said Lands in Ireland, Consideration for the Interest of the said One thousand Three hundred Ninety-six Pounds Nineteen Shillings and Four Pence, and of the said Fifteen hundred Pounds; as also of what unavoidable Charges, in Suits of Law, shall be incurred, before Satisfaction, as aforesaid: And that the said Commissioners do settle them, or their Assigns, in the quiet and peaceable Possession thereof.

Resolved, by the Parliament, That this Report be committed to the same Committee, to consider of this Case, as of the rest of the Persons who have any Charge upon this Bill.

Resolved, That the Two Provisoes from GoldsmithsHall be committed to the same Committee to consider thereof; and bring them in To-morrow Morning.

Navy Office.

Mr. Nelthorp reports from the Committee of the Navy; viz.

IN pursuance of an Order of Parliament, of the 21th of this Instant September, whereby it is referred unto this Committee to consider of the Salaries allowed to the Register-Accomptant, and of Persons fit to execute the said Office;

Resolved, That it be reported to the Parliament, as the Opinion of this Committee, That Mr. Philip Tandy, Mr. Wm. Benson, and Mr. Edward Green, be appointed to the said Office of Register-Accomptant, in the Place of Colonel Robert Manwaring, deceased, in reference to all and every the Accompts by him kept; as also for examining and approving of all Debentures, before they be allowed by the respective Trustees sitting at Gurney, Worcester, and Drury Houses: And that, in Consideration of their Care and Pains to be taken therein, there be allowed unto them the Sum of Six hundred Pounds per Annum, to be equally divided amongst them, for themselves and their Clerks, payable quarterly by the Treasurer for Delinquents Estates: And that all Salaries and Allowances formerly granted to Colonel Manwaring, as RegisterAccomptant, or unto Mr. Tandy, as Examiner of Debentures, or to either of them, or to any of their Clerks, be henceforth taken away.

Resolved, by the Parliament, That Philip Tandy, William Benson, and Edward Green, be appointed to the Office of Register-Accomptant, in the Place and Stead of Colonel Robert Manwaring, deceased, in reference to all and every the Accompts by him kept; as also for examining and approving of all Debentures, before they be allowed by the respective Trustees sitting at Gurney, Worcester, and Drury Houses.

Resolved, That, for their said Service, there be allowed unto them the Sum of Six hundred Pounds per Annum, to be equally divided amongst them, for themselves and their Clerks, payable quarterly by the Treasurer for Delinquents Estates.

Resolved, That all former Salaries and Allowances, granted to Colonel Robert Manwaring, as RegisterAccomptant, or unto the said Philip Tandy, Wm. Benson, and Edward Green, or any of them, or to any of their Clerks, shall henceforth cease.

Resolved, That a Certificate under the Hands of the said Philip Tandy, William Benson, or Edward Green, or any one of them, shall be a sufficient Voucher unto the Treasurers of the respective Offices to proceed thereupon, to the Receiving of the Money or Bills doubled upon any of the Securities, according to the former Acts and Ordinances of Parliament in that Behalf made.

Resolved, That it be referred to the Committee to whom the Delinquents Bill is committed, to prepare a Clause upon these Votes, to be inserted into this Bill.
