The Earl of Warwick reported from the Lords Committees to whom the Bill, intituled, "An Act for naturalizing John Daniel Paul," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Ordered, That the said Bill be engrossed.

Macleod's Bill.

The Earl of Hyndford reported from the Lords Committees to whom the Bill, intituled, "An Act for vesting certain Adjudications, now vested in the Crown by the Conviction or Attainder of Alexander Mackenzie of Fraserdale, in Hugh Macleod of Genies Esquire," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Duty on Silver Plate, Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act for granting to His Majesty several Rates and Duties, payable by all Persons and Bodies Politick or Corporate, having certain Quantities of Silver Plate."

After some Time, the House was resumed.

And the Earl of Warwick reported from the Committee, "That they had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Supply of Seamen, Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee on the Bill, intituled, "An Act for the better Supply of Mariners and Seamen, to serve in His Majesty's Ships of War, and on board Merchant Ships, and other Trading Ships and Vessels."

After some Time, the House was resumed.

And the Earl of Warwick reported from the Committee, "That they had gone through the Bill, and directed him to report the same to the House, without any Amendment."

King's Answer to the Address of both Houses.

The Lord Chamberlain reported, "That the Lord Steward and he had, in Pursuance of their Lordships Order, waited upon His Majesty, with the Address of both Houses; to which His Majesty was pleased to return the following most Gracious Answer:

"I am always very glad to do any Thing that is agreeable to My Parliament, and for the Benefit and Security of My People: And as both Houses desire that a Body of My German Troops should be brought over hither, to assist in the Defence of this Kingdom in the present critical Conjuncture, I will give immediate Orders for that Purpose."

Irvine against Irvine.

After hearing Counsel in Part, in the Cause wherein John Irvine of New Orchard is Appellant, and John Irvine of Cove Respondent:

It is Ordered, That the further Hearing of the said Cause be adjourned till To-morrow.

Embanking Fen Lands in the Isle of Ely, Bill.

Aston and Shardlow Common, Bill.

L. Bulkeley's Bill.

The Lord Willoughby of Parham reported from the Lords Committees to whom the Bill, intituled, "An Act for carrying into Execution several Contracts, made by or on the Behalf of James late Lord Bulkeley in the Kingdom of Ireland, in his Life-time, for the Sale of several Lands and Tenements in the County of Chester; and for applying the Purchasemoney to discharge Encumbrances affecting the same," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the said Bill, and directed him to report the same to the House, without any Amendment."

Ordered, That the said Bill be engrossed.

Wandsford Bridge Road, Bill.

The Lord Willoughby of Parham also reported from the Lords Committees to whom the Bill, intituled, An Act for enlarging and altering the Term and Powers granted by an Act made in the Twentysecond Year of His present Majesty's Reign, for effectually amending and repairing the Road leading from Wandsford Bridge in the County of Northamp ton, to the Town and Borough of Stamford in the County of Lincoln, and for repairing the Road from the Borough of Stamford to Stapleford Bridge in the Parish of Ryhall in the County of Rutland, and from thence to Bourne in the County of Lincoln," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Coleham Bridge Road, Bill.

The Lord Willoughby of Parham also reported from the Lords Committees to whom the Bill, intituled, "An Act for repairing and widening the Roads from Coleham Bridge in Shrewsbury to the Market-place in Church Stretton, and to the Top of Lythwood Hill, and from Pulley Common to the May Pole in Condover, and from Coleham Bridge to Longdon in the County of Salop," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

With a Bill, intituled, "An Act for granting to His Majesty a Duty upon Licenses for retailing Beer, Ale, and other Exciseable Liquors; and for establishing a Method of granting such Licenses in Scotland; and for allowing such Licenses to be granted at a Petty Session in England, in a certain Case therein mentioned;" to which they desire the Concurrence of this House.

Cards and Dice, Duty on, Bill.

