List of the State of the Navy returned, signed.
Mr. Hill, at the Bar, delivered a List of the present State of Her Majesty's Royal Navy, in relation to their Repairs, and what Condition they are in for the Sea Service; which was returned, to be signed by the Commissioners of the Navy, by Order of this House of the Thirteenth Instant, in order to the greater Certainty of it, as signed by the said Commissioners. And as to the Councils of War desired, he says, "There are none of them in their Office."
Haydon's Petition retened to Judges.
Upon reading the Petition of Alice Haydon Widow and Relict of Gideon Haydon Esquire, deceased, Robert Russell Uncle and Guardian of Gideon Haydon and Tho. mas Haydon, Infants, Children of the said Gideon Haydon and Alice his Wife, for and on Behalf of the said Infants, and William Fitch Esquire and William Haydon Gentleman, surviving Trustees in the Marriage Settlement of the said Gideon and Alice; praying Leave to bring in a Bill, for the Sale of the Manors of Farwood and Farway, and divers other Lands and Tenements, in the County of Devon, for Payment of the Debts wherewith they are incumbered; and for laying out the Overplus of the Monies in the Purchase of other Lands and Tenements, to be settled for the Jointure of the Petitioner Alice, and for the Provision of the said Infants:
It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Petition shall be, and is hereby, referred to the Lord Chief Justice of the Court of Common Pleas and Mr. Justice Powys; who are forthwith to summon all Parties that are to be concerned in the Bill; and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Patties concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.
Councils of War, relating to Spain, to be laid before the House;
It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Secretary at War do lay before this House the Two Councils of War mentioned in a Paper, intituled, "The Memorial of the Earl of Peterborow, and Result of a Council of War thereon, dated the Twenty-fourth of August, One Thousand Seven Hundred and Five;" which Councils of War are dated the Sixteenth and Twenty-second of the same August, One Thousand Seven Hundred and Five, and all other Councils of War relating to the War in Spain.
and the Order of the 22th of March, 1705/6.
It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Lord High Admiral of Great Britain be, and he is hereby, desired to cause to be laid before this House the Order of the 22th March, 1705/6, mentioned in a Council of War, dated April 4th, 1706.
War in Spain.
The House, pursuant to Order, was adjourned during Pleasure, and put into a Committee, in relation to the War in Spain, and the Papers relating thereto.
After some Time, the House was resumed.
And the Lord Herbert reported, "That the Committee of the whole House had made some further Progress in the Matters to them referred; and desired another Time may be appointed, for the House to be in a Committee, to proceed therein."
It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That To-morrow, at Twelve a Clock, this House shall be put into a Committee again, to consider further the State of the Nation, in relation to the War in Spain, and the Papers relating thereunto.
Adjourn.
