Stokes versus Clarke:
After hearing Counsel, upon the Petition and Appeal of Abjohn Stokes, the Uncle, Heir, and Administrator of Christopher Stokes Gentleman, deceased, who was Son and Heir, and Administrator, with the Will annexed, of Christopher Stokes the Father, as Husband and Administrator of Mary Ailoffe his late Wife, deceased, and also Administrator, with the Will annexed, of the said Christopher the Father, of his Good unadministered by the said Christopher Stokes the Son, from a Decree made in the Court of Chancery, the Third of February, Undecimo Gulielmi Tertii Regis, on the Behalf of Richard Clarke and Susannah his Wife, late Susannah Rainbut Widow, and Philip Jenkins the Son, Heir, and Executor of Rebeccab Jenkins, deceased, and Administrator, with the Will annexed, of Jane Brooks deceased; and praying, "That so much of the said Decree as relates to the Sale of the Parsonage of Whitchurch, as also the Household Goods (other than the Plate), may be reversed;" as also upon the Answer of Richard Clarke and Susannah his Wife, late Susannah Rainbut Widow, and Philip Jenkins the Son, Heir, and Executor of Rebeccah Jenkins, deceased, Administrator, with the Will annexed, of Jane Brooks, deceased, put in thereunto; and due Consideration of what was offered thereupon:
Judgement.
It is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the Decree complained of in the said Appeal shall be, and is hereby, reversed, as to so much thereof as decrees Christopher Stokes the Younger to account for the Rents and Profits of the Rectory of Whitchurch in Question, since the Death of Mary Ailoffe, and to assign the said Rectory and Premises to the Respondent Susannah Rainbut and Philip Jenkins; and as to those Particulars the Bill in Chancery is hereby dismissed; and as to all other Matters, the Decree is hereby affirmed.