A Message was brought from the House of Commons, by Mr. Hardinge and others:

To return the Bill, intituled, "An Act to enable John Earl of Sandwich, George Earl of Cholmondeley, and Wellbore Ellis Esquire, to take, in Great Britain, the Oath of Office, as Vice Treasurer and Receiver General and Paymaster General of all His Majesty's Revenues in the Kingdom of Ireland; and to qualify themselves for the Enjoyment of the said Offices;" and to acquaint this House, that they have agreed to the same, without any Amendment.

Irvine against Irvine.

After hearing Counsel further, in the Cause wherein John Irvine of New Orchyard is Appellant, and John Irvine of Cove Respondent:

It is Ordered, That the further Hearing of the said Cause be adjourned till Monday next; and that the Cause which stands for that Day be put off till Wednesday next; and that the other Causes be removed in Course.

His Majesty's Advocate against Forbes of Pitsligo.

Upon reading the Petition and Appeal of Robert Dundas of Arniston Esquire, His Majesty's Advocate for Scotland, on Behalf of His Majesty; complaining of an Interlocutor of the Lords of Session in Scotland, of the 6th of March 1756; and also of an Interlocutor of the Lord Ordinary, of the 10th of the same Month; and praying, "That the same may be reversed or varied; and that the Appellant, on Behalf of His Majesty, may have such Relief in the Premises as to this House in their Lordships great Wisdom and Justice should seem meet; and that John Forbes Master of Pitsligo may be required to answer the said Appeal:"

It is Ordered, That the said John Forbes may have a Copy of the said Appeal; and do put in his Answer thereunto, in Writing, on or before Friday the 30th Day of this Instant April; and Service of this Order upon any of his Counsel or Agents in the Court below shall be deemed good Service.

To return the Bill, intituled, "An Act for raising Money, out of the Estates of Ralph Lane Esquire, deceased, in the Counties of Northampton and Cambridge, for discharging the Encumbrances affecting the same; and for applying Part of the Personal Estate of Elizabeth Lane his Wife, deceased, in the Purchase of the Cambridgeshire Estate, to be settled pursuant to her Will;" and to acquaint this House, that they have agreed to the same, without any Amendment.

Sir H. Williams's Bill.

The Lord Sandys reported from the Lords Committees to whom the Bill, intituled, "An Act for vesting the Manor of Northall, and divers Lands and Hereditaments in the County of Middlesex, settled on the Marriage of Sir Hutchins Williams Baronet, and devised by the Will of William Peere Williams his Father, respectively, in Trustees, in order to be conveyed to Agatha Child Widow, and her Heirs, pursuant to Articles of Agreement for that Purpose; and for laying out the Money arising by Sale of the Estate devised by the said Will in the Purchase of Lands, to be settled to the Uses in that Will; and for other Purposes therein mentioned," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

After hearing Counsel, as well on Thursday and Friday last as this Day, upon the Petition and Appeal of John Irvine of New Orchard; complaining of an Interlocutor of the Lords of Session in Scotland, of the 10th of July 1751; and of several Interlocutors of the Lord Ordinary, of the 15th of November 1751, 11th of January and 11th of June 1752, 20th of July 1754, and 6th of February 1755; and also of another Interlocutor of the said Lords, of the 1st of July 1755, made on the Behalf of John Irvine of Cove; and praying, "That the same might be reversed, varied, or altered:" As also upon the Answer of the said John Irvine of Cove put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal be, and is hereby, dismissed this House; and that the said several Interlocutors therein complained of be, and the same are hereby, affirmed.

River Nine, Bill.

A Message was brought from the House of Commons, by Mr. Cartwright and others:

With a Bill, intituled, "An Act for explaining, amending, and rendering more effectual, Two several Acts of Parliament; One of them, passed in the Thirteenth Year of Her late Majesty Queen Anne, for making the River Nine, or Nen, running from Northampton to Peterborough, navigable; and the other, made in the Eleventh Year of His late Majesty King George the First, for making more effectual the said former Act;" to which they desire the Concurrence of this House.

