Absent Lords excused.

D. of Bucks requests that the Commons may have a Copy of his Answer and that he may have Leave to add to it.

The Duke of Buckingham desired the Lords, that, sith the Commons had sent for a Copy of his Answer unto their Charge against his Grace, their Lordships would be pleased to recommend unto them his humble Desire unto their Lordships, for the expediting of their Replication unto the same. And he first moved the House, That he might first add somewhat unto his Answer, touching the Business of Rochell.

Withdraws from the House till his Cause is determined.

And whereas he is accused by a Member of this House (meaning the Earl of Bristol) of Matters of high Nature; he said, he would forbear to fit here until his Cause be heard and determined; which his Grace desired their Lordships to expedite; and so he departed.

Report from the Committee that the Commons may reply.

The Lord Treasurer reported, That the Committee for the Commons met Yesterday in the Afternoon; and found, by many Precedents, to be the usual Course for the Commons to reply unto their Accusation; and that they ought to have a Copy of the Duke's Answer; and that the Commons may send up their Proofs and Witnesses to be examined here.

D. of Bucks adds to his Answer. It is sent to the Commons.

Whereupon the Duke's Answer was delivered unto his Counsel, who made an Addition in the Margin unto the Charge of the Business of Rochell, as the Duke had desired; which being read in the House, the Copy of the said Answer, with the said Addition also thereunto added, was sent to the Commons, by

Mr. Baron Trevor, and Sir Peter Mutton.

With this Message: That it is the Duke's humble Desire unto their Lordships, and their Lordships recommend the same unto them, that the Commons Reply may come up with the soonest.

Committee for Safety and Defence of the Realm.

Upon the Lord Conwayes Motion, the Lords Committees for Defence of the Realm, etc. are to meet on Monday next, in the Morning; and all the Lords Lieutenants of the Shires, and all the Lords of the Council of War, are added to the said Committee.

E. of Bristol Petitions for Witnesses to be examined for him.

The Earl of Bristol exhibited his Petition, that these underwritten might be ordered to appear before their Lordships, to be examined for his Defence: videlicet,

And it was Agreed, That the Clerk should make an Order for all those to appear, who are not of the House of Commons; and the Earl to request those, as of himself, to come to be examined; which if they shall refuse, then this House to send to the Commons that they may come.

King's Counsel to be instructed by the E. of Bristol concerning his Charge against the Duke of Bucks.

It was this Day also Ordered, The Earl of Bristol, with Mr. Maxwell, to have Leave to go to the King's Counsel, at such fitting Place as they shall agree on, to inform them against the Duke of Buckingham; and, if the Earl be sick, then one or more of the King's Counsel to resort to him, and to receive his Informations, and to acquaint the rest therewith; and the King's Counsel are required to appoint an indifferent Place for the said Meeting, and give the said Earl Notice thereof.

Lady Purbeck's Privilege. May's Arrest.

It was this Day Ordered, upon the Petition of Phillipp May, Servant to the Lady Purbeck, That those who arrested him contrary to the Privilege of Parliament shall be brought before their Lordships, to answer their Contempt.

And Memorandum, That Richard Ellwicke (the Lady Purbeckes Servant) informed, that John Bill, Taylor, Nicholas Weekes, and Peter Browne, caused the said Arrest, who were sent for accordingly.

L. Colchester's Privilege. Gray's Arrest.

The Under-Sheriff of Essex (Robert Samon), and Nine others were this Day brought to the Bar, by an Order of the 24th of May last, upon the Complaint of Thomas Gray, Servant to the Right Honourable the Lord Viscount Colchester, to answer their Contempt, for the attaching of the Goods of the said Thomas Gray, upon an Execution. And the said Thomas Gray, being there present, affirmed, that he was not the Servant to the Lord Viscount Colchester.

The Lords taking due Consideration of the said Cause; it was Ordered, The said Under-Sheriff and Nine others to be absolutely discharged of any further Attendance; and the said Serjeant at Arms to keep the said Thomas Gray in his Custody, until he hath paid them all their Charges, and discharged all Fees; the which are to be taxed moderately by Sir Charles Cæsar and Sir Robert Rich.

The Committee on the Bill for Salt-petre are to meet on Monday next, at Eight.

The Committee on the Bill for better Maintenance of Ministers are to meet on Wednesday next, at Two, in the Painted Chamber.
