Skrine's Bill: Standing Order dispensed with.

The Order of the Day being read, for taking into Consideration the Motion made Yesterday, for dispensing with the Standing Order of this House, in relation to Bills for selling Lands in one Place, and buying Lands in another, so far as that the Committee to whom the Bill, intituled, "An Act for vesting in Trustees certain Messuages, Lands, Tenements, and Farms; in the County of Surry, settled upon the Marriage of Richard Dickson Skrine Esquire with Elizabeth his now Wife, to be sold, and conveyed pursuant to Articles; and for laying out the Purchase-money in other Lands and Tenements, to be settled to the Uses of their Marriage Settlement," stands committed, may proceed thereupon, notwithstanding there is not an actual Agreement yet made for the Purchase of another Estate, to be settled, in Lieu of that to be sold, as required by the said Standing Order:

After hearing Counsel, as well Yesterday as this Day, upon the Petition and Appeal of Sir Alexander Ross of Balnagowan Baronet, an Infant, and of Dame Jane Sinclair, Widow of Sir Charles Gilmour of Craigmiller Baronet, Andrew Mitchel of Thainston Esquire, and Adam Ingles Younger of Cramond Esquire, his Curators or Guardians; complaining of an Interlocutor of the Lords of Session in Scotland, of the 26th of November 1755, made on the Behalf of Lieutenant Colonel James Lockhart; and praying, "That the same might be reversed; and that the Appellants might have such other Relief in the Premises as to this House in their Lordships great Wisdom should seem meet:" As also upon the Answer of the said Lieutenant Colonel James Lockhart put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

Interlocutor affirmed.

After hearing Counsel, as well Yesterday as this Day, upon the Petition and Appeal of William Lucas Esquire, since deceased, which, by Order of this House, of the 21st of November last, was revived in the Names of Alice Lucas Widow, Relict and only acting Executrix of the said William Lucas, and of Elizabeth Lucas his only Child, an Infant; complaining of an Order of the Court of Exchequer in Ireland, of the 1st of February 1755; and praying, "That the same might be reversed and set aside; and that this House would grant the Appellants such further and other Relief in the Premises as the Nature and Circumstances of the Case might require:" As also upon the Answer of Henry Byrne, Francis Lucas, and Charles Lucas, Minors, by Richard Mullegan their Guardian, and the Answer of the said Richard Mullegan, put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

Order affirmed, with Variations.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Order complained of in the said Appeal be, and the same is hereby, affirmed, with the following Variation, videlicet, "That the Respondents to pay the Appellants their Costs of the last Trial in this Cause, to be taxed by the Deputy Remembrancer of the said Court, before any new Trial be had; and that the said Court do appoint such Time for the new Trial of the First Issue in this Cause, and also for trying of the Second Issue, as shall be proper:" And it is hereby further Ordered, That the said Court of Exchequer do give the proper Directions for carrying this Judgement into Execution, and all such further Directions as shall be just.

Walker's Bill.

The Earl of Warwick reported from the Lords Committees to whom the Bill, intituled, "An Act for vesting divers Lands and Hereditaments, in the Counties of Bucks and Berks, late the Estate of Thomas Walker Clerk, deceased, in Thomas Walker the Grandson, in Fee Simple, subject to the raising Portions for his Younger Brother and Sisters," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

A Message was brought from the House of Commons, by Mr. Cooke and others:

With a Bill, intituled, "An Act for the better regulating the Nightly Watch and Beadles, and cleansing, enlightening, and paving, the Streets, Squares, Lanes, and other Passages, and repairing the Highways and Causeways, and regulating the Poor, within the Parish of St. Mary le Bone, in the County of Middlesex;" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Table of Fees, the Part which directs no more than One Double Fee to be taken for any Bill except Nat Bills, to be considered.

Ordered, That all the Lords who have been present this Session of Parliament be appointed a Committee, to consider so much of the Table of Fees, relating to Private Bills, as restrains the Clerks and Officers of this House from taking more than a Double Fee for any Bill, except in Cases of Naturalization; and to report their Opinion thereupon to the House.

Erskine & al. against Scot.

A Petition of Francis Erskine and others Appellants, in a Cause depending in this House, was presented, and read; taking Notice of a former Petition for putting off the Hearing of their Cause, which their Lordships were pleased to reject; and setting forth, "That One of the Appellants is now on the Road from Edinburgh to London, with the Exhibits which were produced in the Cause below, as also Money to fee Counsel; but, as it may be the End of this or the Beginning of next Week before he will arrive in London, the Cause cannot be argued on the Part of the Appellants if the Hearing shall come on next Monday, which is the Day appointed for the same; and that it will be a considerable Loss, not only to the Appellants, but also to the Publick in North Britain, if this Cause shall be heard only on the Part of the Respondents;" and therefore praying, "That the said Hearing may be put off for a few Days."

Ordered, That the Hearing of the said Cause be put off to Thursday next, the 26th Instant.

With a Bill, intituled, "An Act for repairing and widening the Roads leading from a Pond belonging to Henry Eyre Esquire, in the Parish of White Parish in the County of Wilts, to the Top of Dunwood Hill, and from thence, over Great-bridge and Middle-bridge, through Romsey-infra, to Hundred-bridge in the County of Southampton, and from thence to the County of the Town of Southampton;" to which they desire the Concurrence of this House.

Old Street Road, Bill.

With a Bill, intituled, "An Act to enable the Trustees for repairing Old Street Road to repair, widen, and make, a Road, from the Sign of The Red Lion on Windmill Hill, through Worship Street, to the Ditch Side near the East Side of Holy Well Mount, and through a certain Ground, to the Sign of The London Apprentice, in the (fn. 1) Parishes of Saint Luke and Saint Leonard Shoreditch in the County of Middlesex, or to lay open, repair, and widen, a Road from the said Red Lion, through The Dog Bar, into The Old Street Road, in the said County;" to which they desire the Concurrence of this House.

A Petition of Henry Viscount Irwin, and of George Ingram the Brother, and Charles Ingram the Nephew, of the said Henry Viscount Irwin, was presented, and read; setting forth, "That they have prepared and signed a Petition to this House, for Leave to bring in a Private Bill, for the Purposes therein mentioned; but, as a Matter of so great Consequence and Importance to the Family required some Time for Consideration and Advice amongst the Petitioners, who live at a Distance from one another, the said Petition could not be prepared, signed, and exhibited, within the Time limited by Order of this House for receiving Petitions for Private Bills; and therefore praying, "That they may be at Liberty to present their said Petition, notwithstanding the Time so limited is expired."

The Lord Viscount Fauconberg (pursuant to an Order of the 26th of January last) presented to the House a Bill, intituled, "An Act for dividing and enclosing the undivided Parts of the several Common Fields in the Township of Warthill, in the Connty of York; and for giving Compensations to the Rector of Holtby, in the same County, and the Vicar of Warthill aforesaid, in Lieu of Tithes and certain Ecclesiastical Dues."

The said Bill was read the First Time.