The said Two Bills were read the First Time.

Message from H. C. to return L. Vere's Bill.

A Message was brought from the House of Commons, by Mr. Sandys and others:

To return the Bill, intituled, "An Act for vesting the Capital Messuage of Halfted, and divers Lands in Kent, Part of the settled Estate of Vere Lord Vere, in Trustees, to be conveyed to Robert Bagshaw Esquire, the Purchaser thereof, pursuant to Articles; and for settling another Estate, in the County of Middlesex, of greater Value, in Lieu thereof;" and to acquaint this House, that they have agreed to the same, without any Amendment.

D. of Marlborough takes the Oaths.

Charles Duke of Marlborough took the Oaths, and made and subscribed the Declaration, and also took and subscribed the Oath of Abjuration, pursuant to the Statutes; his Grace having first delivered a Certificate of his receiving the Sacrament, to the Truth whereof Witnesses were sworn and examined.

Leman's Bill.

The Earl of Warwick reported from the Lords Committees to whom the Bill, intituled, "An Act for confirming a Partition between John Leman Esquire and Elizabeth Newnham and John Newnham Esquire, of several Estates, in the City of London and Counties of Middlesex and Huntingdon; and for vesting and settling the entire Premises which, on such Partition, were allotted to the said John Leman, Elizabeth Newnham, and John Newnham, respectively, to the Uses therein mentioned," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and made One Amendment thereto."

Which Amendment, being read Twice by the Clerk, was agreed to by the House.

Ordered, That the said Bill, with the Amendment, be engrossed.

Aften and Shardlaw Common Bill.

Upon reading the Petition of Thomas Trotter of Edinburgh Merchant, Attorney and Factor of Henry Trotter of Morton Hall in the Shire of Edinburgh Esquire; alleging, "That, if the Bill now depending before their Lordships, for supplying the City of Edinburgh with fresh and wholesome Water, should pass into a Law, it will greatly affect and prejudice the Property of the said Henry Trotter, who is now beyond Sea, in the Dominions of the Empress of Russia;" and therefore praying, "That the said Bill may not pass; and that the said Henry Trotter may be heard, by his Counsel, against the same, or have such other Relief as to their Lordships shall seem meet:"

It is Ordered, That the Consideration of the said Petition be referred to the Lords Committees to whom the said Bill stands committed; and that the said Henry Trotter may be heard, by his Counsel, against the said Bill, before the said Committee, as desired.

Sheffield and Ecclesall Courts Baron, Bill.

After hearing Counsel, as well Yesterday as this Day, upon the Petition and Appeal of Colonel John Scott of Commiston, and John Fullarton of Kinnaber; complaining of certain Interlocutors of the Lords of Session in Scotland, of the 8th of July and 18th of November 1752, and of the 26th of July and 9th of August 1755; and praying, "That the same might be reversed, varied, or altered; and that the Appellants might have such other Relief in the Premises as to this House should seem just:" As also upon the Answer of Arthur Straton put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

Judgement.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Interlocutors of the 8th of July and 18th of November 1752 be, and the same are hereby, reversed; and that, in the Interlocutor of the 26th of July 1755, after the Words ["sole and exclusive Right of Salmon Fishing"], these Words ["in the Sea"] be inserted; and, after the Words ["within the Bounds and Limits of the Lands of Kirkside"]; the Words ["at all Times of the Tide"] be left out; and that, after the Words ["through the Wynd Path down to the Sea"], these Words be inserted, ["but has no Right of Salmon Fishing in the River Northesk, so far, and at such Times, as the Stream or Water of the said River can be distinguished from the Water of the Sea"]: And it is hereby further Ordered and Adjudged, That, with these Variations, the last mentioned Interlocutor, and the said Interlocutor of the 9th of August 1755 adhering thereto, be, and the same are hereby, affirmed.
