Lord Carbery against Wilson.
A Petition of Thomas Wilson Esquire, Respondent in a Cause depending in this House, wherein George Lord Carbery of the Kingdom of Ireland is Appellant, which is set down for hearing on a distant Day, was presented, and read; setting forth Delays made by the Appellant, before the Decree appealed from was obtained by the Petitioner; and also setting forth, "That there is another Cause now depending before their Lordships, in which the said Lord Carbery is Appellant, and Edward Weston Esquire and others are Respondents, which was set down for Hearing since the Petitioner's Cause, and which their Lordships, on the Petition of the said Respondents, were pleased to order to be brought forward, and heard on Thursday next; and that giving such Precedence will be a manifest Prejudice to the Petitioner, and may tend to prevent his recovering his Debt, in regard the said Mr. Weston will be thereby enabled (in case the Appeal be dismissed) to prosecute his Decree, and sequester the Estate, prior to the Petitioner; and the said Lord Carbery being only Tenant for Life of all his Estates, the Petitioner will be in Danger of losing his Debt;" and therefore praying, "In regard both Appeals depend upon One and the same Question, and will take up but little Time in Hearing, that their Lordships would be pleased to order the Petitioner's Cause to be brought forward, and heard before that of Mr. Weston, or to make such other Order therein as to their Lordships shall seem meet."
And thereupon the Agents on both Sides were called in, and heard at the Bar.
And being withdrawn:
Ordered, That this House will hear the said Cause on Thursday next, after the Cause wherein the said Lord Carbery is Appellant, and Edward Weston Esquire and others are Respondents, which stands appointed for that Day.
