Instructions for Reprizals.

The Earl of Warwicke reported from the Committee for the Admiralty, "That they have considered of the Instructions for the Reprizals, and find it somewhat defective; for the Supply thereof, they offer some Alterations to this House; videlicet,

"In the Fourth Folio, and Line 4, after the Word [" Ireland"], insert these Words ["and also the Ship and Goods of any other Person whatsoever, Foreigner or other'].

"In the same Folio, Linea 7^a, after the Words ["belonging to"], leave out the Words [" the Subjects of any"], and insert these Words ["any Foreigner or"].

"In the same Folio, Linea 10^a, after the Word [Parliament"], insert these Words ["and adjudging and condemning the same, together with the Goods themselves, and all such other Goods as belong to the Master or the Laders of such Contrabanded Goods"].

"And that this Ordinance be intimated to the Foreign Ambassadors and Agents, and published upon The Exchange."

Ordered, That this House agrees to these Alterations; and that the Concurrence of the House of Commons be desired herein.

L. Savill to be released upon Bail, on account of his Health.

The Petition of the Lord Savill was read; shewing,

"That, after a long Imprisonment, he is fallen into a very desperate Condition of his Health; and that he is assured by his Physician (the sworn Physician of this Place), that the Hope of his Life and Cure will much depend upon his being removed to some House in the Town, where he may have Liberty to take the Air, have Opportunity of Help, and enjoy some Quiet of Mind and Spirit; as will appear by his Certificate, which he humbly annexeth:

"Therefore the Petitioner beseecheth their Lordships, that his sad Condition may be taken into Consideration; and to grant him his Liberty, until he shall have recovered his Health, or it shall be otherwise thought fit to return him back to this Place; which he will engage his Honour to perform, whensoever he shall have Notice thereof from the Lieutetenant of The Tower; and in the mean Time to be his true and faithful Prisoner, under such Limitations as this House shall think fit."

The House taking into Consideration, that the Lord Savill stands committed for his Contempt to the Commands of both Houses of Parliament, which this House is sensible of; yet, in Consideration of the great Indisposition of Health now upon the Lord Savill, this House is willing to give the Lord Savill Leave to be for a Time in some convenient Place in or near London, for the Means of the Recovery of his Health; he giving good Security to render himself again at The Tower when his Health shall be recovered; and desire the Concurrence of the House of Commons herein.

Committee to meet about him.

Ordered, That the Committee for the Lord Savill do meet on Thursday next, in the Afternoon.

Answer from the H. C.

Doctor Aylett and Dr. Heath returned with this Answer to the Message sent Yesterday to the House of Commons:

That they agree in referring the King's last Message to the Scotts Commissioners: Touching the other Particulars, they will send an Answer by Messengers of their own.

Message to them, with the Instructions for Reprizals.

A Message was sent to the House of Commons, by Dr. Aylett and Dr. Heath:

1. To desire their Concurrence in the Alterations to the Instructions concerning the Reprizals; and that it be published.

about releasing L. Savill upon Bail;

2. To communicate the Lord Savill's Petition to them; and to let them know, that this House is very sensible of the Contempt which the Lord Savill lies under; yet, in regard of his extreme Weakness and Indisposition of Body, their Lordships are content to give him the Liberty to remain in any private House, either in or near the City of London, as he shall choose; he putting in sufficient Bail to return again to The Tower when he shall have recovered his Health.

3. To desire that the Committee appointed about the Lord Savill may meet on Thursday next, in the Afternoon, in the Prince's Lodgings.

5. To deliver to them the Petition of Sam. Basnett, touching Twenty Pounds, which should be paid to him (fn. 1) by the City of Coventry, as being a Scholar according to the Foundation of Sir Tho. White; and to recommend (fn. 1) it to them.

Scots Paper, complaining of Calumnies.

Ordered, The last Scotts Paper shall be taken into Consideration on Thursday Morning next.

Ld. Balmerino to be admitted to the Assembly.

Ordered, That this House thinks it fit, that the Lord Balmerino be admitted to the Assembly of Divines, as the rest of the Scotts Commissioners are; and the Concurrence of the House of Commons to be desired herein, by this Message now going down, by Doctor Aylett and Doctor Heath.

Church Government.

Ordered, That the Business concerning Government shall be taken into Consideration on Thursday Morning next.

Ordinance to pay 32,000 l. to the City.

The Ordinance for the Thirty-two Thousand Pounds to be paid to the City, out of the Excise, was read the Second Time, and committed to these Lords following:

Any Five, to meet on Thursday next, in (fn. 1) the Afternoon, at Three of the Clock.

Sir G. Penruddocke & al. a Pass.

Ordered, That a Pass shall be granted to Sir George Penruddocke and his Lady, with Two Children, Two Nurses, Dorithy Hungerford, John Hungerford, Edward Lamplugh, John Petty, with a Coach and Four Horses, One Groom, Three Saddle-horses, Two Maids, Anne Poole, Mary White, and a Guide.

North'ton Committee, Petition for their Allowance.

Upon reading the Petition of divers of the Committee for the County of North'ton; shewing, "That they have been faithful and diligent in the Service of the Parliament; therefore desire that some Course may be taken for the Payment of that Allowance which is mentioned in the Ordinance of Parliament:"

It is Ordered, That it be specially recommended to the House of Commons, by the next convenient Opportunity.

Order for the Mayor, &c. of Coventry, to pay Basnet Money, pursuant to Sir T. White's Will.

"The humble Petition of Samuell Basnett, Student of Emanuell Colledge, was this Day read: And it is Ordered, by the Lords and Commons in Parliament assembled, That the Mayor and Aldermen of the City of Coventry, or the Committee of Sequestrations respectively, whom it doth or may concern, do forthwith pay unto Samuell Basnett, now a Student of Emanuell Colledge, in Cambridge, the Twenty Pounds per Annum, payable, with the Arrears, unto him, upon the Gift of Sir Tho. White, bequeathed by his last Will, long since made; the Case standing so, in regard of these Distractions, he cannot make himself a Student of St. John's Colledge in Oxford, now being the King's Head Quarters, according to the Direction and Intimation of the said last Will."
