Riot at Whittlesey.

Ordered, That the Persons that have committed the Riot at Whittlesey shall be brought before this House on Friday next; and then their Lordships will examine the Business.

Message from the H. C. to sit P. M.

A Message was brought from the House of Commons, by Sir Wm. Armyn:

That they have Resolved, upon some very important Business, To sit this Afternoon, (fn. 1) at Two of the Clock; and they desire their Lordships would sit likewise, if it may stand with their Lordships Conveniency.

The Answer returned was:

Answer,

That this House will sit at Three of the Clock this Afternoon.

E. of Chesterfield to remain in London, on his Parole.

The House being informed, "That the Earl of Chesterfeild, having given his Word, upon his Honour to my Lord Gray, for to render himself a true Prisoner to this House, and accordingly he is come up to London; but, in regard of his great Indisposition of his Health, and Disability to endure a Prison, his Lordship's Desire to this House is, that he might obtain the Favour of their Lordships to continue a true Prisoner where he now is:" Hereupon this House Ordered, That the Earl of Clare shall have Authority from this House, to let the Earl of Chesterfeild know, "That, if he will pass his Word, upon his Honour, to be a true Prisoner, and not depart out of the Cities of London and Westm. without acquainting this House therewith, and appear before this House at a Day's Warning, after Notice given, that then their Lordships do give Way that his Lordship shall remain where he now is, a Prisoner."

Ordinance concerning Gunpowder.

The House took the Ordinance concerning Gunpowder and Salt-petre again into Consideration, and re-committed the same unto these Lords: videlicet,

Ordinance concerning the Treatment of Prisoners.

Next, the Ordinance for the Usage of Prisoners was again considered of; and Ordered, To be re-committed to the Committee for Salt-petre and Gunpowder, who are to consider of a Regulation how Prisoners on both Sides are equally to be used; and that a Difference may be made of Prisoners taken in War, and such as are not; and, this being Resolved of, to be published.

Ordered, (fn. 2) That this Committee meet this Afternoon, at Two a Clock.

Ordinance for an Assembly of Divines, to settle the Doctrine of the Church.

The Earl of Northumb. reported from the Committee, the Ordinance for calling an Assembly of Godly and Learned Divines, wherein the Committee have thought fit to make some Alterations, and add a Proviso; which, being read, this House approved of.

The Alterations were these:

"Linea 18, leave out the Word ["Scotland"], and it runs thus ["and a nearer Agreement with all the other reformed Churches abroad"].

"Doctor Wincupp of St. Martins in the Feilds, Mr. Price of St. Paules Church in Covent Garden, Mr. Henry Wilkinson, Batchelor in Divinity, To be added to the Divines.

"That Ten Peers be added, and a proportionable Number of the House of Commons be added.

"In the Title, after the Word ["Divines"], add the Words [and others"].

"Memba 2a, Linea ult. leave out the Words [as aforesaid"].

"Memba 3a, Linea 9a, put out the Word ["Moderator"], and put in the Words ["as Prolocutor"].

"Memba 3a, Linea20a, put out the Word ["Persons,"] and put in the Word [Divines].

"Memba 3a, Linea 27a, put out the Word [Persons"], and put in the Word ["Divines"].

"Provided always, That this Ordinance or any Thing therein contained, shall not give unto the Persons aforesaid, or any of them, any Jurisdiction, Power, or Authority Ecclesiastical whatsoever, or any other Power than is herein particularly expressed.

"That Mr. Wm. Dunninge, of Coldaston, is omitted in this Ordinance, being in the Bill last sent to the King.

"Daniell Feately is named in this Ordinance ["Nath. Featly"].

"Doctor John Wincupp, Doctor Ric'd Oldsworth, is omitted in this Ordinance."

These Alterations being read, this House approved thereof.

Ordered, This House will nominate a Committee of Lords, to sit with the Divines in the Assembly, To-morrow Morning.

Kecke, a Pass.

Ordered, That Thomas Kecke, Servant to Wm. Bridges Esquire, shall have a Pass, to go to Oxford, and return to London, and carry and bring back Writings, as Leases, and Bonds, &c.

Captain Weldon, a Pass.

Ordered, That Captain Weldon shall have a Pass, to travel beyond the Seas.

Adjourn.

House adjourned till 3a post meridiem.

Ordered, That Mr. George Lassell shall have a Pass, to go into Nottinghamshire, and return again to London.

Byard and Searles, a Pass.

Ordered, That Mr. Thomas Byard and Mr. John Searles, with Two Saddle-horses, or with a Coach, shall have a Pass, to go to The Bath, and return again without any Molestation to London.

Countess of Devon, a Pass.

Ordered, That the Countess of Devon shall have a Pass, with her Coach and Horses and Servants, to go to Oxford.

Mrs. Walter's Servant, a Pass.

Ordered, That a Servant of Mrs. Waller shall have a Pass, to go into Pembrookshire, about her Affairs.

Fayrye & al. Woodmongers and Carmen of London.

Upon Petition of Tho. Fayrye, &c. for themselves and others, Woodmongers and Carmen of London; shewing, "That the Differences between them we rereferred to the Consideration of some Persons as are at Oxford, and so cannot (fn. 3) attend the Hearing of the Business; therefore desired that their Lordships would nomiminate other (fn. 4) Referees:" It is hereupon Ordered, That Mr. Alderman Towse, Mr. Alderman Gibbs, and the now Recorder of London, are appointed Referees, to hear the Business.

Ordinances concerning Gunpowder, and Treatment of Prisoners.

The Lord Wharton reported from the Committee, "That they have considered of the Ordinances concerning Salt-petre and Gunpowder, and the Usage of Prisoners, wherein their Lordships have thought fit to make some Alterations;" which being read, this House agreed to the said Ordinances, with these Alterations.

Message to the H. C. that the Lords will adjourn.

A Message was sent to the House of Commons, by Sir Edw. Leech and Doctor Heath:

To let the House of Commons know, that their Lordships have fat ever since Three of the Clock, and are resolved to adjourn till To-morrow Morning, at Nine of the Clock, unless they shall have any Business of Importance to come up to this House with.

Adjourn.

House adjourned till 9a cras.
