Message from the H. C. for a Conference on the Covenant from Scotland, and concerning the Excise.

A Message was brought from the House of Commons, by Sir Rob't Harley Knight, and others:

To desire a present Conference; if it may stand with their Lordships Conveniency, touching the Brotherly Covenant sent from Scotland, and touching the Excise.

The Answer returned was:

Answer.

That their Lordships will give a present Conference, in the Painted Chamber, as is desired.

Emperor's Agent, a Pass.

Ordered, That the Emperor's Agent shall have a Pass, to go into Flanders.

Justice Berkley's Trial.

Ordered, That the Trial of Mr. Justice Berkley shall be deferred till To (fn. 1) morrow Morning, at Nine of the Clock.

Message to the H. C. about it.

And a Message was sent to the House of Commons, by Sir Rob't Rich and Mr. Page, to give them Notice of it.

Judges. &c. to attend.

Ordered, That all the Judges and Assistants shall have Notice to attend this House.

Hughes, E. of Warwick s Servant, arrested.

Upon hearing the Complaint of Fulke Hughes, Servant of the Earl of Warwicke, arrested contrary to the Privilege of Parliament, and likewise the Defence of Howett, at whose Debt he was arrested, who denied that Hughes shewed him the Protection of the Earl of Warwicke, until after he was arrested: (fn. 2)

Fuller's Claim on the India Company.

Upon hearing the Treasurer of the India Company, concerning the Complaint of the Widow Fuller: It is Ordered, That the Cause be dismissed this House.

Message from the H. C. with Orderes.

A Message was brought from the House of Commons, by Mr. Ashhurst:

To desire Concurrence in Two Orders:

1. For preventing of the Landing of Irish Rebels in England.

Read, and Agreed to with a small Addition.

2. For ordering of the Forces in Lane, and Cheshire, and appointing an Auditor for the Forces.

That this House agrees to the Order concerning Lanc. and Cheshire; and touching the other, their Lordships will send an Answer by Messengers of their own.

Message to the H. C. with a further Answer.

A Message was sent to the House of Commons, by Sir Edw. Leech and Doctor Aylett:

To let them know, that their Lordships do agree with the House of Commons to the Order concerning the preventing of Irish Rebels coming over, with the Alteration.

For ordering the Forces in Lancaster, &c. and appointing an Auditor for them.

It is this Day Ordered, by the Lords and Commons in Parliament assembled, That the Deputy Lieutenants and Committees of Parliament, in the several Counties of Lancaster and Chester, shall make Choice of One able Person in each County, to be an Auditor, who shall take perfect Accompts of such Monies, and other Goods and Profits, as have been taken or seized by virtue of any Order or Ordinance of either or both Houses of Parliament, or any other Power derived from Parliament, that so there may be a perfect Accompt given to this House, when it shall be called for; and, for that End, the said Auditors shall have Power to send for Parties, Witnesses, and Writings: And it is further Ordered, That the said Deputy Lieutenants and Committees of Parliament, in each of the said Counties, shall likewise make Choice of One able and sufficient Person, to be a Treasurer, unto whom all Monies collected for the Maintenance of the Soldiers in the said Counties shall be paid; who is to issue the same upon Warrant from Seven or more Deputy Lieutenants in either County, or the major Part of the Deputy Lieutenants resident in either County; which Warrants shall not be paid by any respective Treasurer, until the said Warrants be First entered with One of the Auditors, and attested under his Hand: And it is further Ordered, That the said Deputy Lieutenants shall have a special Care, that all the Soldiers be indifferently paid, as well for their Arrears as for the Time to come."
