The Earl of Marchmont reported from the Lords Committees to whom the Bill, intituled, "An Act for vesting the settled Estates of Lillie Smith Aynscombe Esquire and Valentina his Wife in Trustees, to be sold; and for applying the Money arising by such Sale in the Purchase of other Freehold Lands, Tenements, and Hereditaments, to be settled and limited to the like Uses; and for other Purposes in the said Act mentioned," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Ordered, That the said Bill be engrossed.

Molineux's Bill.

The Earl of Warwick reported from the Lords Committees to whom the Bill, intituled, "An Act for carrying into Execution Articles of Agreement, entered into before, and in Consideration of, the Marriage of Crisp Molineux Esquire with Katherine Montgomerie his now Wife," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

With a Bill, intituled, "An Act for enlarging the Term and Powers granted by an Act passed in the Twenty-sixth Year of the Reign of His present Majesty, intituled, "An Act for repairing several Roads leading into the City of Glasgow," so far as the same relates to certain Roads mentioned in the said Act; and also to enlarge the Term and Powers granted by an Act passed in the Twenty-seventh Year of the Reign of His present Majesty, intituled, "An Act to explain, amend, and render more effectual, an Act passed in the Twenty-sixth Year of the Reign of His present Majesty, intituled, An Act for repairing several Roads leading into the City of Glasgow; and to repair several other Roads leading into the said City; and for building a Bridge cross the River of Inchinnan;" to which they desire the Concurrence of this House.

Hodie 2^a vice lecta est Billa, intituled, "An Act for confirming a Partition between William Earl of Dartmouth and Frances Catherine Countess of Dartmouth his Wife, and Sir William Maynard Baronet, of several Estates, in the Counties of Bucks, Middlesex, Surry, Suffolk, and Hertford, and in the City of London; and for vesting and settling the entire Premises to the several Uses therein mentioned."

Ordered, That the said Bill be committed to the Consideration of the Lords following:

Their Lordships, or any Five of them; to meet on Monday the 9th Day of May, at Ten o'Clock in the Forenoon, in the Prince's Lodgings near the House of Peers; and to adjourn as they please.

Marquis of Tweeddale and His Majesty's Advocate against Dundase.

After hearing Counsel in Part, in the Cause wherein John Marquis of Tweeddale and His Majesty's Advocate are Appellants, and John Dundass of Newhall is Respondent:"

It is Ordered, That the further Hearing of the said Cause be adjourned till Monday next; and that the Cause which stands appointed for that Day be put off till Thursday next.

Guildford to Arundell, Road Bill.

The Lord Willoughby of Parham reported from the Lords Committees to whom the Bill, intituled, "An Act for repairing and widening the Road from the North End of Dapdon Wharf in the Parish of Stoke next Guldeford, through Guldeford, to Andrew's Cross and to Alford Bars in the County of Surry, and from thence to Saint Mary's Gate in Arundel in the County of Sussex," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Bridge at Jeremy's Ferry, Bill.

The Earl of Warwick reported from the Lords Committees to whom the Bill, intituled, "An Act for building a Bridge over the River Lea, at or near a Place called Jeremy's Ferry; and for making, repairing, and widening, Roads from thence into the Great Roads at Snarcsbrooke in the County of Essex, and at Clapton in the County of Middlesex," was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Marquis of Tweeddale and His Majesty's Advocate against Dundass.

After hearing Counsel, as well on Friday last as this Day, upon the Petition and Appeal of John Marquis of Tweeddale, and of Robert Dundas His Majesty's Advocate for Scotland, in Behalf of His Majesty; complaining of Two Interlocutors of the Lords of Session in Scotland, as Commissioners appointed by Act of Parliament for Plantation of Kirks, Valuation and Sale of Tiends, of the 25th of July 1753, and 14th of January 1756, made on the Behalf of John Dundass of Newhall; and praying, "That the said Interlocutors might be reversed or varied; and that the Appellants might have such Relief in the Premises as to this House in their Lordships great Wisdom should seem meet:" As also upon the Answer of the said John Dundass put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal be, and is hereby, dismissed this House; and that the said Interlocutors therein complained of be, and the same are hereby, affirmed.

