The Lord Willoughby of Parham reported from the Lords Committees to whom the Bill, intituled, "An Act for enabling the surviving Trustees and Executors of John late Earl of Ashburnham, deceased, to sell and convey his Estate at Bretherton, in the County of Lancaster, pursuant to the Directions, and for the Purposes, of his Will," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Bill, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Ordered, That the said Bill be engrossed.

Stourbridge and other Roads, Bill.

The Earl of Warwick reported from the Lords Committees to whom the Bill, intituled, "An Act for repairing and widening several Roads leading from the Market-house in Stourbridge, and other Roads therein mentioned, in the Counties of Worcester, Stafford, Salop, and Warwick, respectively," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Manchester Church, Bill:

Ennever's Divorce Bill.

The Earl of Warwick (according to order) reported the Amendments made by the Committee of the whole House to the Bill, intituled, "An Act to dissolve the Marriage of John Ennever Gentleman with Mary Cornwell his now Wife; and to enable him to marry again; and for other Purposes therein mentioned."

Which, being read Twice by the Clerk, were agreed to by the House.

Ordered, That the Bill, with the Amendments, be engrossed.

Bernard against Woodley & al.

The House being informed, "That a Person attended, in order to deliver in Copies of certain Papers and Proceedings, in a Cause depending in this House, wherein Roger Bernard Esquire is Appellant, and Francis Woodley and John Dixon are Respondents:"

Pleadings proved.

He, Patrick Keaghran, was called in, and delivered at the Bar the said Copies; and attested upon Oath, The same were true, he having examined them with the Originals in the proper Offices in Ireland."

And then he withdrew.

Quarantine Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act to oblige Ships more effectually to perform their Quarantine, and for the better preventing the Plague being brought from Foreign Parts into Great Britain or Ireland, or the Isles of Guernsey, Jersey, Alderney, Sark or Man."

After some Time, the House was resumed.

And the Earl of Warwick reported from the said Committee, "That they had gone through the Bill, and made some Amendments thereto; which he would be ready to report, when the House will please to receive the same."

Ordered, That the said Report be received Tomorrow.

Lady Ann Jekyll's Bill.

Hodie 2^a vice lecta est Billa, intituled, "An Act for vesting the undivided Twelfth Part of Ann Jekyll, an Infant, in the Real Estate of Sir Joseph Jekyll Knight, deceased, in Trustees, to enable them to convey the same to the Purchasers thereof under a Decree of the Court of Chancery."

A Petition of Captain John Sutherland, Appellant in a Cause depending in this House, wherein Captain John Scot and others are Respondents, was presented, and read; setting forth Proceedings had before the Lords of Session in Scotland, by reason whereof the Cause is not in a proper State to be appealed; and praying, In as much as no final Determination of the Matters in Question can be made on the Hearing of the present Appeal; that the Petitioner may be at Liberty to withdraw his said Appeal, without Prejudice to the Petitioner's or the Respondents being at Liberty to appeal, as they shall be advised, after the Cause shall be finally determined by the said Lords of Session."

And thereupon the Agents on both Sides were called in, and heard at the Bar.

And being withdrawn:

Appeal withdrawn.

Ordered, That the Petitioner be at Liberty to withdraw his Appeal, as desired; and that he do pay, or cause to be paid, to the Respondents, Twenty Pounds, for their Costs occasioned by the bringing of the said Appeal.

Mr. Pitt and the Rector of Stratfield Sea, Exchange, &c. Bill.

With a Bill, intituled, "An Act for confirming an Agreement between George Pitt Esquire, and the Rector of the Church of Stratfield Sea, in the County of Southampton, for Exchange of Lands in the said Parish; and to enable the said George Pitt to take down the present and erect a new Parish Church there; and for making Roads to the said Church;" to which they desire the Concurrence of this House.

The House being moved, "That a Day may be appointed, for hearing Counsel, to argue the Errors assigned upon the Writ of Error depending in this House, wherein Mathew Bogle and William Robb are Plaintiffs, and His Majesty's Advocate for Scotland, for His Majesty's Interest, is Defendant:

It is Ordered, That this House will hear the said Errors argued, by Counsel, at the Bar, on the First vacant Day for Causes after those already appointed.

Erskine against Monro;

A Petition of Henry Dagge, Agent for David Erskine, Appellant in a Cause depending in this House, in which Alexander Monro is Respondent, was presented, and read; praying, "In regard the Petitioner did not receive any Papers in the said Cause till the End of last Month, and the Proceedings below are very voluminous; that the Hearing thereof, which is appointed for Monday next, may be put off till the First vacant Day for Causes after the Recess."

And thereupon the Agents on both Sides were called in, and heard at the Bar.

The Earl of Warwick reported from the Lords Committees to whom the Bill, intituled, "An Act for vesting the undivided Twelfth Part of Ann Jekyll, an Infant, in the Real Estate of Sir Joseph Jekyll Knight, deceased, in Trustees, to enable them to convey the same to the Purchasers thereof under a Decree of the Court of Chancery:" [ (fn. 2) was committed] "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Edinburgh publick Buildings, Bill.

The Earl of Warwick also reported from the Lords Committees to whom the Bill, intituled, "An Act for erecting several Publick Buildings in the City of Edinburgh; and to empower the Trustees therein mentioned to purchase Lands for that Purpose; and also for widening and enlarging the Streets of the said City, and certain Avenues leading thereunto," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."