The Lord Willoughby of Parham reported from the Lords Committees to whom the Bill, intituled, "An Act for Sale of Part of the settled Estate of William Thomson Esquire, in the County of Berks, to raise Money, towards discharging Debts and Encumbrances affecting other Parts of his settled Estates in the same County," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

A Petition of James Plunkett Esquire, Appellant in a Cause depending in this House, wherein John Knox Esquire and others are Respondents, was presented, and read; praying, "In regard there is a Treaty on Foot, to compromise and settle all Matters in Dispute between the Petitioner and the Respondents, which is likely to take Effect; that the Hearing of this Cause may be put off till next Session of Parliament, the Respondents Agent consenting thereto."

And thereupon the Agents on both Sides were called in, and heard at the Bar.

And being withdrawn:

Hearing put off till next Session.

Ordered, That the Hearing of the said Cause be put off till the next Session of Parliament, as desired.

Loxley, Enlosure Bill; King's Consent signified.

The Earl of Holdernesse acquainted the House, "That His Majesty, having been informed of the Contents of the Bill, intituled, "An Act for dividing and enclosing several Open and Arable Meadow and Pasttire Grounds, in the Parish of Loxley, in the County of Warwick," was pleased to consent (as far as the Interest of the Crown is concerned) that their Lordships may proceed therein as they shall think fit."

Then the said Bill was read a Second Time.

Ordered, That the said Bill be committed to the Consideration of the Lords Committees aforenamed:

Their Lordships, or any Five of them; to meet on Monday next, at the usual Time and Place; and to adjourn as they please.

Marquis of Tweeddale and His Majesty's Advocare against Anstruther:

A Petition of Philip Anstruther of Inverkeithing Esquire, Respondent in a Cause depending in this House, wherein John Marquis of Tweeddale and His Majesty's Advocate for Scotland are Appellants, was presented, and read; setting forth, "That the Petitioner obtained Two Interlocutors of the Lords of Session in Scotland, of the 13th of February and 17th of July 1751, finding the Tithes of his Lands of Inverkeithing saleable; and the Price thereof having been ascertained to be Nine Years Purchase, the Petitioner thereupon obtained a Charter under the Great Seal of Scotland, giving, granting, and confirming to him, the said Tithes, and was duly infeofed in the same; that an Appeal was lately brought by the said Appellants against the said Two Interlocutors; and that an Appeal was also brought by the same Appellants against Two other Interlocutors of the Lords of Session, ordaining the Tithes of the Lands of Ferryhill, belonging to John Dundass of Newhall, to be sold to him at Nine Years Purchase; and that, the Petitioner having put in his Answer to the said first mentioned Appeal, the Cause came on to be heard before this House on Monday the 21st of March last; but, in regard it was admitted by the Counsel on both Sides that the general Question was precisely the same in both these Causes, their Lordships were pleased to postpone the hearing the Petitioner's Cause till the other Appeal was determined; and that, Counsel having been heard on the said last mentioned Appeal, their Lordships were pleased to dismiss the said Appeal, and to affirm the Interlocutors complained of;" and therefore praying, In regard the Question in the Petitioner's Cause is admitted to be the same with what is already determined, with an additional Circumstance in Favour of the Petitioner, whose Right was compleated by the Grant abovementioned, that the said Interlocutors of the 13th of February and 17th of July may be affirmed, and the said Appeal dismissed."

And thereupon Mr. William Gordon Agent for the Petitioner, and Mr. George Ross Agent for the Appellants, were called in, and heard at the Bar.

And being withdrawn:

Judgement by Consent.

Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled (by Consent of the Agents on both Sides signified at the Bar), That the said Appeal be dismissed; and that the said Interlocutors therein complained of be, and the same are hereby, affirmed.

The Lord Cathcart reported from the Lords Committees to whom the Bill, intituled, "An Act for regulating and improving certain Benefactions, vested in the Rector, Principal, Professors, and Masters, of the University and College of Glasgow," was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."
